90_HB0147 New Act Creates the Tuition Increase Limitation Act. Beginning with the 1997-98 academic year, prohibits a tuition rate increase at a public university that is greater than the lesser of (i) 5% of the tuition rate for the preceding academic year, or (ii) the product of the tuition rate for the preceding academic year multiplied by the rate of inflation for the calendar year in which that academic year began. LRB9000431THpk LRB9000431THpk 1 AN ACT in relation to higher education. 2 Be it enacted by the People of the State of Illinois, 3 represented in the General Assembly: 4 Section 1. Short title. This Act may be cited as the 5 Tuition Increase Limitation Act. 6 Section 5. Definition. As used in this Act, "public 7 institution of higher education" has the meaning ascribed to 8 it in Section 1 of the Board of Higher Education Act, except 9 it does not include any public community college of this 10 State. 11 Section 10. Limitation of tuition increase. 12 Notwithstanding any other law of this State, beginning with 13 the 1997-98 academic year and in each academic year 14 thereafter the governing board of a public institution of 15 higher education shall not increase or authorize an increase 16 in the rate of undergraduate tuition charged at any campus of 17 a university under its jurisdiction by an amount that is 18 greater than the lesser of the following: (i) 5% of the 19 applicable rate of tuition that was charged in the 20 immediately preceding academic year; or (ii) the result 21 obtained when the applicable rate of tuition that was charged 22 in the immediately preceding academic year is multiplied by 23 the rate of inflation for the calendar year in which that 24 academic year began. 25 Section 99. Effective date. This Act takes effect upon 26 becoming law.
