Amends the Health Care Worker Background Check Act. Provides that the Department of Financial and Professional Regulation shall provide access to the Health Care Worker Registry to health care employers, staffing agencies, digital staffing platforms, workforce intermediaries, organizations that provide pro bono legal services, and educational entities. Provides that nothing shall prevent the Department from providing access to other types of entities to the extent that the Department deems appropriate.

| 2 | | Be it enacted by the People of the State of Illinois,
| 3 | | represented in the General Assembly:
| 4 | | Section 5. The Health Care Worker Background Check Act is | 5 | | amended by adding Section 26.1 as follows: | 6 | | (225 ILCS 46/26.1 new) | 7 | | Sec. 26.1. Access to Health Care Worker Registry. | 8 | | (a) The Department shall provide access to the Health Care | 9 | | Worker Registry, which includes the information as stated in | 10 | | Section 26, to: | 11 | | (1) health care employers; | 12 | | (2) staffing agencies; | 13 | | (3) digital staffing platforms; | 14 | | (4) workforce intermediaries; | 15 | | (5) organizations that provide pro bono legal | 16 | | services; and | 17 | | (6) educational entities. | 18 | | (b) Nothing in this Section shall prevent the Department | 19 | | from providing access to other types of entities to the extent | 20 | | the Department deems appropriate. | 21 | | (c) As used in this Section: | 22 | | "Digital staffing platform" means an organization, | 23 | | including, but not limited to, a corporation, limited |

| 1 | | liability company, partnership, sole proprietor, or any other | 2 | | entity, that both (i) operates a digital website or digital | 3 | | application that facilitates the provision of health care | 4 | | services by health care providers to individuals or entities | 5 | | seeking such services, and (ii) accepts service requests only | 6 | | through its digital website or digital application, and does | 7 | | not accept service requests by telephone, by facsimile, or | 8 | | in-person at physical locations. | 9 | | "Educational entity" means a community college, community | 10 | | agency, or private business that conducts educational programs | 11 | | in which individuals learn the skills to provide direct care | 12 | | services to clients, residents, or patients. | 13 | | "Health care employers" has the same meaning as in Section | 14 | | 15. | 15 | | "Organization providing pro bono legal services" has the | 16 | | same meaning as in subsection (n) of Section 33. | 17 | | "Staffing agency" means any individual or business entity | 18 | | whose profession is job counseling or that contracts or | 19 | | subcontracts its workers or services to a health care | 20 | | employer. | 21 | | "Workforce intermediary" has the same meaning as in | 22 | | subsection (n) of Section 33.
