Provides that in a hospital that offers the kinds of services that can be performed by a licensed clinical psychologist, no Illinois law, rule, practice, or policy shall prohibit licensed clinical psychologists from being accorded clinical privileges and being appointed to staff membership positions. LRB9003930LDdv LRB9003930LDdv 1 AN ACT to amend the Hospital Licensing Act by adding 2 Section 10.5. 3 Be it enacted by the People of the State of Illinois, 4 represented in the General Assembly: 5 Section 5. The Hospital Licensing Act is amended by 6 adding Section 10.5 as follows: 7 (210 ILCS 85/10.5 new) 8 Sec. 10.5. Licensed clinical psychologists. If a 9 hospital offers the kinds of services that can be performed 10 by licensed clinical psychologists, no provision of Illinois 11 law, agency rule or practice, or institutional or staff 12 bylaw, rule, or policy shall discriminate against licensed 13 clinical psychologists by prohibiting them from being 14 accorded clinical privileges and being appointed to all 15 categories of staff membership, including medical staff 16 membership. The accordance and delineation of staff 17 membership and clinical privileges for licensed clinical 18 psychologists by a hospital licensed under this Act shall be 19 determined on an individual basis and be commensurate with an 20 applicant's education, training, experience, and demonstrated 21 competence. Reasonable, nondiscriminatory standards for the 22 evaluation of an applicant's credentials shall be formulated 23 by each hospital. A hospital that admits patients for 24 treatment of mental illness may grant to a licensed clinical 25 psychologist an opportunity to admit, treat, and discharge 26 patients. If a hospital grants a psychologist hospital staff 27 privileges under this amendatory Act of 1997, the 28 psychologist or the hospital shall, prior to or at the time 29 of hospital admission of a patient, identify an appropriate 30 physician with admitting privileges at the hospital who shall 31 be responsible for the medical evaluation and medical -2- LRB9003930LDdv 1 management of the patient for the duration of his or her 2 hospitalization.
