LRB9000775LDdv LRB9000775LDdv 1 AN ACT to amend the Public Utilities Act by changing 2 Section 2-103. 3 Be it enacted by the People of the State of Illinois, 4 represented in the General Assembly: 5 Section 5. The Public Utilities Act is amended by 6 changing Section 2-103 as follows: 7 (220 ILCS 5/2-103) (from Ch. 111 2/3, par. 2-103) 8 Sec. 2-103. Employment limitations. 9 (a) No former member of the Commission may, for a period 10 of 2 years (one year in the case of a person whose service as 11 a Commissioner ends before July 1, 1997) following the 12 termination of his or her services with the Commission, 13 represent any person before the Commission in a professional 14 capacity with respect to any particular Commission matter in 15 which he or she participated personally and substantially as 16 a member of the Commission. 17 (b) No former member of the Commission may act as agent 18 or attorney for any one other than the State of Illinois in 19 connection with any particular Commission matter in which he 20 or she participated personally and substantially as a member 21 of the Commission, through decision, approval, disapproval, 22 recommendation, the rendering of service, investigation, or 23 otherwise. 24 (c) No former member of the Commission may accept any 25 employment with any public utility subject to Commission 26 regulations for 2 years (one year in the case of a person 27 whose service as a Commissioner ends before July 1, 1997) 28 following the termination of his or her services with the 29 Commission. 30 (d) No public utility subject to Commission regulation 31 shall offer a former member of the Commission employment for -2- LRB9000775LDdv 1 a period of 2 years (one year in the case of a person whose 2 service as a Commissioner ends before July 1, 1997) following 3 the termination of the former Commission member's service 4 with the Commission, or otherwise hire such person as an 5 agent or attorney where such employment or contractual 6 relation would be in violation of this Section. 7 (e) While employed by the Commission and for 2 years 8 following the end of his or her employment with the 9 Commission, a person shall not accept employment with or 10 agree to perform services for or on behalf of any public 11 utility subject to regulation by the Commission. 12 (f) A public utility subject to regulation by the 13 Commission shall not offer employment to any current employee 14 of the Commission or otherwise engage or contract with a 15 current employee of the Commission to perform services for or 16 on behalf of the public utility. 17 A public utility subject to regulation by the Commission 18 shall not offer employment to any former employee of the 19 Commission whose employment with the Commission ends on or 20 after July 1, 1997, or otherwise engage or contract with such 21 a former employee of the Commission to perform services for 22 or on behalf of the public utility, for a period of 2 years 23 following the termination of the former employee's employment 24 with the Commission. 25 (g) For the purposes of subsections (e) and (f), a 26 person who directly provides legal, technical, or other 27 personal services to the Commission under a contract shall be 28 deemed to be an employee of the Commission for the duration 29 of the contract, regardless of whether the contracting party 30 is the person individually or a firm, partnership, or other 31 business entity with which the person is affiliated. 32 (Source: P.A. 84-617.) 33 Section 99.
