| 1 | | AN ACT concerning local government.
| 2 | | Be it enacted by the People of the State of Illinois,
| 3 | | represented in the General Assembly:
| 4 | | Section 5. The Municipal Clerk Training Act is amended by | 5 | | changing Sections 1, 2, 3, and 4 as follows:
| 6 | | (65 ILCS 50/1) (from Ch. 144, par. 61.51)
| 7 | | Sec. 1.
The Municipal Clerk Training Institute Committee | 8 | | shall establish a
Municipal Clerk Training Institute and | 9 | | designate the number of times each
year the program provided | 10 | | for in this Act shall be offered by the Institute.
The location | 11 | | or locations within the State at which the program shall be
| 12 | | offered each year shall be fixed by the Municipal Clerk | 13 | | Training Institute
Committee , provided that any location so | 14 | | fixed shall be on the campus of one
or more of the colleges or | 15 | | universities represented on the Committee .

There is created the Municipal Clerk Training | 19 | | Institute Committee
composed of 5 municipal clerks or deputy | 20 | | clerks , appointed by
the Governor as provided herein, and one 9 | 21 | | ex-officio member members, designated by the governing board of | 22 | | any public college or university in this State at the request |

| 1 | | of the Executive Board of the Municipal Clerks of Illinois
as | 2 | | provided herein, as a representative representatives of public | 3 | | colleges and universities in
this State. Each member appointed | 4 | | by the Governor after the effective
date of this amendatory Act | 5 | | of 1987 shall be a certified municipal clerk
recommended by the | 6 | | Executive Board of the Municipal Clerks of Illinois and
serving | 7 | | as a municipal clerk at the time he or she is so recommended | 8 | | and
appointed. The 2 additional municipal clerks appointed | 9 | | pursuant to the
provisions of this amendatory Act of 1987 both | 10 | | shall be appointed to serve
until the third Monday in January, | 11 | | 1992, or until their successors are
appointed and qualified. Of | 12 | | the 3 municipal clerks serving as members of
the Committee on | 13 | | the effective date of this amendatory Act of 1987, they
shall | 14 | | determine by agreement or by lot one who shall continue to so | 15 | | serve
until the third Monday in January, 1989, a second who | 16 | | shall continue to so
serve until the third Monday in January, | 17 | | 1990, and a third who shall
continue to so serve until the | 18 | | third Monday in January, 1991; provided,
that each shall serve | 19 | | until his or her successor is appointed and
qualified. Each | 20 | | successor of any member appointed to the Committee as a
| 21 | | municipal clerk or deputy clerk shall be appointed to serve for | 22 | | a 4 year term expiring on
the third Monday in January, or until | 23 | | his or her successor is appointed and
qualified. Any vacancy | 24 | | occurring in the office of a Committee member
appointed by the | 25 | | Governor, whether by death, resignation or otherwise,
shall be | 26 | | filled by appointment by the Governor from a recommendation or

| 1 | | recommendations made by the Executive Board of the Municipal | 2 | | Clerks of
Illinois, in the same manner as original | 3 | | appointments. A member appointed
to fill a vacancy shall serve | 4 | | for the remainder of the unexpired term or
until his or her | 5 | | successor is appointed and qualified. In the event the
Governor | 6 | | refuses to appoint a municipal clerk or deputy clerk | 7 | | recommended by
the Executive Board of the Municipal Clerks of | 8 | | Illinois to either a full
term or, in cases of a vacancy, to | 9 | | the remainder of an unexpired term on
the Committee, such | 10 | | Executive Board shall promptly recommend one or more
additional | 11 | | qualified persons to the Governor for such appointment. The | 12 | | term of the ex-officio member may be designated by the | 13 | | governing board of any public college or university in this | 14 | | State at the request of the Executive Board of the Municipal | 15 | | Clerks of Illinois. The
terms of the 3 committee members | 16 | | designated by the Board of Trustees of the
University of | 17 | | Illinois and serving on the effective date of this amendatory
| 18 | | Act of 1987 shall terminate on that effective date, and the 4 | 19 | | ex-officio
members designated pursuant to the provisions of | 20 | | this amendatory Act of
1987 shall be designated as follows: one | 21 | | representative of the University
of Illinois designated by the | 22 | | Board of Trustees of that University; one
representative of | 23 | | Southern Illinois University designated by the Board of
| 24 | | Trustees of that University; one representative designated by | 25 | | the Board of
Governors of State Colleges and Universities of | 26 | | the several universities
and colleges under its governance; and |

| 1 | | one representative designated by the
Board of Regents of the | 2 | | several Regency Universities under its
jurisdiction. The terms | 3 | | of the 2 ex-officio members designated as
representatives of | 4 | | the Board of Governors of State Colleges and Universities
and | 5 | | the Board of Regents shall terminate on the effective date of | 6 | | this
amendatory Act of 1995. The 2 ex-officio members whose | 7 | | terms are terminated by
this amendatory Act of 1995 shall be | 8 | | replaced by 7 additional ex-officio
members, one representing | 9 | | the Board of Trustees of Chicago State University,
one | 10 | | representing the Board of Trustees of Eastern Illinois | 11 | | University, one
representing the Board of Trustees of Governors | 12 | | State University, one
representing the Board of Trustees of | 13 | | Illinois State University, one
representing the Board of | 14 | | Trustees of Northeastern Illinois University, one
representing | 15 | | the Board of Trustees of Northern Illinois University, and one
| 16 | | representing the Board of Trustees of Western Illinois | 17 | | University. The 9
ex-officio member members representing the | 18 | | public
colleges and universities shall serve in an advisory | 19 | | capacity to the
members appointed by the Governor, and each | 20 | | such ex-officio member shall
serve at the pleasure of the | 21 | | governing board designating them to membership
on the | 22 | | Committee. Members of the Committee shall serve without | 23 | | compensation.

The Committee shall develop the curriculum for the | 2 | | Municipal Clerk
Training Institute and include such subjects | 3 | | and courses as will provide
methods for maintaining the | 4 | | services of municipal clerks or deputy clerks at a level
| 5 | | consistent with the needs of the municipality and the public. | 6 | | The subjects
selected shall include, but are not limited to, a | 7 | | study of the Illinois
Municipal Code, parliamentary procedure, | 8 | | office management and the
preparation of agendas, minutes and | 9 | | records.

Each year, the The Institute shall offer (i) a | 13 | | course of at least 5 one-day sessions one week's duration
which | 14 | | may be attended by municipal clerks or deputy clerks who have | 15 | | been newly appointed or
elected to office , and (ii) an advanced | 16 | | a refresher course each year of at least 2 one-day sessions 2 | 17 | | days' duration which
may be attended by all other municipal | 18 | | clerks or deputy clerks . Attendance at courses
offered by the | 19 | | Institute shall be restricted to municipal clerks and their
| 20 | | deputies.
