90_HB0619 20 ILCS 1305/10-25 Amends the Department of Human Services Act. Provides that the Department shall include a lactation support services program for participants in the Women, Infants and Children program. Provides that the program shall pay for lactation equipment as well as lactation specialists. Provides that the Department shall coordinate the Women, Infants and Children program with the Medicaid program though an interagency agreement whereby each program provides information about the other to applicants for services. LRB9000200SMdv LRB9000200SMdv 1 AN ACT to amend the Department of Human Services Act by 2 changing Section 10-25. 3 Be it enacted by the People of the State of Illinois, 4 represented in the General Assembly: 5 Section 5. The Department of Human Services Act is 6 amended by changing Section 10-25 as follows: 7 (20 ILCS 1305/10-25) 8 (Text of Section taking effect July 1, 1997) 9 Sec. 10-25. Women, Infants, and Children Nutrition 10 Program. 11 (a) The Department shall participate in the Women, 12 Infants and Children Nutrition program of the federal 13 government to the maximum extent permitted by the federal 14 appropriation and allocation to the State of Illinois. The 15 Department shall report quarterly to the Governor and the 16 General Assembly the status of obligations and expenditures 17 of the WIC nutrition program appropriation and make 18 recommendations on actions necessary to expend all available 19 federal funds. Other appropriations and funds from any 20 public or private source in addition to federal funds may be 21 used by the Department for the purpose of maximum 22 participation in the WIC nutrition program. 23 (b) The Department shall maintain a drug abuse education 24 program for participants in the Women, Infants and Children 25 Nutrition Program. The program shall include but need not be 26 limited to (1) the provision of information concerning the 27 dangers of drug abuse and (2) the referral of participants 28 who are suspected drug abusers to drug abuse clinics, 29 treatment programs, counselors or other drug abuse treatment 30 providers. 31 (c) The Department shall cooperate with the Department -2- LRB9000200SMdv 1 of Public Health for purposes of the smoking cessation 2 program for participants in the Women, Infants and Children 3 Nutrition Program maintained by the Department of Public 4 Health under Section 55.44 of the Civil Administrative Code 5 of Illinois. 6 (d) The Department may contract with any bank as defined 7 by the Illinois Banking Act to redeem bank drafts issued by 8 the Department under the United States Department of 9 Agriculture Special Supplemental Food Program for Women, 10 Infants and Children (WIC). Any bank with which the 11 Department has entered into a contract to redeem bank drafts 12 may receive, pursuant to an appropriation to the Department, 13 an initial advance and periodic payment of funds for the 14 Women, Infants and Children Program in amounts determined by 15 the Secretary. Notwithstanding any other law, such funds 16 shall be retained in a separate account by the bank. Any 17 interest earned by monies in such account shall accrue to the 18 USDA Women, Infants and Children Fund and shall be used 19 exclusively for the redemption of bank drafts issued by the 20 Department. WIC program food funds received by the bank from 21 the Department shall be used exclusively for the redemption 22 of bank drafts. The bank shall not use such food funds, or 23 interest accrued thereon, for any other purpose including, 24 but not limited to, reimbursement of administrative expenses 25 or payments of administrative fees due the bank pursuant to 26 its contract or contracts with the Department. 27 Such initial and periodic payments by the Department to 28 the bank shall be effected, pursuant to an appropriation, in 29 an amount needed for the redemption of bank drafts issued by 30 the Department under the United States Department of 31 Agriculture Special Supplemental Food Program for Women, 32 Infants and Children in any initial or succeeding period. 33 The State Comptroller shall, upon presentation by the 34 Secretary of adequate certification of funds needed for -3- LRB9000200SMdv 1 redemption of bank drafts, promptly draw a warrant payable to 2 the bank for deposit to the separate account of the bank. 3 Such certification may be in magnetic tape or computer output 4 form, indicating the amount of the total payment made by the 5 bank for the redemption of bank drafts from funds provided to 6 the bank under this Section. 7 The separate account of the bank established under this 8 Section, any payments to that account, and the use of such 9 account and funds shall be subject to (1) audit by the 10 Department or a private contractor authorized by the 11 Department to conduct audits, including but not limited to 12 such audits as may be required by State law, (2) audit by the 13 federal government or a private contractor authorized by the 14 federal government, and (3) post audit pursuant to the 15 Illinois State Auditing Act. 16 (e) The Department shall include a program of lactation 17 support services as part of the benefits and services 18 provided for participants in the Women, Infants and Children 19 Nutrition Program. The program shall include payment for 20 breast pumps, breast shields, or any supply deemed essential 21 for the successful maintenance of lactation, as well as 22 lactation specialists who are registered nurses, licensed 23 dietitians, or persons who have successfully completed the 24 lactation management training sponsored by the United States 25 Department of Agriculture Special Supplemental Food Program 26 for Women, Infants and Children. 27 (f) The Department shall coordinate the operation of the 28 Women, Infants and Children program with the Medicaid program 29 by interagency agreement whereby each program provides 30 information about the services offered by the other to 31 applicants for services. 32 (Source: P.A. 89-507, eff. 7-1-97.)
