          Amends the Election Code.  Provides that  the  nomination
      papers  of  the  candidate shall contain a statement that the
      candidate has complied with (or is  not  required  to  comply
      with)  the  disclosure  requirements  of  Article  9  of  the
      Election  Code.    Provides  that  it shall be grounds for an
      objection if a candidate willfully makes a false statement in
      the nomination papers.  Effective immediately.

 1        AN ACT to amend the Election Code  by  changing  Sections
 2    7-10, 8-8, 10-5, and 10-8.
 3        Be  it  enacted  by  the People of the State of Illinois,
 4    represented in the General Assembly:
 5        Section 5.  The Election  Code  is  amended  by  changing
 6    Sections 7-10, 8-8, 10-5, and 10-8 as follows:
 7        (10 ILCS 5/7-10) (from Ch. 46, par. 7-10)
 8        Sec.  7-10.  The  name of no candidate for nomination, or
 9    State central  committeeman,  or  township  committeeman,  or
10    precinct  committeeman, or ward committeeman or candidate for
11    delegate  or  alternate  delegate  to   national   nominating
12    conventions,  shall be printed upon the primary ballot unless
13    a petition for nomination has been filed  in  his  behalf  as
14    provided in this Article in substantially the following form:
15        We,  the  undersigned, members of and affiliated with the
16    ....  party  and  qualified  primary  electors  of  the  ....
17    party, in the ....  of ...., in the county of ....  and State
18    of  Illinois,  do  hereby  petition  that the following named

14        Each  sheet  of  the petition other than the statement of
15    candidacy and candidate's statement shall be of uniform  size
16    and   shall   contain  above  the  space  for  signatures  an
17    appropriate heading giving the  information  as  to  name  of
18    candidate  or  candidates,  in  whose behalf such petition is
19    signed; the office, the political party represented and place
20    of residence; and the heading of  each  sheet  shall  be  the
21    same.
22        Such  petition  shall  be  signed  by  qualified  primary
23    electors  residing  in  the  political division for which the
24    nomination is sought in their own  proper  persons  only  and
25    opposite  the signature of each signer, his residence address
26    shall be written or printed.  The residence address  required
27    to  be  written  or  printed  opposite each qualified primary
28    elector's name shall include  the  street  address  or  rural
29    route  number  of  the signer, as the case may be, as well as
30    the signer's city, village or town.  However  the  county  or
31    city, village or town, and state of residence of the electors
32    may  be  printed  on  the  petition  forms  where  all of the
33    electors signing the petition reside in the  same  county  or
34    city,  village or town, and state. Standard abbreviations may

 1    be used in writing the residence  address,  including  street
 2    number,  if any. At the bottom of each sheet of such petition
 3    shall be added a statement signed by a  registered  voter  of
 4    the  political  division,  who has been a registered voter at
 5    all times he or she circulated the petition,  for  which  the
 6    candidate is seeking a nomination, stating the street address
 7    or  rural  route  number of the voter, as the case may be, as
 8    well as the voter's city, village  or  town;  and  certifying
 9    that the signatures on that sheet of the petition were signed
10    in his presence; and either (1) indicating the dates on which
11    that  sheet  was  circulated, or (2) indicating the first and
12    last  dates  on  which  the  sheet  was  circulated,  or  (3)
13    certifying that none of the  signatures  on  the  sheet  were
14    signed  more  than  90  days  preceding  the last day for the
15    filing of the petition, or more than 45  days  preceding  the
16    last  day for filing of the petition in the case of political
17    party and independent candidates for single  or  multi-county
18    regional  superintendents  of  schools  in  the  1994 general
19    primary election; and certifying that the signatures  on  the
20    sheet  are  genuine,  and  certifying that to the best of his
21    knowledge  and belief the persons so signing were at the time
22    of signing the petitions qualified voters  of  the  political
23    party  for which a nomination is sought. Such statement shall
24    be sworn to before  some  officer  authorized  to  administer
25    oaths in this State.
26        No  petition  sheet shall be circulated more than 90 days
27    preceding the last day  provided  in  Section  7-12  for  the
28    filing  of  such petition, or more than 45 days preceding the
29    last day for filing of the petition in the case of  political
30    party  and  independent candidates for single or multi-county
31    regional superintendents  of  schools  in  the  1994  general
32    primary election.
33        The  person circulating the petition, or the candidate on
34    whose behalf the  petition  is  circulated,  may  strike  any

