Amend House Bill 605 on page 3, by 3 replacing lines 10 through 21 with the following: 4 "Nonreusable tangible personal property that is used by 5 persons engaged in the business of operating a restaurant, 6 cafeteria, or drive-in is a sale for resale when it is 7 transferred to customers in the ordinary course of business 8 as part of the sale of food or beverages and is used to 9 deliver, package, or consume food or beverages, regardless of 10 where consumption of the food or beverages occurs. Examples 11 of those items include, but are not limited to nonreusable, 12 paper and plastic cups, plates, baskets, boxes, sleeves, 13 buckets or other containers, utensils, straws, placemats, 14 napkins, doggie bags, and wrapping or packaging materials 15 that are transferred to customers as part of the sale of food 16 or beverages in the ordinary course of business."; and 17 on page 10, by replacing lines 9 through 20 with the 18 following: 19 "Nonreusable tangible personal property that is used by 20 persons engaged in the business of operating a restaurant, 21 cafeteria, or drive-in is a sale for resale when it is 22 transferred to customers in the ordinary course of business 23 as part of the sale of food or beverages and is used to -2- LRB9003075DNmbam02 1 deliver, package, or consume food or beverages, regardless of 2 where consumption of the food or beverages occurs.
