      415 ILCS 15/4.1 new
          Amends the Solid Waste  Planning  and  Recycling  Act  to
      require  municipalities  with  a  population  over  5,000  in
      counties  with  a population over 100,000 to consider, before
      January 1, 1998, the feasibility  of  implementing  municipal
      waste quantity based user fees. Requires those municipalities
      to  implement  quantity based user fees unless the fees would
      pose  an  administrative,  safety,  or   economic   hardship.

 1        AN  ACT  to  amend the Solid Waste Planning and Recycling
 2    Act by adding Section 4.1.
 3        Be it enacted by the People of  the  State  of  Illinois,
 4    represented in the General Assembly:
 5        Section  5. The Solid Waste Planning and Recycling Act is
 6    amended by adding Section 4.1 as follows:
 7        (415 ILCS 15/4.1 new)
 8        Sec. 4.1. Quantity based fees. No later than  January  1,
 9    1998,  each municipality with a population over 5,000 located
10    within a county with a population over 100,000 shall consider
11    the feasibility of implementing quantity based user fees that
12    promote municipal waste reduction  and  recycling,  including
13    but  not limited to a two-part pricing structure that charges
14    a base user fee to cover fixed costs and a minimum  level  of
15    service  and then charges an additional per container fee for
16    service beyond the minimum level. Quantity  based  user  fees
17    shall   be   implemented   at   the  municipality's  earliest
18    convenience unless the  municipality  determines  that  those
19    fees  would  pose  an  administrative,  safety,  or  economic
20    hardship on its waste collection system or residents.
21        Section 99. Effective date. This Act takes effect January
22    1, 1998.
