| 1 | | AN ACT concerning State government. | 2 | | Be it enacted by the People of the State of Illinois, | 3 | | represented in the General Assembly: | 4 | | Section 5. The Department of Public Health Powers and | 5 | | Duties Law of the Civil Administrative Code of Illinois is | 6 | | amended by adding Section 2310-257 as follows: | 7 | | (20 ILCS 2310/2310-257 new) | 8 | | Sec. 2310-257. Crisis standards of care plan. | 9 | | (a) The Department shall develop and implement a crisis | 10 | | standards of care plan as an annex to the Department of Public | 11 | | Health's Essential Support Function (ESF-8) Plan for Public | 12 | | Health and Medical Services, to assist health care facilities | 13 | | and provide support in situations in which local medical | 14 | | resources are overwhelmed, including, but not limited to, | 15 | | public health emergencies, as that term is defined in Section | 16 | | 4 of the Illinois Emergency Management Agency Act. | 17 | | (b) In developing a crisis standards of care plan, the | 18 | | Department shall: | 19 | | (1) collaborate with the entities listed in Sections | 20 | | 2310-50.5 and 2310-620 of the Department of Public Health | 21 | | Powers and Duties Law of the Civil Administrative Code of | 22 | | Illinois; | 23 | | (2) ensure the crisis standards of care plan addresses |

| 1 | | situations in which a conventional response moves to a | 2 | | crisis response and key resources may be affected; | 3 | | (3) establish a multi-disciplinary planning committee | 4 | | with representation from the following, as applicable: | 5 | | (A) the Department and local public health | 6 | | agencies; | 7 | | (B) emergency medical services; | 8 | | (C) healthcare providers and facilities, including | 9 | | representation of rural, urban, and critical access | 10 | | and municipal healthcare providers and facilities; | 11 | | (D) medical ethicists; | 12 | | (E) healthcare coalitions, including, but not | 13 | | limited to, a statewide association representing | 14 | | hospitals; and | 15 | | (F) other members from across the State with | 16 | | expertise within their disciplines, as necessary, to | 17 | | inform and develop an emergency medical disaster plan; | 18 | | (4) conduct literature reviews to develop an | 19 | | inclusive, culturally sensitive, and ethical framework for | 20 | | the Emergency Medical Disaster Plan Crisis Standards of | 21 | | Care Annex, which considers, among other factors, ethical | 22 | | healthcare decision making, health equity, and social | 23 | | determinants of health, and the equitable distribution of | 24 | | patients and critical healthcare resources in a manner | 25 | | that, to the maximum extent possible and given resources | 26 | | available at the time, reduces shortages of healthcare |

| 1 | | resources to preserve lives during a public health | 2 | | emergency; and | 3 | | (5) disseminate the crisis standards of care plan | 4 | | among healthcare providers and facilities, emergency | 5 | | management officials, public safety communities, and other | 6 | | stakeholders, including, but not limited to, disseminating | 7 | | information about, and gathering feedback on, the | 8 | | emergency medical disaster plan, including gathering | 9 | | general information and data, assessing regional needs, | 10 | | perspectives, specific capabilities and potential | 11 | | challenges, to ensure a structured, ethical, culturally | 12 | | sensitive, and integrated framework and approach to | 13 | | equitable distribution of resources during public health | 14 | | emergencies. | 15 | | (c) The Department may adopt rules necessary to implement | 16 | | this Section. | 17 | | Section 99. Effective date. This Act takes effect upon | 18 | | becoming law. |