 1    signature from the petition, provided that;
 2             (1)  the person striking the signature shall initial
 3        the  petition at the place where the signature is struck;
 4        and
 5             (2)  the person striking the signature shall sign  a
 6        certification  listing the page number and line number of
 7        each  signature   struck   from   the   petition.    Such
 8        certification shall be filed as a part of the petition.
 9        Such  sheets  before being filed shall be neatly fastened
10    together in book form, by placing the sheets in  a  pile  and
11    fastening  them together at one edge in a secure and suitable
12    manner, and the sheets shall then be numbered  consecutively.
13    The sheets shall not be fastened by pasting them together end
14    to  end,  so  as  to  form  a  continuous strip or roll.  All
15    petition  sheets  which  are  filed  with  the  proper  local
16    election officials, election authorities or the  State  Board
17    of  Elections  shall  be  the original sheets which have been
18    signed by the voters and by the circulator thereof,  and  not
19    photocopies or duplicates of such sheets.  Each petition must
20    include  as a part thereof, a statement of candidacy for each
21    of the candidates filing, or in whose behalf the petition  is
22    filed.  This  statement  shall  set  out  the address of such
23    candidate, the office for which  he  is  a  candidate,  shall
24    state  that the candidate is a qualified primary voter of the
25    party to which the petition relates and is qualified for  the
26    office  specified  (in  the  case  of a candidate for State's
27    Attorney it shall state that the candidate is at the time  of
28    filing  such  statement  a  licensed  attorney-at-law of this
29    State), shall state that the candidate has complied with  (or
30    is not required to comply with) the requirements of Article 9
31    of  this  Code,  shall  state that he has filed (or will file
32    before the close of the petition filing period)  a  statement
33    of   economic   interests   as   required   by  the  Illinois
34    Governmental Ethics Act, shall request that  the  candidate's

 1    name  be  placed  upon  the  official  ballot,  and  shall be
 2    subscribed and sworn to by such candidate before some officer
 3    authorized to take acknowledgment of deeds in the  State  and

 4        The petitions, when filed,  shall  not  be  withdrawn  or
 5    added  to,  and  no  signatures  shall  be  revoked except by
 6    revocation  filed  in  writing  with  the  State   Board   of
 7    Elections, election authority or local election official with
 8    whom  the  petition  is  required to be filed, and before the
 9    filing of such petition.  Whoever forges the name of a signer
10    upon any petition required by this Article is  deemed  guilty
11    of  a  forgery  and  on  conviction thereof shall be punished
12    accordingly.
13        Petitions of candidates for nomination for offices herein
14    specified, to be filed with the same officer, may contain the
15    names of 2 or more candidates of the same political party for
16    the same or different offices.
17        Such petitions for nominations shall be signed:
18             (a)  If for a  State  office,  or  for  delegate  or
19        alternate  delegate to be elected from the State at large
20        to a National nominating  convention  by  not  less  than
21        5,000 nor more than 10,000 primary electors of his party.
22             (b)  If  for a congressional officer or for delegate
23        or alternate delegate to be elected from a  congressional
24        district  to a national nominating convention by at least
25        .5% of the qualified primary electors of his party in his
26        congressional district, except that for the first primary
27        following a redistricting of congressional districts such
28        petitions shall be  signed  by  at  least  600  qualified
29        primary   electors   of  the  candidate's  party  in  his
30        congressional district.
31             (c)  If for a county office (including county  board
32        member  and  chairman  of  the county board where elected
33        from the county  at  large),  by  at  least  .5%  of  the
34        qualified   electors  of  his  party  cast  at  the  last

