          Amends the Illinois Police Training  Act.  Provides  that
      the  policy  to  improve  law  enforcement  training includes
      providing that training to civilian personnel.  Provides that
      a criminal justice program or police training curriculum at a
      public  college  is  an  approved  police  training   school.
      Provides that a  recruit or a "trainee" means any person (now
      any  full-time or part-time law enforcement officer or county
      corrections officer) who is enrolled in an approved  training
      course.   Provides  that  the  provisions  concerning  course
      certification   by  the  Illinois  Law  Enforcement  Training
      Standards Board also apply to trainees. Effective January  1,
      1998.

 1        AN  ACT  to  amend  the  Illinois  Police Training Act by
 2    changing Sections 1, 2, 6, and 8.1.
 3        Be it enacted by the People of  the  State  of  Illinois,
 4    represented in the General Assembly:
 5        Section  5.   The Illinois Police Training Act is amended
 6    by changing Sections 1, 2, 6, and 8.1 as follows:

 8        Sec. 1.  Policy.  It is hereby declared as  a  matter  of
 9    legislative  determination  that  in  order  to  promote  and
10    protect  citizen health, safety, and welfare, it is necessary
11    and in the public interest to provide for the creation of the
12    Illinois Law Enforcement Training  Standards  Board  for  the
13    purpose  of  encouraging and aiding municipalities, counties,
14    park districts, State controlled universities, colleges,  and
15    public  community  colleges,  and  other  local  governmental
16    agencies  of  this  State and participating State agencies in
17    their efforts to  raise  the  level  of  law  enforcement  by
18    upgrading  and  maintaining  a  high  level  of  training and
19    standards for law enforcement executives and officers, county
20    corrections officers,  sheriffs,  county  coroners,  and  law
21    enforcement  support personnel, and civilian personnel  under
22    this Act.  It is declared to be  the  responsibility  of  the
23    board  to  ensure the required participation of the pertinent
24    local governmental units in the  programs  established  under
25    this  Act,  to encourage the voluntary participation of other
26    local governmental units and participating State agencies, to
27    set standards,  develop  and  provide  quality  training  and
28    education,  and  to  aid  in  the  establishment  of adequate
29    training facilities.

 3        Sec. 2. Definitions.  As used in  this  Act,  unless  the
 4    context otherwise requires:
 5        "Board"  means  the  Illinois  Law  Enforcement  Training
 6    Standards Board.
 7        "Local  governmental agency" means any local governmental
 8    unit or municipal corporation in this  State.   It  does  not
 9    include  the  State  of  Illinois  or  any  office,  officer,
10    department, division, bureau, board, commission, or agency of
11    the  State,  except  that  it does include a State-controlled
12    university, college or public community college.
13        "Police training school" means any school located  within
14    the  State  of  Illinois  whether privately or publicly owned
15    which  offers  a  course  in  police  or  county  corrections
16    training and has been approved by the Board.
17        "Probationary  police  officer"  means  a   recruit   law
18    enforcement officer required to successfully complete initial
19    minimum  basic  training  requirements  at  a police training
20    school to be eligible for permanent full-time employment as a
21    local law enforcement officer.
22        "Probationary part-time police officer" means  a  recruit
23    part-time  law  enforcement  officer required to successfully
24    complete initial minimum part-time training  requirements  to
25    be  eligible  for  employment on a part-time basis as a local
26    law enforcement officer.
27        "Permanent  police  officer"  means  a  law   enforcement
28    officer  who has completed his or her probationary period and
29    is permanently employed on a full-time basis as a  local  law
30    enforcement  officer  by  a  participating local governmental
31    unit or as a security officer or campus policeman permanently
32    employed  by  a  participating  State-controlled  university,
33    college, or public community college.
34        "Part-time  police  officer"  means  a  law   enforcement

