1 AN ACT to amend the Environmental Protection Act by
2 changing Section 55.9.
3 Be it enacted by the People of the State of Illinois,
4 represented in the General Assembly:
5 Section 5. The Environmental Protection Act is amended
6 by changing Section 55.9 as follows:
7 (415 ILCS 5/55.9) (from Ch. 111 1/2, par. 1055.9)
8 Sec. 55.9. Collection of fee. Retailers shall collect
9 the fee from the purchaser by adding the fee to the selling
10 price of the tire. The fee imposed by Section 55.8 shall be
11 stated as a distinct item separate and apart from the selling
12 price of the tire. The fee imposed by Section 55.8 shall not
13 be included includable in the gross receipts of the retailer
14 subject to the Retailers' Occupation Tax Act, the Use Tax Act
15 or any locally imposed retailers' occupation tax. The fee
16 imposed by Section 55.8, and any such fees collected by a
17 retailer, shall constitute a debt owed by the retailer to
18 this State.