 1        preceding general election in his  county.   However,  if
 2        for  the  nomination  for  county  commissioner  of  Cook
 3        County,  then  by  at  least .5% of the qualified primary
 4        electors of his or her party in his or her county in  the
 5        district  or division in which such person is a candidate
 6        for nomination; and if for county  board  member  from  a
 7        county  board  district,  then  by  at  least  .5% of the
 8        qualified primary electors of his  party  in  the  county
 9        board  district.   In  the case of an election for county
10        board member to be elected from a district, for the first
11        primary  following  a  redistricting  of   county   board
12        districts  or  the  initial establishment of county board
13        districts, then by at least .5% of the qualified electors
14        of his party in the entire county at the  last  preceding
15        general  election,  divided by the number of county board
16        districts, but in any event not less  than  25  qualified
17        primary electors of his party in the district.
18             (d)  If  for  a  municipal  or township office by at
19        least .5% of the qualified primary electors of his  party
20        in  the  municipality or township; if for alderman, by at
21        least .5% of the voters of his party of his ward.  In the
22        case  of  an  election  for  alderman  or  trustee  of  a
23        municipality to be elected from a ward or  district,  for
24        the  first  primary  following  a  redistricting  or  the
25        initial  establishment of wards or districts, then by .5%
26        of the total number of votes cast for  the  candidate  of
27        such  political  party who received the highest number of
28        votes in the entire  municipality  at  the  last  regular
29        election  at  which an officer was regularly scheduled to
30        be elected from the entire municipality, divided  by  the
31        number  of  wards or districts, but in any event not less
32        than 25 qualified primary electors of his  party  in  the
33        ward or district.
34             (e)  If  for State central committeeman, by at least

 1        100 of the primary electors of his or her party of his or
 2        her congressional district.
 3             (f)  If for a candidate for trustee  of  a  sanitary
 4        district in which trustees are not elected from wards, by
 5        at  least  .5% of the primary electors of his party, from
 6        such sanitary district.
 7             (g)  If for a candidate for trustee  of  a  sanitary
 8        district in which the trustees are elected from wards, by
 9        at  least .5% of the primary electors of his party in his
10        ward of such sanitary district, except that for the first
11        primary following a reapportionment of the district  such
12        petitions  shall  be  signed  by  at  least 150 qualified
13        primary electors of the candidate's ward of such sanitary
14        district.
15             (h)  If for a candidate for judicial office,  by  at
16        least  500  qualified  primary  electors  of  his  or her
17        judicial district, circuit, or subcircuit,  as  the  case
18        may be.
19             (i)  If  for  a candidate for precinct committeeman,
20        by at least 10 primary electors of his or  her  party  of
21        his  or  her  precinct;  if  for  a  candidate  for  ward
22        committeeman,  by not less than 10% nor more than 16% (or
23        50 more than the minimum, whichever is  greater)  of  the
24        primary  electors  of  his  party  of  his ward; if for a
25        candidate for township committeeman, by not less than  5%
26        nor  more than 8% (or 50 more than the minimum, whichever
27        is greater) of the primary electors of his party  in  his
28        township or part of a township as the case may be.
29             (j)  If  for  a  candidate  for  State's Attorney or
30        Regional Superintendent of Schools to  serve  2  or  more
31        counties,  by at least .5% of the primary electors of his
32        party in the territory comprising such counties.
33             (k)  If for any other office by at least .5% of  the
34        total  number  of  registered  voters  of  the  political