 1    officer  who has completed his or her probationary period and
 2    is employed on a part-time basis as a law enforcement officer
 3    by a participating unit of local government or  as  a  campus
 4    policeman  by  a  participating  State-controlled university,
 5    college, or public community college.
 6        "Law enforcement officer" means any police officer  of  a
 7    local  governmental  agency  who is primarily responsible for
 8    prevention or detection of crime and the enforcement  of  the
 9    criminal  code, traffic, or highway laws of this State or any
10    political subdivision thereof.
11        "Recruit"  means   any   full-time   or   part-time   law
12    enforcement  officer  or  county  corrections  officer who is
13    enrolled in an approved training course.
14        "Probationary county corrections officer" means a recruit
15    county corrections officer required to successfully  complete
16    initial  minimum  basic  training  requirements  at  a police
17    training school to be eligible for permanent employment on  a
18    full-time basis as a county corrections officer.
19        "Probationary part-time county corrections officer" means
20    a  recruit  part-time  county corrections officer required to
21    successfully  complete  initial  minimum  part-time  training
22    requirements to be eligible for  part-time  employment  as  a
23    county corrections officer.
24        "Part-time  county  corrections  officer"  means a county
25    corrections officer who has completed his or her probationary
26    period and is employed on  a  part-time  basis  as  a  county
27    corrections  officer  by  a  participating local governmental
28    unit.
29        "Permanent county corrections  officer"  means  a  county
30    corrections officer who has completed his probationary period
31    and  is permanently employed on a full-time basis as a county
32    corrections officer by  a  participating  local  governmental
33    unit.
34        "County  corrections  officer" means any sworn officer of

 1    the sheriff who is primarily responsible for the control  and
 2    custody of offenders, detainees or inmates.

 5        Sec.  2.  Definitions.   As  used in this Act, unless the
 6    context otherwise requires:

15        "Police  training school" means any school located within
16    the State of Illinois whether  privately  or  publicly  owned
17    that  which  offers  a course in police or county corrections
18    training and has been approved by  the  Board.  Any  criminal
19    justice  program  or  police  training curriculum at a public
20    college is recognized as an approved police training school.
21        "Probationary  police  officer"  means  a   recruit   law
22    enforcement officer required to successfully complete initial
23    minimum  basic  training  requirements  at  a police training
24    school to be eligible for permanent full-time employment as a
25    local law enforcement officer.
26        "Probationary part-time police officer" means  a  recruit
27    part-time  law  enforcement  officer required to successfully
28    complete initial minimum part-time training  requirements  to
29    be  eligible  for  employment on a part-time basis as a local
30    law enforcement officer.
31        "Permanent  police  officer"  means  a  law   enforcement
32    officer  who has completed his or her probationary period and
33    is permanently employed on a full-time basis as a  local  law
34    enforcement  officer  by  a  participating local governmental

 1    unit or as a security officer or campus policeman permanently
 2    employed  by  a  participating  State-controlled  university,
 3    college, or  public  community  college.   "Part-time  police
 4    officer"  means  a  law enforcement officer who has completed
 5    his or her probationary period and is employed on a part-time
 6    basis as a law enforcement officer by a participating unit of
 7    local government or as a campus policeman by a  participating
 8    State-controlled  university,  college,  or  public community
 9    college.
10        "Law enforcement officer" means any police officer  of  a
11    local  governmental  agency  who is primarily responsible for
12    prevention or detection of crime and the enforcement  of  the
13    criminal  code, traffic, or highway laws of this State or any
14    political subdivision thereof.
15        "Recruit" or "trainee"  means  any  person  full-time  or
16    part-time  law  enforcement  officer  or  county  corrections
17    officer who is enrolled in an approved training course.
18        "Probationary county corrections officer" means a recruit
19    county  corrections officer required to successfully complete
20    initial minimum  basic  training  requirements  at  a  police
21    training  school to be eligible for permanent employment on a
22    full-time basis as a county corrections officer.
23        "Probationary part-time county corrections officer" means
24    a recruit part-time county corrections  officer  required  to
25    successfully  complete  initial  minimum  part-time  training
26    requirements  to  be  eligible  for part-time employment as a
27    county corrections officer.
28        "Part-time county corrections  officer"  means  a  county
29    corrections officer who has completed his or her probationary
30    period  and  is  employed  on  a  part-time basis as a county
31    corrections officer by  a  participating  local  governmental
32    unit.
33        "Permanent  county  corrections  officer"  means a county
34    corrections officer who has completed his probationary period

 1    and is permanently employed on a full-time basis as a  county
 2    corrections  officer  by  a  participating local governmental
 3    unit.
 4        "County corrections officer" means any sworn  officer  of
 5    the  sheriff who is primarily responsible for the control and
 6    custody of offenders, detainees, or inmates.
 7        "Probationary court security  officer"  means  a  recruit
 8    court  security  officer  required  to  successfully complete
 9    initial minimum basic training requirements at  a  designated
10    training  school to be eligible for permanent employment as a
11    court security officer.
12        "Permanent court security officer" means a court security
13    officer who has completed his or her probationary period  and
14    is  permanently  employed  as  a  court security officer by a
15    participating local governmental unit.
16        "Court security officer" has the meaning ascribed  to  it
17    in Section 3-6012.1 of the Counties Code.

