LRB9001096MWpc LRB9001096MWpc 1 AN ACT to amend the Highway Advertising Control Act of 2 1971 by changing Section 10. 3 Be it enacted by the People of the State of Illinois, 4 represented in the General Assembly: 5 Section 1. The Highway Advertising Control Act of 1971 6 is amended by changing Section 10 as follows: 7 (225 ILCS 440/10) (from Ch. 121, par. 510) 8 Sec. 10. Unlawful signs. The following signs are 9 unlawful andapublic nuisancesnuisance: 10 (a) Signs erected after the effective date of this Act 11 in violation of this Act; 12 (b) Signs not registered in accordance with this Act or 13 in accordance with the regulations established by the 14 Department; 15 (c) Signs without valid permits, as required by this Act 16 or by regulations established by the Department; 17 (d) Signs advertising alcoholic beverages or tobacco 18 products located within 1,000 feet of any elementary or 19 secondary school. 20 Each sign declared by this Section to be unlawful and a 21 public nuisance shall be removed or brought into compliance 22 with this Act by the owner, without compensation, within 30 23 days after receipt of notice by certified mail from the 24 Department, such notice period to be computed from the date 25 of mailing. If the unlawful sign is affixed to a motor 26 vehicle or a trailer or other vehicle capable of being 27 propelled by a motor vehicle, it shall be removed by the 28 owner, without compensation, within 24 hours after verbal 29 notice by the Department. Any signs not so removed by the 30 owners or any such signs which are removed and re-erected 31 illegally by the owners shall become the property of the -2- LRB9001096MWpc 1 State and shall be removed and disposed of by the Department 2 or may be painted over by the Department. The Department is 3 also granted authority to enter upon private property for 4 these purposes. If the name and address of the owner of the 5 sign cannot be ascertained from the records of the Department 6 or from a visual inspection of the sign, notices provided for 7 by this Sectionforegoing notice provisionsare not required 8 and the Department shall take immediate action to remove or 9 paint over the sign. 10 (Source: P.A. 79-1009.)
