Amend House Bill 1050 on page 3, by 3 replacing line 23 with the following: 4 "Sections 1.3, 3.7, and 3.8 as follows:"; and 5 on page 5, below line 20, by inserting the following: 6 "(520 ILCS 5/3.7) (from Ch. 61, par. 3.7) 7 Sec. 3.7. (a) Any person controlling land or water, or 8 both, for commercial purposes in whole or in part for the 9 taking of wild ducks or wild geese or for having the 10 privilege of taking wild ducks or wild geese thereon shall 11 make application for a Migratory Waterfowl Hunting Area 12 Permit (Commercial) and pay a basic annual permit fee of 13 $15.00 for each blind or pit on that land or water. Migratory 14 Waterfowl Hunting Area Permits shall be issued by the 15 Department on the basis of principal use. Permit holders are 16 entitled to harvest either wild ducks or wild geese. The 17 permits described in this Paragraph shall expire each year on 18 the day after the last day of the season during which it is 19 lawful to take migratory waterfowl. 20 (b) The following duties are imposed upon the holder of 21 a permit described in Paragraph (a) but only during duck and 22 Canada goose seasons: -2- LRB9004123NTsbam 1 (1) He shall require all hunters, including the 2 officers and employees of any licensed clubs, to register 3 daily, on the daily register forms provided by the 4 Department, prior to their hunting on the area covered by 5 his permit. The registration shall include each 6 registering hunter's name and mailing address. 7 (2) He shall require each hunter, at the completion 8 of each hunting day, to report the number and species of 9 migratory waterfowl the hunter has taken. 10 (3) He shall exhibit the daily registers described 11 in Sub-Section (1) and make them open to inspection by 12 authorized employees of the Department, any sheriff or 13 deputy sheriff, or any other peace officer of the State; 14 (4) He shall ensure the observance of the 15 provisions of this Act in the taking and possession of 16 migratory waterfowl by himself, his guests or employees 17 on the area covered by his permit; 18 (5) He shall forward at the end of each season for 19 the taking of migratory waterfowl, or at more frequent 20 times as may be requested by the Department, a report 21 upon blanks furnished by the Department, which report 22 shall set forth the number of each kind of bird taken 23 upon the area covered by his permit. 24 (c) An area's principal use shall be determined by the 25 composition of its harvest. 26 (Source: P.A. 87-174.) 27 (520 ILCS 5/3.8) (from Ch. 61, par. 3.8) 28 Sec. 3.8. Migratory waterfowl areas; geese. 29 (a) On any property operated under a Migratory Waterfowl 30 Hunting Area Permit (Commercial) where the principal use is 31 to take wild geese, it is the permit holder's duty to ensure 32 all of the following but only during Canada goose season: 33 (1) That no person takes wild geese except from a -3- LRB9004123NTsbam 1 blind or pit. 2 (2) That no person establishes or uses any blind or 3 pit for the taking of wild geese within 200 yards of any 4 other blind or pit or within 100 yards of the boundary of 5 the property on which the blind or pit is located. 6 (3) That no person establishes or uses any blind or 7 pit for the taking of wild geese within 200 yards of any 8 wildlife refuge boundary or public road right-of-way 9 adjacent to any State or Federal waterfowl refuge. 10 (b) On any property where the principal use is to take 11 wild geese in Alexander, Franklin, Jackson, Jefferson, Union 12 and Williamson Counties, other than property operated under a 13 Migratory Waterfowl Hunting Area Permit (Commercial), all of 14 the following restrictions shall be observed but only during 15 Canada goose season: 16 (1) No person may take wild geese except from a 17 blind or pit and it shall be illegal to take or attempt 18 to take geese from the base of standing timber except 19 when immediately adjacent to an open field. 20 (2) No person may establish or use a blind or pit 21 within 100 yards of the boundary of the property on which 22 the blind or pit is located unless the minimum yardage 23 requirement cannot be met, in which case one pit or blind 24 may be permitted only if there is a minimum of 200 yards 25 between that pit or blind and the nearest pit or blind. 26 (3) No person may establish or use a blind or pit 27 for the taking of wild geese within 200 yards of any 28 wildlife refuge boundary or public road right-of-way 29 adjacent to any State or Federal waterfowl refuge. 30 (4) No more than the number of persons allowed by 31 administrative rule may occupy or attempt to take wild 32 geese from any blind or pit at the same time. 33 (Source: P.A. 87-174; 88-468.)".