 1        subdivision,   district   or   division   for  which  the
 2        nomination is made or  a  minimum  of  25,  whichever  is
 3        greater.
 4        For  the  purposes  of this Section the number of primary
 5    electors shall be determined by taking the total  vote  cast,
 6    in  the  applicable  district,  for  the  candidate  for such
 7    political party who received the  highest  number  of  votes,
 8    state-wide,  at  the  last  general  election in the State at
 9    which electors  for  President  of  the  United  States  were
10    elected.  For  political  subdivisions, the number of primary
11    electors shall be determined by taking the  total  vote  cast
12    for  the  candidate for such political party who received the
13    highest number of votes in such political subdivision at  the
14    last  regular  election  at  which  an  officer was regularly
15    scheduled to be elected from that subdivision.  For wards  or
16    districts  of  political  subdivisions, the number of primary
17    electors shall be determined by taking the  total  vote  cast
18    for  the  candidate for such political party who received the
19    highest number of votes in such ward or district at the  last
20    regular  election at which an officer was regularly scheduled
21    to be elected from that ward or district.
22        A "qualified primary elector" of a  party  may  not  sign
23    petitions  for  or be a candidate in the primary of more than
24    one party.

34        All  petitions  for  nomination  for  the office of State

 1    Senator shall be signed by 1% or 600, whichever  is  greater,
 2    of the qualified primary electors of the candidate's party in
 3    his  legislative  district, except that for the first primary
 4    following a  redistricting  of  legislative  districts,  such
 5    petitions  shall  be signed by at least 600 qualified primary
 6    electors  of  the  candidate's  party  in   his   legislative
 7    district.
 8        All   petitions   for   nomination   for  the  office  of
 9    Representative in the General Assembly shall be signed by  at
10    least  1%  or  300,  whichever  is  greater, of the qualified
11    primary electors of the  candidate's  party  in  his  or  her
12    representative  district,  except  that for the first primary
13    following a redistricting of  representative  districts  such
14    petitions  shall  be signed by at least 300 qualified primary
15    electors  of  the   candidate's   party   in   his   or   her
16    representative district.
17        Opposite  the signature of each qualified primary elector
18    who signs a petition for nomination for the office  of  State
19    Representative  or  State  Senator  such  elector's residence
20    address shall be written or printed.  The  residence  address
21    required  to  be  written  or printed opposite each qualified
22    primary elector's name shall include the  street  address  or
23    rural route number of the signer, as the case may be, as well
24    as the signer's city, village or town.
25        For  the  purposes of this Section, the number of primary
26    electors shall be determined by taking the total  vote  cast,
27    in  the  applicable  district,  for  the  candidate  for such
28    political party who received the  highest  number  of  votes,
29    state-wide,  at  the  last  general  election in the State at
30    which electors  for  President  of  the  United  States  were
31    elected.
32        A  "qualified  primary  elector"  of a party may not sign
33    petitions for or be a candidate in the primary of  more  than
34    one party.

 1        In  the  affidavit  at  the  bottom  of  each  sheet, the
 2    petition circulator, who shall have been a  registered  voter
 3    at  all  times he or she circulated the petition, shall state
 4    his street address or rural route number, as the case may be,
 5    as well as his city, village or town.
 6        In the affidavit at the bottom of  each  petition  sheet,
 7    the  petition  circulator shall either (1) indicate the dates
 8    on which he or she circulated that sheet, or (2) indicate the
 9    first and last dates on which the sheet  was  circulated,  or
10    (3)  certify  that  none  of the signatures on the sheet were
11    signed more than 90 days  preceding  the  last  day  for  the
12    filing   of   the  petition.   No  petition  sheet  shall  be
13    circulated more than 90 days preceding the last day  provided
14    in Section 8-9 for the filing of such petition.
15        All  petition sheets which are filed with the State Board
16    of Elections shall be the original  sheets  which  have  been
17    signed   by  the  voters  and  by  the  circulator,  and  not
18    photocopies or duplicates of such sheets.
19        The person circulating the petition, or the candidate  on
20    whose  behalf  the  petition  is  circulated,  may strike any
21    signature from the petition, provided that;
22             (1)  the person striking the signature shall initial
23        the petition at the place where the signature is  struck;
24        and
25             (2)  the  person striking the signature shall sign a
26        certification listing the page number and line number  of
27        each   signature   struck   from   the   petition.   Such
28        certification shall be filed as a part of the petition.

