Requires DCFS to place school-aged children, 15 years of age or younger, with a family in the same school district unless the benefits of continuity are outweighed by some potential harm to the child. Allows schools to report families that show a pattern of frequent, random moves without a reasonable explanation. Requires a housing authority, if possible, to place families with school-aged children, 15 years of age or younger, within the same school district if the authority must relocate the family due to renovation or closure of a complex. Preempts home rule. LRB9000685DNmb LRB9000685DNmb 1 AN ACT in relation to education of children. 2 Be it enacted by the People of the State of Illinois, 3 represented in the General Assembly: 4 Section 5. The Children and Family Services Act is 5 amended by adding Section 7.4 as follows: 6 (20 ILCS 505/7.4 new) 7 Sec. 7.4. Placement within school district. In placing 8 a child under this Act, the Department shall, if possible, 9 place a school-aged child, 15 years old or younger, with a 10 family located in the same school district unless the 11 benefits of continuity of education are outweighed by some 12 potential harm to the child. 13 Section 10. The School Code is amended by adding Section 14 10-23.11A as follows: 15 (105 ILCS 5/10-23.11A new) 16 Sec. 10-23.11A. Report on frequent relocation. To 17 report families with school-aged children, 15 years of age or 18 younger, that show a pattern of frequent, random moves 19 without a reasonable explanation to appropriate State 20 agencies and local districts. 21 Section 15. The Housing Authorities Act is amended by 22 adding Section 24.5 as follows: 23 (310 ILCS 10/24.5 new) 24 Sec. 24.5. Relocation of families. 25 (a) A housing authority shall, if possible, place 26 families with school-aged children, 15 years of age or 27 younger, within the same school district if the authority is -2- LRB9000685DNmb 1 forced to relocate the family because of the renovation or 2 closure of a particular complex. 3 (b) This Section applies to any housing authority 4 created under this Act or under the powers of any home rule 5 unit. A home rule unit or a housing authority created by a 6 home rule unit may not place families in a manner 7 inconsistent with this Section. This Section is a denial and 8 limitation under subsection (i) of Section 6 of Article VII 9 of the Illinois Constitution on the concurrent powers of home 10 rule units to place families.
