Political contributions and campaigns.
(a) During a commissioner's or an employee's compensated time, other than vacation, personal, holiday, or compensatory time off, a commissioner or an employee in the service of the sanitary district
shall not, directly or indirectly, give or hand over to any commissioner or employee, or to any senator, representative, alderperson, councilman, or trustee, any money or other valuable thing on
account of or to be applied to the promotion of any party or political
(b) During an employee's compensated time, other than vacation, personal, holiday, or compensatory time off, an employee shall not take any part
in the management or affairs of any political party or in any political
campaign, except to exercise his or her right as a citizen privately to express
his or her opinion, and to cast his or her vote, provided, however, that an employee
shall have the right to hold any public office, either by appointment or
election, that is not incompatible with his or her duties as an employee of the
District, and provided further that the employee does not campaign or otherwise
engage in political activity during his or her compensated time other than vacation, personal, holiday, or compensatory time off.
(c) This Section shall
not be deemed to authorize conduct prohibited by the Federal Hatch Act by
employees subject to that Act.
(d) For the purposes of this Section, "compensated time" means any time worked by or credited to an employee that counts toward any minimum work time requirement imposed as a condition of employment with the sanitary district, but does not include any designated holidays or any period when the employee is on a leave of absence. With respect to commissioners, "compensated time" means any period of time when the commissioner is on the premises under the control of the sanitary district and any other time when the commissioner is executing his or her official duties, regardless of location.
For the purposes of this Section, "compensatory time off" means authorized time off earned by or awarded to an employee to compensate in whole or in part for time worked in excess of the minimum work time required of that employee as a condition of employment with the sanitary district.
