 1                     AMENDMENT TO HOUSE BILL 927
 2        AMENDMENT NO.     .  Amend House Bill  927  by  replacing
 3    the title with the following:
 4        "AN  ACT  to  amend the Criminal Code of 1961 by changing
 5    Section 32-4a."; and
 6    by replacing everything after the enacting  clause  with  the
 7    following:
 8        "Section  5.  The  Criminal  Code  of  1961 is amended by
 9    changing Section 32-4a as follows:
10        (720 ILCS 5/32-4a) (from Ch. 38, par. 32-4a)

12        Sec. 32-4a.  Harassment of jurors and witnesses. A person
13    who, with intent to harass or annoy one who has served  as  a
14    juror  or  as a witness, or who may be expected to serve as a
15    witness in a pending legal proceeding, because of the verdict
16    returned by the jury therein or  the  participation  of  such
17    juror in the verdict or because of the testimony or potential
18    testimony   of   such   witness,   communicates  directly  or
19    indirectly with the juror or witness in  such  manner  as  to
20    produce mental anguish or emotional distress or who conveys a
21    threat  of  injury or damage to the property or person of any

 1    individual commits a Class 2 felony.

 4        Sec. 32-4a.  Harassment of representatives for the child,
 5    jurors, and witnesses and family members  of  representatives
 6    for the child, jurors, and witnesses.
 7        (a)  A person who, with intent to harass or annoy one who
 8    has  served  or  is  serving  or  who is a family member of a
 9    person who has served or is serving (1) as a juror because of
10    the  verdict  returned  by  the  jury  in  a  pending   legal
11    proceeding  or  the participation of the juror in the verdict
12    or (2) as a witness, or who may be expected  to  serve  as  a
13    witness  in  a  pending  legal  proceeding,  because  of  the
14    testimony or potential testimony of the witness, communicates
15    directly  or indirectly with the juror, or witness, or family
16    member of a juror or witness in such  manner  as  to  produce
17    mental  anguish or emotional distress or who conveys a threat
18    of injury or damage to the property or person of  any  juror,
19    or  witness, or family member of the juror or witness commits
20    a Class 2 felony.
21        (b)  A person who, with intent to harass or annoy one who
22    has served or is serving or who  is  a  family  member  of  a
23    person  who  has served or is serving as a representative for
24    the child,  appointed  under  Section  506  of  the  Illinois
25    Marriage  and  Dissolution of Marriage Act, Section 12 of the
26    Uniform Child Custody Jurisdiction Act, or Section  2-502  of
27    the  Code  of  Civil Procedure, because of the representative
28    service of that capacity, communicates directly or indirectly
29    with  the  representative  or  a   family   member   of   the
30    representative in such manner as to produce mental anguish or
31    emotional  distress  or  who  conveys  a  threat of injury or
32    damage to the property or person of any representative  or  a
33    family  member  of  the  representative  commits  a  Class  A
34    misdemeanor.

 1        (c)  For  purposes of this Section, "family member" means
 2    a spouse, parent, child, stepchild or other person related by
 3    blood or by present marriage, a person who has, or  allegedly
 4    has  a  child in common, and a person who shares or allegedly
 5    shares a blood relationship through a child.

 8        Section  95.   No  acceleration or delay.  Where this Act
 9    makes changes in a statute that is represented in this Act by
10    text that is not yet or no longer in effect (for  example,  a
11    Section  represented  by  multiple versions), the use of that
12    text does not accelerate or delay the taking  effect  of  (i)
13    the  changes made by this Act or (ii) provisions derived from
14    any other Public Act.".