31        Sec. 10-5.  All petitions for nomination  shall,  besides
32    containing the names of candidates, specify as to each:
33        1.   The  office  or  offices  to which such candidate or

 1    candidates shall be nominated.
 2        2.   The  new  political  party,  if  any,   represented,
 3    expressed in not more than 5 words. However, such party shall
 4    not  bear  the  same  name  as,  nor  include the name of any
 5    established political party as defined in this Article.  This
 6    prohibition does not preclude any established political party
 7    from  making  nominations  in  those  cases  in  which  it is
 8    authorized to do so.
 9        3.  The place of  residence  of  any  such  candidate  or
10    candidates with the street and number thereof, if any. In the
11    case  of  electors  for  President  and Vice-President of the
12    United States, the names  of  candidates  for  President  and
13    Vice-President may be added to the party name or appellation.
14        Such  certificate  of  nomination or nomination papers in
15    addition shall include as a part thereof, the  oath  required
16    by Section 7-10.1 of this Act and must include a statement of
17    candidacy  for  each  of the candidates named therein, except
18    candidates for electors for President and  Vice-President  of
19    the  United  States.  Each  such  statement shall set out the
20    address of such candidate, the  office  for  which  he  is  a
21    candidate,  shall  state  that the candidate is qualified for
22    the office specified, has complied with (or is  not  required
23    to  comply  with) the requirements of Article 9 of this Code,
24    and has filed (or will file before the close of the  petition
25    filing  period) a statement of economic interests as required
26    by the Illinois Governmental Ethics Act, shall  request  that
27    the  candidate's  name be placed upon the official ballot and
28    shall be subscribed and sworn to  by  such  candidate  before
29    some  officer  authorized to take acknowledgments of deeds in
30    this State, and may be in substantially the following form:

19        In addition, a new political party  petition  shall  have
20    attached   thereto   a  certificate  stating  the  names  and
21    addresses of the party officers authorized to fill  vacancies
22    in nomination pursuant to Section 10-11.
23        Nomination  papers filed under this Section are not valid
24    if the candidate named therein fails to file a  statement  of
25    economic  interests  as required by the Illinois Governmental
26    Ethics Act in relation to his candidacy with the  appropriate
27    officer by the end of the period for the filing of nomination
28    papers  unless he has filed a statement of economic interests
29    in relation to the same governmental unit with  that  officer
30    during  the  same  calendar  year  as  the year in which such
31    nomination papers were filed.  If the  nomination  papers  of
32    any  candidate and the statement of economic interest of that
33    candidate are not required to be filed with the same officer,
34    the candidate must  file  with  the  officer  with  whom  the

 1    nomination  papers  are filed a receipt from the officer with
 2    whom the statement of economic interests is filed showing the
 3    date on which such statement was filed.  Such  receipt  shall
 4    be  so  filed not later than the last day on which nomination
 5    papers may be filed.

 8        Sec. 10-8.  Certificates  of  nomination  and  nomination
 9    papers,  and  petitions  to  submit  public  questions  to  a
10    referendum,  being  filed as required by this Code, and being
11    in apparent conformity with the provisions of this Act, shall
12    be deemed to be valid unless objection thereto is  duly  made
13    in  writing  within  5  business  days after the last day for
14    filing the certificate of nomination or nomination papers  or
15    petition   for   a   public   question,  with  the  following
16    exceptions:
17             A.  In the case of petitions to amend Article IV  of
18        the Constitution of the State of Illinois, there shall be
19        a  period  of 35 business days after the last day for the
20        filing of such  petitions  in  which  objections  can  be
21        filed.
22             B.   In the case of petitions for advisory questions
23        of public policy to be submitted to  the  voters  of  the
24        entire State, there shall be a period of 35 business days
25        after  the  last  day for the filing of such petitions in
26        which objections can be filed.
27        It shall be grounds  for  an  objection  if  a  candidate
28    wilfully  makes  a  false statement in the nomination papers.
29    Any legal voter of the political subdivision or  district  in
30    which  the candidate or public question is to be voted on, or
31    any legal voter in the  State  in  the  case  of  a  proposed
32    amendment  to  Article  IV of the Constitution or an advisory
33    public question to be submitted to the voters of  the  entire

