Amends the State Employees Group Insurance Act of 1971 to provide State group health benefits for those surviving spouses if health benefits are not provided by the employer of the deceased firefighter or police officer. LRB9003579EGfg HB1136 Engrossed LRB9003579EGfg 1 AN ACT in relation to burial benefits for firefighters 2 and police officers killed in the line of duty and health 3 care benefits for their surviving spouses, amending named 4 Acts. 5 Be it enacted by the People of the State of Illinois, 6 represented in the General Assembly: 7 Section 5. The State Employees Group Insurance Act of 8 1971 is amended by adding Section 6.9 as follows: 9 (5 ILCS 375/6.9 new) 10 Sec. 6.9. Health benefits for certain surviving spouses 11 and dependent children. This Section applies only to the 12 surviving spouse and dependent children of a law enforcement 13 officer or firefighter whose death arises out of or in the 14 course of employment on or after September 28, 1994 while a 15 sworn member of a police or fire department operated by the 16 State, a State university, or a unit of local government. 17 A surviving spouse or dependent child to whom this 18 Section applies may elect to participate in the plan of group 19 health benefits provided under this Act, with the same 20 benefits and subject to the same costs and limitations as 21 surviving spouses and dependent children of State employees 22 who die in service. The election must be made no later than 23 July 1, 1998 or 24 months after the death of the officer or 24 firefighter, whichever is later, and may be made on behalf of 25 a dependent child by the child's parent or legal guardian. 26 Group life insurance benefits are not included in the 27 benefits available under this Section. 28 The Department of Central Management Services may adopt 29 rules and procedures for the implementation of this Section. 30 Section 10. The Law Enforcement Officers, Civil Defense HB1136 Engrossed -2- LRB9003579EGfg 1 Workers, Civil Air Patrol Members, Paramedics, Firemen, 2 Chaplains, and State Employees Compensation Act is amended by 3 adding Section 3.5 as follows: 4 (820 ILCS 315/3.5 new) 5 Sec. 3.5. Burial benefit. In addition to the benefit 6 provided in Section 3, a burial benefit of $10,000 shall be 7 payable to the surviving spouse or estate of a law 8 enforcement officer or firefighter who dies as a result of 9 the performance of an act of duty on or after the effective 10 date of this amendatory Act of 1997 while a sworn member of a 11 police or fire department operated by the State, a State 12 university, or a unit of local government. 13 Section 99. Effective date. This Act takes effect upon 14 becoming law.
