LRB9004012EGfg LRB9004012EGfg 1 AN ACT to amend the Illinois Pension Code by changing 2 Section 7-169 and to amend the State Mandates Act. 3 Be it enacted by the People of the State of Illinois, 4 represented in the General Assembly: 5 Section 5. The Illinois Pension Code is amended by 6 changing Section 7-169 as follows: 7 (40 ILCS 5/7-169) (from Ch. 108 1/2, par. 7-169) 8 Sec. 7-169. Separation benefits; repayments. If an 9 employee who has received a separation benefit subsequently 10 becomes a participating employee, and renders at least 2 11 years of contributing service from the date of such re-entry, 12 he may pay to the fund the amount of the separation benefit, 13 plus interest at the effective rate for each year from the 14 date of payment of the separation benefit to the date of 15 repayment. Upon payment his creditable service shall be 16 reinstated and the payment shall be credited to his account 17 as normal contributions. Beginning January 1, 1998, the 18 requirement of returning to service for at least 2 years does 19 not apply to persons who return to service as a sheriff's law 20 enforcement employee. 21 (Source: P.A. 84-1028.) 22 Section 90. The State Mandates Act is amended by adding 23 Section 8.21 as follows: 24 (30 ILCS 805/8.21 new) 25 Sec. 8.21. Exempt mandate. Notwithstanding Sections 6 26 and 8 of this Act, no reimbursement by the State is required 27 for the implementation of any mandate created by this 28 amendatory Act of 1997. -2- LRB9004012EGfg 1 Section 99. Effective date. This Act takes effect upon 2 becoming law.
