1 AN ACT in relation to public employee benefits.
2 Be it enacted by the People of the State of Illinois,
3 represented in the General Assembly:
4 Section 5. The Illinois Pension Code is amended by
5 changing Section 6-128.4 as follows:
6 (40 ILCS 5/6-128.4) (from Ch. 108 1/2, par. 6-128.4)
7 Sec. 6-128.4. Minimum widow's annuities.
8 (a) Notwithstanding any other provision of this Article,
9 beginning January 1, 1996, the minimum amount of widow's
10 annuity payable to any person who is entitled to receive a
11 widow's annuity under this Article is $700 per month, without
12 regard to whether the deceased fireman is in service on or
13 after the effective date of this amendatory Act of 1995.
14 (b) Notwithstanding Section 6-128.3, beginning January
15 1, 1994, the minimum widow's annuity under this Article shall
16 be $700 per month for (1) all persons receiving widow's
17 annuities on that date who are survivors of employees who
18 retired at age 50 or over with at least 20 years of service,
19 and (2) persons who become eligible for widow's annuities and
20 are survivors of employees who retired at age 50 or over with
21 at least 20 years of service.
22 (c) Notwithstanding Section 6-128.3, beginning January
23 1, 1999, the minimum widow's annuity under this Article shall
24 be $800 per month for (1) all persons receiving widow's
25 annuities on that date who are survivors of employees who
26 retired at age 50 or over with at least 20 years of service,
27 and (2) persons who become eligible for widow's annuities and
28 are survivors of employees who retired at age 50 or over with
29 at least 20 years of service.
30 (d) Notwithstanding Section 6-128.3, beginning January
31 1, 2004, the minimum widow's annuity under this Article shall

1 be $1,000 per month for all persons receiving widow's
2 annuities on or after that date, without regard to whether
3 the deceased fireman is in service on or after the effective
4 date of this amendatory Act of the 93rd General Assembly.
5 (e) Notwithstanding Section 6-128.3, beginning January
6 1, 2005, the minimum widow's annuity under this Article shall
7 be $1,200 per month for all persons receiving widow's
8 annuities on or after that date, without regard to whether
9 the deceased fireman is in service on or after the effective
10 date of this amendatory Act of the 93rd General Assembly.

12 Section 90. The State Mandates Act is amended by adding
13 Section 8.27 as follows:
14 (30 ILCS 805/8.27 new)
15 Sec. 8.27. Exempt mandate. Notwithstanding Sections 6
16 and 8 of this Act, no reimbursement by the State is required
17 for the implementation of any mandate created by this
18 amendatory Act of the 93rd General Assembly.
19 Section 99. Effective date. This Act takes effect upon
20 becoming law.
