The Consent by Minors to Medical Procedures 6 Act is amended by changing Section 1 as follows: 7 (410 ILCS 210/1) (from Ch. 111, par. 4501) 8 Sec. 1. Consent by minor. The consent to the performance 9 of a medical or surgical procedure by a physician licensed to 10 practice medicine and surgery executed by a married person 11 who is a minor, by a parent who is a minor, by a pregnant 12 woman who is a minor, by a homeless person who is a minor, or 13 by any person 18 years of age or older, is not voidable 14 because of such minority, and, for such purpose, a married 15 person who is a minor, a parent who is a minor, a pregnant 16 woman who is a minor, a homeless person who is a minor, or 17 any person 18 years of age or older, is deemed to have the 18 same legal capacity to act and has the same powers and 19 obligations as has a person of legal age. 20 For purposes of this Act, "homeless person who is a 21 minor" means a person under the age of 18 who is not living 22 with his or her parent or legal guardian and (i) who lacks a 23 fixed or regular nighttime residence or (ii) whose primary 24 residence is a supervised shelter designed to provide 25 temporary accommodations, a halfway house, or a place not 26 designed for ordinary use by humans for sleeping. 27 (Source: P.A. 89-187, eff. 7-19-95.)