22        Sec. 6.  The  Board  shall  select  and  certify  schools
23    within  the  State  of  Illinois for the purpose of providing
24    basic  training   for   probationary   police   officers   or
25    probationary  county  corrections  officers,  and advanced or
26    in-service  training  for  permanent   police   officers   or
27    permanent  county  corrections officers, which schools may be
28    either  publicly  or  privately  owned  and   operated.    In
29    addition, the Board has the following power and duties:
30             a.  To  require  local governmental units to furnish
31        such reports and information as the Board deems necessary
32        to fully implement this Act.
33             b.  To  establish  appropriate   mandatory   minimum

 1        standards  relating to the training of probationary local
 2        law   enforcement   officers   or   probationary   county
 3        corrections officers.
 4             c.  To provide appropriate  certification  to  those
 5        probationary   officers  who  successfully  complete  the
 6        prescribed minimum standard basic training course.
 7             d.  To review and approve annual training curriculum
 8        for county sheriffs.
 9             e.  To review and approve applicants  to  ensure  no
10        applicant  is  admitted to a certified academy unless the
11        applicant is a person of good character and has not  been
12        convicted  of a felony offense or a crime involving moral
13        turpitude under the laws of this State or any other state
14        which if committed in this State would be punishable as a
15        felony or a crime of  moral  turpitude.   The  Board  may
16        appoint   investigators  who  shall  enforce  the  duties
17        conferred upon the Board by this Act.

20        Sec.   8.1.   Full-time  police  and  county  corrections
21    officers.
22        (a)  After January 1, 1976, no person shall receive an  a
23    permanent appointment as a law enforcement officer as defined
24    in this Act nor shall any person receive, after the effective
25    date  of this amendatory Act of 1984, a permanent appointment
26    as a county corrections officer unless that person  has  been
27    awarded,  within 6 six months of his or her initial full-time
28    employment, a certificate attesting to his or her  successful
29    completion of the Minimum Standards Basic Law Enforcement and
30    County  Correctional  Training  Course  as  prescribed by the
31    Board; or has been awarded a  certificate  attesting  to  his
32    satisfactory  completion  of  a  training  program of similar
33    content and number of hours and which course has  been  found

 1    acceptable  by the Board under the provisions of this Act; or
 2    by reason  of  extensive  prior  law  enforcement  or  county
 3    corrections  experience  the  basic  training  requirement is
 4    determined by the Board to be illogical and unreasonable.
 5        If the such training is required and not completed within
 6    the applicable 6 six months, then the  officer  must  forfeit
 7    his  position,  or  the employing agency must obtain a waiver
 8    from the Board extending the period for compliance.  The Such
 9    waiver shall be issued only for good and justifiable reasons,
10    and in no case shall extend more  than  90  days  beyond  the
11    initial 6 six months.
12        (b)  No  provision  of this Section shall be construed to
13    mean that a law  enforcement  officer  employed  by  a  local
14    governmental agency at the time of the effective date of this
15    amendatory Act, either as a probationary police officer or as
16    a permanent police officer, shall require certification under
17    the  provisions of this Section. No provision of this Section
18    shall be construed to mean that a county corrections  officer
19    employed  by  a  local governmental agency at the time of the
20    effective date of this amendatory Act of 1984,  either  as  a
21    probationary  county  corrections  or  as  a permanent county
22    corrections officer, shall require  certification  under  the
23    provisions  of  this  Section.  No  provision of this Section
24    shall be construed  to  apply  to  certification  of  elected
25    county sheriffs.
26        (c)  This  Section  does  not  apply  to part-time police
27    officers, probationary part-time police  officers,  part-time
28    county corrections officers, or probationary part-time county
29    corrections officers.

31        Section  95.  No  acceleration  or delay.  Where this Act
32    makes changes in a statute that is represented in this Act by
33    text that is not yet or no longer in effect (for  example,  a

 1    Section  represented  by  multiple versions), the use of that
 2    text does not accelerate or delay the taking  effect  of  (i)
 3    the  changes made by this Act or (ii) provisions derived from
 4    any other Public Act.
 5        Section 99.  Effective date.  This Act  takes  effect  on
 6    January 1, 1998.
