1 AN ACT concerning insurance.
2 Be it enacted by the People of the State of Illinois,
3 represented in the General Assembly:
4 Section 5. The Illinois Insurance Code is amended by
5 adding Section 356z.4 as follows:
6 (215 ILCS 5/356z.4 new)
7 Sec. 356z.4. Surgical assistants. A group or individual
8 policy of accident and health insurance amended, delivered,
9 issued, or renewed after the effective date of this
10 amendatory Act of the 93rd General Assembly that provides
11 coverage for health care services, including surgical
12 services, must provide coverage for services rendered by an
13 assistant in surgery authorized or credentialed by a hospital
14 or ambulatory surgical treatment center to provide surgical
15 assistance to a physician licensed to practice medicine in
16 all its branches. An assistant in surgery may be a physician
17 licensed to practice medicine in all its branches, an
18 advanced practice registered nurse, a registered professional
19 nurse, a nationally certified surgical assistant, a
20 nationally certified first assistant, or a nationally
21 certified orthopedic assistant physician. In the case of an
22 assistant physician, a nationally certified surgical
23 assistant, a nationally certified first assistant, or a
24 nationally certified orthopedic assistant physician,
25 insurance reimbursement may be made directly to the provider.
26 Section 10. The Health Maintenance Organization Act is
27 amended by changing Section 4-6.5 as follows:

29 Sec. 4-6.5. Required health benefits; Illinois Insurance

1 Code requirements. A health maintenance organization is
2 subject to the provisions of Sections 155.37, 356t, 356u, and
3 356z.1, and 356z.4 of the Illinois Insurance Code.

6 Section 15. The Voluntary Health Services Plans Act is
7 amended by changing Section 10 as follows:

9 Sec. 10. Application of Insurance Code provisions.
10 Health services plan corporations and all persons interested
11 therein or dealing therewith shall be subject to the
12 provisions of Articles IIA and XII 1/2 and Sections 3.1, 133,
13 140, 143, 143c, 149, 155.37, 354, 355.2, 356r, 356t, 356u,
14 356v, 356w, 356x, 356y, 356z.1, 356z.2, 356z.4, 367.2, 368a,
15 401, 401.1, 402, 403, 403A, 408, 408.2, and 412, and
16 paragraphs (7) and (15) of Section 367 of the Illinois
17 Insurance Code.

22 Section 99. Effective date. This Act takes effect upon
