1 AN ACT in relation to vehicles.
2 Be it enacted by the People of the State of Illinois,
3 represented in the General Assembly:
4 Section 5. The Illinois Vehicle Code is amended by
5 changing Section 3-600 as follows:
6 (625 ILCS 5/3-600) (from Ch. 95 1/2, par. 3-600)
7 Sec. 3-600. Requirements for issuance of special plates.
8 (a) The Secretary of State shall not issue a series of
9 special plates that the General Assembly has authorized for
10 issuance before the effective date of this amendatory Act of
11 the 93rd General Assembly unless applications, as prescribed
12 by the Secretary, have been received for 10,000 plates of
13 that series; except that the Secretary of State may prescribe
14 some other required number of applications if that number is
15 sufficient to pay for the total cost of designing,
16 manufacturing and issuing the special license plate.
17 (a-1) The Secretary of State may issue a series of
18 special plates that the General Assembly has authorized for
19 issuance on or after the effective date of this amendatory
20 Act of the 93rd General Assembly only if the organization
21 seeking issuance of the plates either has deposited with the
22 Secretary in cash an amount the Secretary has determined to
23 be sufficient to cover the cost of designing, manufacturing,
24 and issuing 1,500 sets of the special plates or has provided
25 the Secretary with a performance bond guaranteeing payment of
26 the required amount if necessary. If no formal organization
27 exists at the time that issuance of the special plates is
28 proposed, the individual or individuals seeking issuance of
29 the plates must form an organization to deposit the required
30 moneys or post the required bond.
31 The amount deposited with the Secretary, or any proceeds

1 from redemption of the performance bond, shall be deposited
2 into the Secretary of State Special License Plate Fund.
3 (a-2) Within 3 years after the date on which issuance of
4 special plates under subsection (a-1) is first authorized,
5 the Secretary of State must receive applications for at least
6 1,500 sets of the special plates. If the required number of
7 applications is received within the 3-year period, the
8 Secretary shall return the amount of any cash deposit and
9 shall retain any interest realized on the principal. If the
10 required number of applications is not received within the
11 3-year period, the Secretary may recall the special plates.
12 This subsection (a-2) does not apply to plates for which
13 applicants must meet specified eligibility requirements.
14 (a-3) Within 3 years after the effective date of this
15 amendatory Act of the 93rd General Assembly, the Secretary of
16 State must have received applications for a total of at least
17 1,500 sets of every series of special plates that were issued
18 under subsection (a), except those special plates for which
19 the applicant must meet specified eligibility requirements.
20 If the required number of applications has not been received
21 within the 3-year period, the Secretary may recall the
22 special plates.
23 (b) The Secretary of State, upon issuing a new series of
24 special license plates, shall notify all law enforcement
25 officials of the design, color and other special features of
26 the special license plate series.
27 (c) This Section shall not apply to special license
28 plate categories in existence on the effective date of this
29 amendatory Act of 1990, or to the Secretary of State's
30 discretion as established in Section 3-611.

32 Section 99. Effective date. This Act takes effect upon
33 becoming law.
