SYNOPSIS AS INTRODUCED:
 
625 ILCS 5/11-1433 new

    Amends the Illinois Vehicle Code. Requires a contractor or person employed to deliver goods from a store or restaurant through a third-party delivery service to use a non-carbon emitting mode of transportation while making such deliveries. Provides that a contractor or person who fails to comply with the provisions may be subject to a fine of $250 or suspension of the contractor's or person's driving privileges. Restricts the provisions to counties with a population of 3,000,000 or more. Limits the concurrent exercise of home rule powers.

1    AN ACT concerning transportation.
 
2    Be it enacted by the People of the State of Illinois,
3represented in the General Assembly:
 
4    Section 5. The Illinois Vehicle Code is amended by adding
5Section 11-1433 as follows:
 
6    (625 ILCS 5/11-1433 new)
7    Sec. 11-1433. Third-party delivery service; zero-emission
8deliveries.
9    (a) As used in this Section, "third-party delivery
10service" has the meaning given to that term under the Fair Food
11and Retail Delivery Act.
12    (b) A contractor or person employed to deliver goods from
13a store or restaurant through a third-party delivery service
14shall use a non-carbon emitting mode of transportation while
15making such deliveries.
16    (c) A contractor or person that violates this Section may
17be subject to a fine of $250 or suspension of the contractor's
18or person's driver's license.
19    (d) This Section shall only apply to counties with a
20population of 3,000,000 or more.
21    (e) A home rule municipality may not regulate deliveries
22pertaining to third-party delivery services in a manner
23inconsistent with this Section. This Section is a limitation

1under subsection (i) of Section 6 of Article VII of the
2Illinois Constitution on the concurrent exercise by home rule
3units of powers and functions exercised by the State.
