90_HB0394 New Act Creates the Agency Performance Review Act. Requires each State agency to develop a plan describing the agency's goals, programs, and efficiency over a 6-year period. Requires each agency to submit the plan to the Governor, the Lieutenant Governor, the Speaker of the House, the President of the Senate, the Bureau of the Budget, and the Auditor General. Authorizes the Auditor General when conducting a program or efficiency audit to consider the degree to which an agency conforms to its plan. Requires the Bureau of the Budget, before September 1 of each odd-numbered year, to provide each agency with a long-term forecast of the State's economy. LRB9001353MWpc LRB9001353MWpc 1 AN ACT concerning agency performance review. 2 Be it enacted by the People of the State of Illinois, 3 represented in the General Assembly: 4 Section 1. Short title. This Act may be cited as the 5 Agency Performance Review Act. 6 Section 5. Definitions. In this Act: 7 "Agency" means all Departments, Officers, Commissions, 8 Boards, Institutions, and bodies politic and corporate of the 9 State, excluding the Offices of the Supreme Court and Clerks 10 of the Appellate Courts, the courts of the State, the General 11 Assembly, commissions or committees of the General Assembly, 12 or the constitutionally elected State officers. 13 "Plan" means a strategic plan as required by this Act. 14 Section 10. Strategic plans. 15 (a) Each agency shall develop a strategic plan for its 16 operations in accordance with the provisions and goals of 17 this Act. The plan shall include, but is not limited to, 18 each of the following items or an explanation why an item 19 does not apply to the agency: 20 (1) A statement of the mission, goals, and 21 objectives of the agency. 22 (2) Measures of the output and outcome of the 23 agency in terms of indicators to be developed under this 24 Act. 25 (3) Identification of priority and other service 26 populations or other service measures under current law, 27 and how those populations are expected to change within 28 the period of the plan. 29 (4) An analysis of the use of current agency 30 resources in meeting current needs and expected future -2- LRB9001353MWpc 1 needs and additional resources that may be necessary to 2 meet future needs. 3 (5) An analysis of any likely or expected changes 4 in the services provided by an agency due to changes in 5 State or federal law. 6 (6) Plans and strategies for meeting current and 7 future needs and achieving the goals established for the 8 particular area of State government. 9 (b) Each agency shall issue a plan no later than March 1 10 of each even-numbered year. The plan will cover a period of 11 6 years from the date that it is issued by the agency. 12 (c) Each agency shall send a copy of each plan issued to 13 the Governor, the Speaker of the House, the President of the 14 Senate, the Bureau of the Budget, and the Auditor General. 15 (d) Compilation of a State agency plan. 16 (1) The Bureau of the Budget shall develop forms 17 and instructions for the agencies to aid in the 18 preparation of the agencys' plans. 19 (2) The Bureau of the Budget shall work with 20 individual agencies to determine acceptable measures of 21 workload, output, and outcome. 22 (3) Upon receipt of the individual agency plans, 23 the Bureau of the Budget shall compile a long-range 24 strategic plan for State government based on the 25 individual agency plans. 26 (4) If additional information is required 27 concerning any agency plan submitted, the Bureau of the 28 Budget may request the information from the agency and 29 the information shall be supplied in a timely fashion. 30 (5) The Bureau of the Budget may hold hearings on 31 any matter under this Act. 32 (6) The final compiled report shall be submitted to 33 the Governor, the Lieutenant Governor, the Auditor 34 General, and each member of the General Assembly no later -3- LRB9001353MWpc 1 than September 1 of each even-numbered year. 2 Section 15. Goals for State government. 3 (a) The Governor, in cooperation with the Bureau of the 4 Budget, shall establish and adopt achievement goals for each 5 functional area of State government, including: 6 (1) education, 7 (2) regulation, 8 (3) natural resources, 9 (4) health, 10 (5) human services, 11 (6) transportation, 12 (7) public safety and corrections, 13 (8) government, and 14 (9) State employee benefits. 15 (b) A statement of the goals in each applicable area 16 shall be provided to each State agency no later than October 17 1 of each odd-numbered year. 18 Section 20. Information support for strategic planning. 19 (a) The Bureau of the Budget shall provide each agency 20 with a long-term forecast of the State's economy and 21 population for use in developing the agency's plan. 22 (b) The specific information to be provided shall be 23 agreed upon by the Governor and the Bureau of the Budget. 24 (c) The information shall be provided to each agency no 25 later than September 1 of each odd-numbered year. 26 Section 25. Consideration of strategic plans in program 27 or efficiency audits. The Auditor General, when conducting a 28 program or efficiency audit, shall consider the degree to 29 which the agency being audited conforms to its strategic 30 plan. -4- LRB9001353MWpc 1 Section 30. Elimination of duplication. 2 (a) The Bureau of the Budget and the Office of the 3 Governor shall evaluate the requirements of the agencies to 4 compile similar information under other provisions of law and 5 shall make recommendations to the General Assembly to 6 eliminate unnecessary requirements or duplication. 7 (b) This Section is repealed on December 31, 1998. 8 Section 35. Initial plan. Notwithstanding any other 9 provisions of this Act, the initial statement of an agencies 10 goals required under Section 10 shall be provided no later 11 than January 1, 1998.
