Amends the Humane Care for Animals Act. Prohibits a carnival from offering, awarding, or giving away any live animal in a game, contest, or tournament involving skill or chance. Provides that the carnival may offer a coupon, certificate, or voucher to obtain the live animal from a licensed pet store as the prize. Defines "carnival".

| 1 | | AN ACT concerning animals.
| 2 | | Be it enacted by the People of the State of Illinois,
| 3 | | represented in the General Assembly:
| 4 | | Section 5. The Humane Care for Animals Act is amended by | 5 | | changing Section 4 and adding Section 2.01i as follows: | 6 | | (510 ILCS 70/2.01i new) | 7 | | Sec. 2.01i. Carnival. "Carnival" has the meaning ascribed | 8 | | to that term in the Carnival Regulation Act.

| 10 | | Sec. 4. Prohibited acts. No person may sell, offer for | 11 | | sale, barter,
or give away as a pet or a novelty any rabbit or | 12 | | any baby chick, duckling or
other fowl which has been dyed, | 13 | | colored, or otherwise treated to impart an
artificial color | 14 | | thereto. Baby chicks or ducklings shall not be sold, offered
| 15 | | for sale, bartered, or given away as pets or novelties. | 16 | | Rabbits, ducklings
or baby chicks shall not be awarded as | 17 | | prizes.
| 18 | | No person may allow for the adoption, transfer, sale, offer | 19 | | for sale, barter, or give away any animal forfeited or | 20 | | relinquished under Section 3.04 or 3.05 of this Act to the | 21 | | person who forfeited the animal or a person residing in that | 22 | | person's household. |

| 1 | | No carnival may offer, award, or give away any live animal | 2 | | as a prize in a game, contest, or tournament involving skill or | 3 | | chance. A carnival may offer a coupon, certificate, or voucher | 4 | | to obtain the live animal from a licensed pet store as the | 5 | | prize. | 6 | | A person convicted of violating this Section is guilty of a | 7 | | Class B
misdemeanor. A second or subsequent violation is a | 8 | | Class 4 felony, with
every day that a violation continues | 9 | | constituting a separate offense.
