Increases the pension formula from 2% to 2.5% of salary for the 21st through 30th year of service. Amends the State Mandates Act to require implementation without reimbursement. LRB9000412EGfg LRB9000412EGfg 1 AN ACT to amend the Illinois Pension Code by changing 2 Section 4-109 and to amend the State Mandates Act. 3 Be it enacted by the People of the State of Illinois, 4 represented in the General Assembly: 5 Section 5. The Illinois Pension Code is amended by 6 changing Section 4-109 as follows: 7 (40 ILCS 5/4-109) (from Ch. 108 1/2, par. 4-109) 8 Sec. 4-109. Pension. 9 (a) A firefighter age 50 or more with 20 or more years 10 of creditable service, who is no longer in service as a 11 firefighter, shall receive a monthly pension of 1/2 the 12 monthly salary attached to the rank held by him or her in the 13 fire service at the date of retirement. 14 The monthly pension shall be increased by 1/12 of 2.5%2%15 of such monthly salary for each additional month over 20 16 years of service through 30 years ofservice and 1/12 of 1%17of such monthly salary for each additional month over 3018years ofservice, to a maximum of 75% of such monthly salary. 19 (b) A firefighter who retires or is separated from 20 service having at least 10 but less than 20 years of 21 creditable service, who is not entitled to receive a 22 disability pension, and who did not apply for a refund of 23 contributions at his or her last separation from service 24 shall receive a monthly pension upon attainment of age 60 25 based on the monthly salary attached to his or her rank in 26 the fire service on the date of retirement or separation from 27 service according to the following schedule: 28 For 10 years of service, 15% of salary; 29 For 11 years of service, 17.6% of salary; 30 For 12 years of service, 20.4% of salary; 31 For 13 years of service, 23.4% of salary; -2- LRB9000412EGfg 1 For 14 years of service, 26.6% of salary; 2 For 15 years of service, 30% of salary; 3 For 16 years of service, 33.6% of salary; 4 For 17 years of service, 37.4% of salary; 5 For 18 years of service, 41.4% of salary; 6 For 19 years of service, 45.6% of salary. 7 (Source: P.A. 83-1440.) 8 Section 90. The State Mandates Act is amended by adding 9 Section 8.21 as follows: 10 (30 ILCS 805/8.21 new) 11 Sec. 8.21. Exempt mandate. Notwithstanding Sections 6 12 and 8 of this Act, no reimbursement by the State is required 13 for the implementation of any mandate created by this 14 amendatory Act of 1997. 15 Section 99. Effective date. This Act takes effect upon 16 becoming law.
