Provides that not later than May 30 (now September 30), the Office of the State Fire Marshal shall reimburse participating local governments or persons for the fire protection training expenses incurred by them during the period established by the Office (now during the previous fiscal year). Provides that the Office may (now shall) make rules establishing administration and certification fees. Deletes the provisions concerning reimbursement funding for certain claims and mandating that rules be filed with the Secretary of State within a reasonable time after the Office adopts them. LRB9004036PTpk HB0820 Engrossed LRB9004036PTpk 1 AN ACT to amend the Illinois Fire Protection Training Act 2 by changing Sections 9, 10, and 11. 3 Be it enacted by the People of the State of Illinois, 4 represented in the General Assembly: 5 Section 5. The Illinois Fire Protection Training Act is 6 amended by changing Sections 9, 10, and 11 as follows: 7 (50 ILCS 740/9) (from Ch. 85, par. 539) 8 Sec. 9. Training participation; funding. All local 9 governmental agencies and individuals may elect to 10 participate in the training programs under this Act, subject 11 to the rules and regulations of the Office. TheSuch12 participation may be for certification only, or for 13 certification and reimbursement for training expenses as 14 further provided in this Act. To be eligible to receive 15 reimbursement for training of individuals, a local 16 governmental agency shall require by ordinance that a trainee 17 complete a basic course approved by the Office, and pass the 18 State test for certification at the basic level within the 19 probationary period as established by the local governmental 20 agency. A certified copy of the ordinance must be on file 21 with the Office. 22 The Office may by rule provide for reimbursement funding 23 for trainees who are volunteers or paid on call fire 24 protection personnel beyond their probationary period, but 25 not to exceed 3 years from the date of initial employment. 26 The Office may reimburse for basic or advanced training of 27 individuals who were permanently employed fire protection 28 personnel prior to the date of thesuchordinance. 29 Individuals may receive reimbursement if employed by a unit 30 of local government thatwhichparticipates for reimbursement 31 funding and the individual is otherwise eligible. HB0820 Engrossed -2- LRB9004036PTpk 1 Failure of any trainee to complete thesuchbasic 2 training and certification within the required period will 3 render that individual and local governmental agency 4 ineligible for reimbursement funding for basic training for 5 that individual in the fiscal year in which his probationary 6 period ends. The individual may later become certified 7 without reimbursement. 8 Any participating local governmental agency may elect to 9 withdraw from the training program by repealing the original 10 ordinance, and a certified copy of the ordinancewhichmust 11 be filed with the Office. 12This amendatory Act of 1982 shall apply to all13unreimbursed claims in the fiscal year in which it takes14effect. All local governmental agencies which have previously15filed certified copies of resolutions and ordinances shall be16eligible to receive reimbursement funding for the fiscal year17in which this amendatory Act of 1982 takes effect. To be18eligible for continued reimbursement funding, a local19governmental agency shall submit a certified copy of the20required ordinance to the Office by January 1, 1983.21 (Source: P.A. 82-777.) 22 (50 ILCS 740/10) (from Ch. 85, par. 540) 23 Sec. 10. Training expenses; reimbursement. The Office, 24 not later than MaySeptember30th of each year, from funds 25 appropriated for this purpose, shall reimburse the local 26 governmental agencies or individuals participating in the 27 training program in an amount equalling one-half1/2of the 28 total sum paid by them during the period established by the 29 Officeprevious fiscal yearfor tuition at training schools, 30 salary of trainees while in school, necessary travel 31 expenses, and room and board for each trainee. In addition to 32 reimbursement provided herein by the Office to the local 33 governmental agencies for participation by trainees, the HB0820 Engrossed -3- LRB9004036PTpk 1 Office in each year shall reimburse the local governmental 2 agencies participating in the training program for permanent 3 fire protection personnel in the same manner as trainees for 4 eachsuchtraining program. No more than 50% of the 5 reimbursements distributed to local governmental agencies in 6 any fiscal year shall be distributed to local governmental 7 agencies of more than 500,000 persons. If at the time of the 8 annual reimbursement to local governmental agencies 9 participating in the training program there is an 10 insufficient appropriation to make reimbursement in full, the 11 appropriation shall be apportioned among the participating 12 local governmental agencies. No local governmental agency 13 which shall alter or change in any manner any of the training 14 programs as promulgated under this Act or fail to comply with 15 rules and regulations promulgated under this Act shall be 16 entitled to receive any matching funds under this Act. 17 Submitting false information to the Office is a Class B 18 misdemeanor. 19 (Source: P.A. 81-1509.) 20 (50 ILCS 740/11) (from Ch. 85, par. 541) 21 Sec. 11. Rules and regulations. The Office may make, 22 amend, and rescind thosesuchrules and regulations as may be 23 necessary to carry out the provisions of this Act. The Office 24 mayshallmake rules and regulations establishing the fees to 25 be paid for administration of examinations, certification of 26 schools, and certification of fire fighters.A copy of all27rules and regulations and amendments or rescissions thereof28shall be filed with the Secretary of State within a29reasonable time after their adoption.30 (Source: P.A. 89-180, eff. 7-19-95.) 31 Section 99.
