Amends the Election Code. Permits the dissolution of the board of election commissioners of a municipality with a population of less than 30,000 and the transfer of its authority and duties to the local election authority of the county in which the municipality is located, by referendum initiated by the registered voters of that county. Effective immediately.

| 2 | | Be it enacted by the People of the State of Illinois,
| 3 | | represented in the General Assembly:
| 4 | | Section 5. The Election Code is amended by adding Section | 5 | | 6-19.5 as follows: | 6 | | (10 ILCS 5/6-19.5 new) | 7 | | Sec. 6-19.5. Rejection of Article by county referendum. | 8 | | (a) In addition to any other
method of rejection provided | 9 | | in this Article, if the board of election commissioners of a | 10 | | municipality with a population of less than 30,000 is dissolved | 11 | | in accordance with subsection (b), the application of the | 12 | | provisions of
this Article to that municipality is rejected. | 13 | | (b) In a county with a population of less than 300,000, the | 14 | | board of election commissioners of a municipality with a | 15 | | population of less than 30,000 within that county may be | 16 | | dissolved, and the local election authority of that county may | 17 | | assume the authority and duties of the board of election | 18 | | commissioners of that municipality by a vote of the electors of | 19 | | the
county. Upon the petition of 5,000 voters registered in the | 20 | | county to the circuit court to submit to the electors of the | 21 | | county the
proposition to dissolve the board of election | 22 | | commissioners of the municipality and transfer its authority | 23 | | and duties to the local election authority of the county, the |

| 1 | | circuit court shall cause that proposition
to be submitted to | 2 | | the electors of the county at the next possible general | 3 | | election. The proposition shall be submitted in the same manner | 4 | | as provided for the adoption of this Article and Articles 14 | 5 | | and 18 of this Code, except that the question shall be stated: | 6 | | "Shall the board of election commissioners of | 7 | | ................... be dissolved and the local election | 8 | | authority of ................... County assume the authority | 9 | | and duties of the board of election commissioners of | 10 | | ...................?" | 11 | | (c)
Upon the adoption by the electors of the proposition to | 12 | | dissolve the board of election commissioners of the | 13 | | municipality and transfer its authority and duties to the local | 14 | | election authority of the county, or a reasonable period of | 15 | | time thereafter, the
board of election commissioners of the | 16 | | municipality shall turn over to the local election authority of | 17 | | the county all registry
books, registration record cards, poll | 18 | | books, tally sheets and
ballot boxes, and all other books, | 19 | | forms, blanks, and stationery
of every description in the | 20 | | board's
possession in any way relating to elections or the
| 21 | | holding of elections in the municipality. Thereupon, all | 22 | | functions,
powers, and duties of the board of election | 23 | | commissioners of the municipality relating to elections in that | 24 | | municipality are
transferred to the local election authority of | 25 | | the county.
