Amends the Metropolitan Water Reclamation District Act. Provides that the board of commissioners of the Water Reclamation District of Greater Chicago shall: on or before July 1, 2021, divide the Water Reclamation District of Greater Chicago into 9 commissioner districts and assign the commissioner districts to reflect the results of the most recent federal decennial census; and thereafter, in the year following each federal decennial census, redistrict the commissioner districts to reflect the results of the most recent census. Provides that the commissioner districts shall be compact, contiguous, and substantially equal in population to each other district. Provides that one commissioner shall be elected from each commissioner district for a term of 6 years and that the commissioner shall be a resident of the commissioner district from which he or she was elected. Provides that if the corporate limits of the District expands between redistrictings, the board of commissioners shall determine which commissioner district or districts the expanded territory will join until the next redistricting. Provides that the terms of all commissioners serving at the time of the 2022 general election shall continue until the first Tuesday after the first Monday in the month following the 2022 general election or until the 9 new commissioners are elected and qualified, whichever is later. Makes conforming changes.

| 2 | | Be it enacted by the People of the State of Illinois,
| 3 | | represented in the General Assembly:
| 4 | | Section 5. The Metropolitan Water Reclamation District Act | 5 | | is amended by changing Section 3 and by adding Section 3.3 as | 6 | | follows:

| 8 | | Sec. 3. The corporate authority of the Sanitary District of | 9 | | Chicago shall
consist of nine trustees. Such trustees shall be | 10 | | elected for staggered
terms at the election provided by the | 11 | | general election law. Except as provided by Section 3.3, three | 12 | | Three trustees
shall be elected at each such election to | 13 | | succeed the 3 trustees whose terms
expire in such year.
| 14 | | Such trustees shall take office on the first Tuesday after | 15 | | the first Monday
in the month following the month of their | 16 | | election and shall hold their
offices for six years and until | 17 | | their successors shall be elected and qualified. Except for | 18 | | elections of the commissioners of the Metropolitan Water | 19 | | Reclamation District of Greater Chicago on and after the 2022 | 20 | | general election, in

as there are trustees to be | 22 | | elected, but no elector may give to such candidates
more than | 23 | | one vote, it being the intent and purpose of this Act to |

cumulative voting in the selection of members of the | 2 | | board of the sanitary district.
| 3 | | The election of trustees shall be in accordance with the | 4 | | provisions of
the general election law.
| 5 | | By reason of the importance and character of the services | 6 | | performed by
the sanitary district, there is a great need and | 7 | | it is in the public interest
that such services be performed in | 8 | | as near a non-partisan character as possible.
| 9 | | When a vacancy exists in the office of trustees of any | 10 | | sanitary district
organized under the provisions hereof, the | 11 | | vacancy shall be filled by appointment
by the Governor until | 12 | | the next regular election at which trustees of the
Sanitary | 13 | | District of Chicago are elected, and thereafter until a | 14 | | successor
shall be elected and qualified.
| 15 | | Such sanitary district shall from the time of the first | 16 | | election held by
it under this Act be construed in all courts | 17 | | to be
a body corporate and politic, and by the name and style | 18 | | of the sanitary
district of...., and by such name and style may | 19 | | sue and be sued, contract
and be contracted with, acquire and | 20 | | hold real estate and personal property
necessary for corporate | 21 | | purposes,
and adopt a common seal and alter the same at | 22 | | pleasure.
| 23 | | The board of trustees shall have the power to change the | 24 | | name of the Sanitary
District of Chicago by ordinance and | 25 | | public notice without impairing the
legal status of acts | 26 | | theretofore performed by said district. Thereafter

| 1 | | references to the Sanitary District of Chicago in this Act or
| 2 | | otherwise shall mean and include the name under which such | 3 | | sanitary district
is then operating. No rights, duties or | 4 | | privilege of such a sanitary district,
or those of any person, | 5 | | existing before the change of name shall be affected
by a | 6 | | change, in the name of a sanitary district. All proceedings | 7 | | pending
in any court in favor of or against such sanitary | 8 | | district may continue
to final consummation under the name in | 9 | | which they were commenced.

Districting required; election. | 13 | | (a) The board of commissioners of the Water Reclamation | 14 | | District of Greater Chicago shall: on or before July 1, 2021, | 15 | | divide the Water Reclamation District of Greater Chicago into 9 | 16 | | commissioner districts and assign the commissioner districts | 17 | | to reflect the results of the most recent federal decennial | 18 | | census; and thereafter, in the year following each decennial | 19 | | census, redistrict the commissioner districts to reflect the | 20 | | results of the most recent census. Each commissioner district | 21 | | shall be compact, contiguous, and substantially equal in | 22 | | population to each other district. The division of the Water | 23 | | Reclamation District of Greater Chicago into commissioner | 24 | | districts must be completed and formally approved by a majority | 25 | | of the members of the board of commissioners. | 1 | | meeting of the board of commissioners held on or before July 1, | 2 | | 2021, the board shall, publicly by lot, divide the commissioner | 3 | | districts into 3 groups. In the 2022 general election, the | 4 | | commissioners from the first group shall be elected for a term | 5 | | of 2 years, the commissioners from the second group shall be | 6 | | elected for a term of 4 years, and the commissioners from the | 7 | | third group shall be elected for a term of 6 years. Thereafter, | 8 | | all the terms shall be 6 years and elected pursuant to Section | 9 | | 3 of this Act. One commissioner shall be elected from each | 10 | | commissioner district and the commissioner shall be a resident | 11 | | of the commissioner district from which he or she is elected. | 12 | | (b) If the corporate limits of the District expand between | 13 | | redistrictings, the board of commissioners shall determine | 14 | | which commissioner district or districts the expanded | 15 | | territory will join until the next redistricting. | 16 | | (c) The terms of all commissioners serving at the time of | 17 | | the 2022 general election shall continue until the first | 18 | | Tuesday after the first Monday in the month following the 2022 | 19 | | general election or until the 9 new commissioners are elected | 20 | | and qualified under subsection (a), whichever is later.
