Provides that prisoners in Illinois Department of Corrections facilities shall not be allowed access to exercise equipment and shall not be allowed to provide or receive instruction in boxing, wrestling, or martial arts. Permits wardens to allow prisoners to participate in jogging, basketball, stationary exercise bicycling, supervised calisthenics, or other physical activities that are not designed to increase muscle mass and physical strength or improve fighting skills. Provides for distribution of prison exercise equipment to the correctional officers of the prison for use in the staff recreation area and if the equipment is not used by the correctional officers, it shall be distributed to local law enforcement personnel. LRB9000441RCks LRB9000441RCks 1 AN ACT to amend the Unified Code of Corrections by adding 2 Section 3-6-2.5. 3 Be it enacted by the People of the State of Illinois, 4 represented in the General Assembly: 5 Section 5. The Unified Code of Corrections is amended by 6 adding Section 3-6-2.5 as follows: 7 (730 ILCS 5/3-6-2.5 new) 8 Sec. 3-6-2.5. Exercise equipment and martial arts 9 programs prohibited. 10 (a) In this Section, "exercise equipment" means any 11 equipment or device that is designed to increase physical 12 strength of the person using it. "Exercise equipment" 13 includes equipment such as weight machines that utilize 14 weight plates, tension bands, or any similar device that 15 provides weight training resistance; barbells, dumbbells, and 16 similar free weight equipment; and any other device that the 17 Department of Corrections, in rules adopted under the 18 Illinois Administrative Procedure Act, designates as enabling 19 a person to increase his or her muscle mass and physical 20 strength. 21 (b) A warden of a facility of the Department of 22 Corrections shall not allow either of the following: 23 (1) A prisoner access to exercise equipment; 24 (2) A prisoner to provide or receive instruction in 25 boxing, wrestling, any form of martial arts such as 26 karate and judo, or any other program that the 27 Department, in rules adopted under the Illinois 28 Administrative Procedure Act, designates as enabling a 29 person to improve his or her fighting skills. 30 (c) Nothing in this Section prohibits a warden of a 31 facility of the Department from allowing a prisoner to -2- LRB9000441RCks 1 participate in jogging, basketball, stationary exercise 2 bicycling, supervised calisthenics, or other physical 3 activities that are not designed to increase muscle mass and 4 physical strength or improve fighting skills. 5 (d) Not later than 30 days after the effective date of 6 this amendatory Act of 1997, each warden of a correctional 7 institution under the control or supervision of the 8 Department of Corrections shall offer to the institution's 9 correctional officers for use in the staff recreation area 10 all exercise equipment and boxing, wrestling, and martial 11 arts paraphernalia being used by prisoners on the effective 12 date of this amendatory Act of 1997. The warden shall offer 13 any remaining equipment and paraphernalia to local law 14 enforcement agencies for use by law enforcement personnel.