 1    State,  having objections to any certificate of nomination or
 2    nomination   papers   or   petitions  filed,  shall  file  an
 3    objector's petition together  with  a  copy  thereof  in  the
 4    principal  office or the permanent branch office of the State
 5    Board  of  Elections,  or  in  the  office  of  the  election
 6    authority  or  local  election   official   with   whom   the
 7    certificate of nomination, nomination papers or petitions are
 8    on  file. In the case of nomination papers or certificates of
 9    nomination, the State Board of Elections, election  authority
10    or  local  election official shall note the day and hour upon
11    which such objector's petition is filed, and shall, not later
12    than 12:00 noon on the second business day after  receipt  of
13    the  petition,  transmit  by  registered  mail  or  receipted
14    personal delivery the certificate of nomination or nomination
15    papers  and  the original objector's petition to the chairman
16    of the proper electoral  board  designated  in  Section  10-9
17    hereof, or his authorized agent, and shall transmit a copy by
18    registered   mail  or  receipted  personal  delivery  of  the
19    objector's petition, to the candidate  whose  certificate  of
20    nomination or nomination papers are objected to, addressed to
21    the  place  of  residence  designated  in said certificate of
22    nomination or nomination papers.  In the case  of  objections
23    to  a  petition for a proposed amendment to Article IV of the
24    Constitution  or  for  an  advisory  public  question  to  be
25    submitted to the voters of the entire State, the State  Board
26    of  Elections  shall  note  the  day and hour upon which such
27    objector's petition is filed and shall transmit a copy of the
28    objector's petition by registered mail or receipted  personal
29    delivery  to  the person designated on a certificate attached
30    to the petition as the principal proponent of  such  proposed
31    amendment or public question, or as the proponents' attorney,
32    for  the  purpose  of receiving notice of objections.  In the
33    case of objections to a petition for a public question, to be
34    submitted to  the  voters  of  a  political  subdivision,  or

 1    district  thereof,  the  election authority or local election
 2    official with whom such petition is filed shall note the  day
 3    and  hour  upon which such objector's petition was filed, and
 4    shall, not later than 12:00 noon on the second  business  day
 5    after receipt of the petition, transmit by registered mail or
 6    receipted  personal  delivery  the  petition  for  the public
 7    question and the original objector's petition to the chairman
 8    of the proper electoral  board  designated  in  Section  10-9
 9    hereof, or his authorized agent, and shall transmit a copy by
10    registered  mail  or  receipted  personal  delivery,  of  the
11    objector's petition to the person designated on a certificate
12    attached  to  the  petition as the principal proponent of the
13    public question, or as  the  proponent's  attorney,  for  the
14    purposes of receiving notice of objections.
15        The  objector's  petition  shall give the objector's name
16    and residence address, and shall state fully  the  nature  of
17    the objections to the certificate of nomination or nomination
18    papers or petitions in question, and shall state the interest
19    of  the  objector and shall state what relief is requested of
20    the electoral board.
21        The provisions of this  Section  and  of  Sections  10-9,
22    10-10  and  10-10.1 shall also apply to and govern objections
23    to petitions for nomination filed under Article 7 or  Article
24    8,  except as otherwise provided in Section 7-13 for cases to
25    which  it  is  applicable,  and  also  apply  to  and  govern
26    petitions  for  the  submission  of  public  questions  under
27    Article 28.
