Amends the Livestock Management Facilities Act.
Prohibits the construction or commencement of operation of
new livestock management or waste handling facilities of
1,000 or greater animal units (and the commencement of
operation of the expanded portions of expanded facilities)
until the Pollution Control Board has adopted final rules.
Also requires approval of the appropriate county board or
municipal corporate authorities. Effective immediately.

1 AN ACT to amend the Livestock Management Facilities Act
2 by adding Section 12.
3 Be it enacted by the People of the State of Illinois,
4 represented in the General Assembly:
5 Section 5. The Livestock Management Facilities Act is
6 amended by adding Section 12 as follows:
7 (510 ILCS 77/12 new)
8 Sec. 12. Moratorium.
9 (a) Notwithstanding any other provision of this Act or
10 any other provision of law, no new facility as defined in
11 Section 10.45 of 1,000 or greater animal units that was being
12 constructed on or after May 21, 1996 may continue
13 construction or commence operations until the Pollution
14 Control Board has adopted the final rules authorized under
15 this Act.
16 (b) Notwithstanding any other provision of this Act or
17 any other provision of law, no new facility as defined in
18 Section 10.45 of 1,000 or greater animal units that was being
19 expanded on or after May 21, 1996 may continue the expansion
20 or commence operations in the expanded portion of the
21 facility until the Pollution Control Board has adopted the
22 final rules authorized under this Act.
23 (c) After the Pollution Control Board has adopted the
24 final rules authorized under this Act, no new facility as
25 defined in Section 10.45 of 1,000 or greater animal units
26 that was being constructed on or after May 21, 1996 and no
27 new facility as defined in Section 10.45 of 1,000 or greater
28 animal units that was being expanded on or after May 21, 1996
29 may begin or continue construction, continue expansion, or
30 commence operations without first obtaining approval from
31 the county board of the county in which the facility is or

1 will be located or, if the facility is or will be located
2 within the corporate limits of a municipality, from the
3 corporate authorities of that municipality.
4 Section 99. Effective date. This Act takes effect upon
5 becoming law.
