90_HB1470 625 ILCS 5/15-111 from Ch. 95 1/2, par. 15-111 Amends the Illinois Highway Code. Allows counties to include benches, shelters, and other facilities as part of the construction or maintenance of county highways. Allows counties to use any funds for these projects and bicycle related projects. Provides that for permits required under the provisions for access roads and driveways laid out from county highways, a county may include requirements for pedestrian access for sidewalks, bike paths, bus shelters, benches, and bus loading and unloading areas. LRB9003418NTsb LRB9003418NTsb 1 AN ACT to amend the Illinois Highway Code by changing 2 Sections 5-701.6 and 9-112.3. 3 Be it enacted by the People of the State of Illinois, 4 represented in the General Assembly: 5 Section 5. The Illinois Highway Code is amended by 6 changing Sections 5-701.6 and 9-112.3 as follows: 7 (605 ILCS 5/5-701.6) (from Ch. 121, par. 5-701.6) 8 Sec. 5-701.6. Investigations; studies. Any county board 9 with the approval of the Department may also use motor fuel 10 tax money allotted to it for the purpose of the payment for 11 investigations requisite to determine the reasonably 12 anticipated need for any of the work described in Sections 13 5-701.1 throughto5-701.5, 5-701.13, and 9-112.3inclusive,14 of this Code, and Section 2 of the Bikeway Act. ThoseSuch15 investigations may include, but shall not be limited to, the 16 making of traffic surveys, the study of transportation 17 facilities, research concerning the development of the 18 several areas within the county and contiguous territory as 19 affected by growth and changes in population and economic 20 activity and the collection and review of data relating to 21 all factors affecting the judicious planning of construction, 22 reconstruction, improvement and maintenance of highways. The 23 investigations for which any such payments are made may also 24 be conducted in cooperation with other counties, 25 municipalities, the State of Illinois, the United States, 26 other states of the United States, agencies of any such 27 governments or other persons in pursuance of agreements to 28 share the costs thereof and authority to enter into such 29 agreements is hereby conferred upon counties. 30 (Source: Laws 1959, p. 196.) -2- LRB9003418NTsb 1 (605 ILCS 5/9-112.3) (from Ch. 121, par. 9-112.3) 2 Sec. 9-112.3. Shelters for the convenience and comfort 3 of persons waiting for buses or other public transportation 4 may be placed and maintained within the right of way of any 5 street or highway, including right of way for streets and 6 highways within municipalities, after a license or permit for 7 the shelter and location is obtained from the highway 8 authority having jurisdiction. Placement and location of 9 shelters on any street or highway within a municipality shall 10 be subject to the approval of the corporate authorities of 11 such municipality. The owners may place advertising on the 12 shelters if authorized by the license or permit, provided, 13 however, that no political advertising shall be placed on any 14 shelter on any street or highway at any time and further 15 provided that advertising on shelters shall be limited to 16 one-third of the vertical surface of the shelter. Shelters 17 shall not be placed or maintained on that portion of the 18 right of way designed and used for vehicle traffic and 19 further shall not be so placed as to impair the street or 20 highway or interfere with the free and safe flow of traffic. 21 A county may include as part of the construction or 22 maintenance of a county highway: the placement or maintenance 23 of benches or shelters for the convenience and comfort of 24 persons waiting for buses or other public transportation or 25 at transportation corridor off-street parking facilities; the 26 placement or maintenance of bus route signing; the 27 construction or maintenance of transportation corridor 28 off-street parking facilities, including the acquisition of 29 right-of-way therefore in accordance with Sections 5-801 30 through 5-803 of this Code; the construction or maintenance 31 of bicycle storage facilities; the construction or 32 maintenance of bus loading and unloading areas; and the 33 construction or maintenance of sidewalks. The county shall 34 have the authority to use any funds available for the -3- LRB9003418NTsb 1 construction or maintenance of county highways toward this 2 construction or maintenance. The construction or maintenance 3 shall be under the supervision of the county engineer when 4 that construction or maintenance is undertaken by the county. 5 These facilities shall be considered part of the county 6 highway and the county board may pass an ordinance 7 establishing rules and regulations regarding the use of these 8 highways. 9 For a permit required under Section 5-413 of this Code, a 10 county may include suitable requirements for pedestrian 11 access for sidewalks, bike paths, bus shelters, benches, and 12 bus loading and unloading areas. 13 (Source: P.A. 81-436.)
