90_HB0019 230 ILCS 25/2 from Ch. 120, par. 1102 Amends the Bingo License and Tax Act to increase the aggregate prize limit in any county in this State from $2,250 to $3,250 (current provisions permit certain counties to hold 2 additional bingo games after the $2,250 limit is reached). LRB9000064KRpkA LRB9000064KRpkA 1 AN ACT to amend the Bingo License and Tax Act by changing 2 Section 2. 3 Be it enacted by the People of the State of Illinois, 4 represented in the General Assembly: 5 Section 5. The Bingo License and Tax Act is amended by 6 changing Section 2 as follows: 7 (230 ILCS 25/2) (from Ch. 120, par. 1102) 8 Sec. 2. The conducting of bingo is subject to the 9 following restrictions: 10 (1) The entire net proceeds from bingo play must be 11 exclusively devoted to the lawful purposes of the 12 organization permitted to conduct that game. 13 (2) No person except a bona fide member of the 14 sponsoring organization or a bona fide member of an auxiliary 15 organization, substantially all of whose members are spouses 16 of members of the sponsoring organization may participate in 17 the management or operation of the game. 18 (3) No person may receive any remuneration or profit for 19 participating in the management or operation of the game, 20 except that if an organization licensed under this Act is 21 associated with a school or other educational institution, 22 that school or institution may reduce tuition or fees for a 23 designated pupil based on participation in the management or 24 operation of the game by any member of the organization. The 25 extent to which tuition and fees are reduced shall relate 26 proportionately to the amount of time volunteered by the 27 member, as determined by the school or other educational 28 institution. 29 (4) The aggregate retail value of all prizes or 30 merchandise awarded in any single day of bingo may not exceed 31 $3,250$2,250, except that in adjoining counties having-2- LRB9000064KRpkA 1200,000 to 275,000 inhabitants each, and in counties which2are adjacent to either of such adjoining counties and are3adjacent to a total of not more than 2 counties in this4State, and in any municipality having 2,500 or more5inhabitants and within one mile of such adjoining and6adjacent counties having less than 25,000 inhabitants, 27additional bingo games may be conducted after the $2,2508limit has been reached. The prize awarded for any one game,9including any game conducted after reaching the $2,250 limit10as authorized in this paragraph (4),may not exceed $500 cash 11 or its equivalent. 12 (5) The number of games may not exceed 25 in any one day 13 including regular and special games, except that this 14 restriction on the number of games shall not apply to bingo 15 conducted at the Illinois State Fair or any county fair held 16 in Illinois. 17 (6) The price paid for a single card under the license 18 may not exceed $1 and such card is valid for all regular 19 games on that day of bingo. A maximum of 5 special games may 20 be held on each bingo day, except that this restriction on 21 the number of special games shall not apply to bingo 22 conducted at the Illinois State Fair or any county fair held 23 in Illinois. The price for a single special game card may not 24 exceed 50 cents. 25 (7) The number of bingo days conducted by a licensee 26 under this Act is limited to one per week, except as follows: 27 (i) Bingo may be conducted in accordance with the 28 terms of a special operator's permit or limited license 29 issued under subdivision (3) of Section 1. 30 (ii) Bingo may be conducted at the Illinois State 31 Fair or any county fair held in Illinois under 32 subdivision (3) of Section 1. 33 (iii) A licensee which cancels a day of bingo 34 because of inclement weather or because the day is a -3- LRB9000064KRpkA 1 holiday or the eve of a holiday may, after giving notice 2 to the Department, conduct bingo on an additional date 3 which falls on a day of the week other than the day 4 authorized under the license. As used in this 5 subdivision (iii), "holiday" means any of the holidays 6 listed in Section 17 of the Promissory Note and Bank 7 Holiday Act. 8 (8) A licensee may rent a premises on which to conduct 9 bingo only from an organization which is licensed as a 10 provider of premises or exempt from license requirements 11 under this Act. If the organization providing the premises is 12 a metropolitan exposition, auditorium, and office building 13 authority created by State law, a licensee may enter into a 14 rental agreement with the organization authorizing the 15 licensee and the organization to share the gross proceeds of 16 bingo games; however, the organization shall not receive more 17 than 50% of the gross proceeds. 18 (9) No person under the age of 18 years may play or 19 participate in the conducting of bingo. Any person under the 20 age of 18 years may be within the area where bingo is being 21 played only when accompanied by his parent or guardian. 22 (10) The promoter of bingo games must have a proprietary 23 interest in the game promoted. 24 (11) Raffles or other forms of gambling prohibited by 25 law shall not be conducted on the premises where bingo is 26 being conducted, except that pull tabs and jar games 27 conducted under the Illinois Pull Tabs and Jar Games Act may 28 be conducted on the premises where bingo is being conducted. 29 Prizes awarded in pull tabs and jar games shall not be 30 included in the bingo prize limitation. 31 (12) An organization holding a special operator's permit 32 or a limited license may, as one of the occasions allowed by 33 such permit or license, conduct bingo for a maximum of 2 34 consecutive days, during each day of which the number of -4- LRB9000064KRpkA 1 games may exceed 25, and regular game cards need not be valid 2 for all regular games. If only noncash prizes are awarded 3 during such occasions, the prize limits stated in paragraph 4 (4) of this Section shall not apply, provided that the retail 5 value of noncash prizes for any single game shall not exceed 6 $150. 7 (Source: P.A. 87-220; 87-1175; 88-53.) 8 Section 99.
