1    AN ACT concerning safety.
 
2    Be it enacted by the People of the State of Illinois,
3represented in the General Assembly:
 
4    Section 5. The Environmental Protection Act is amended by
5adding Section 3.141 as follows:
 
6    (415 ILCS 5/3.141 new)
7    Sec. 3.141. Notice of power plant demolition.
8    (a) If a demolition is conducted at a coal-fueled power
9plant, the owner of the coal-fueled power plant shall, at
10least 60 days before commencing the demolition or as otherwise
11required under State or federal law, notify the Agency and the
12public about the demolition and provide the Agency and the
13public with copies of any plans for the demolition. The notice
14shall comply with the following:
15        (1) The notice must be provided, where applicable, in
16    both physical and online form in a newspaper of general
17    circulation within 25 miles of where the coal-fueled power
18    plant is located. The notice must also be posted in
19    physical form in 3 prominent public places and, where
20    applicable, posted on a relevant municipal website.
21        (2) The notice must include reference to any relevant
22    permits issued to the coal-fueled power plant in relation
23    to the demolition, with express instructions stating how

1    to access a copy of the permits.
2        (3) The notice must include the following information:
3            (A) The date and time of any scheduled demolition
4        activity.
5            (B) The portion of the coal-fueled power plant
6        that is set for demolition.
7            (C) Any potential contaminants associated with the
8        demolition.
9            (D) The business name of any company that will
10        perform the demolition in whole or in part.
11            (E) Information on any applicable permits.
12            (F) Whether any unlined CCR surface impoundment or
13        public water source is near the coal-fueled power
14        plant.
15            (G) Details of the preventative measures
16        implemented by the coal-fueled power plant to control,
17        mitigate, or prevent any pollution from occurring.
18    (b) In this Section, "public" means the population of a
19town, village, or city in the State of Illinois that is within
2025 miles of a coal-fueled power plant at which demolition is to
21be conducted.
 
22    Section 99. Effective date. This Act takes effect upon
23becoming law.
