| AN ACT concerning professional regulation.

| Be it enacted by the People of the State of Illinois,
| 3 |
| represented in the General Assembly:
| 4 |
| Section 5. The School Code is amended by changing Sections | 5 |
| 14-1.09b and 14-6.04 as follows:

| (105 ILCS 5/14-1.09b)
| 7 |
| Sec. 14-1.09b. Speech-language pathologist.
| 8 |
| (a) For purposes of supervision of a speech-language | 9 |
| pathology assistant,
"speech-language pathologist" means a | 10 |
| person who has received a license
pursuant to the Illinois | 11 |
| Speech-Language Pathology and Audiology Practice Act
to engage | 12 |
| in the practice of speech-language pathology.
| 13 |
| (b) The School Service Personnel Certificate with a | 14 |
| speech-language
endorsement shall be issued under Section | 15 |
| 21-25 of this Code to a
speech-language pathologist who meets | 16 |
| all of the following requirements:
| 17 |
| (1) Holds (A) Holds a regular license as a | 18 |
| speech-language pathologist
pursuant to the Illinois | 19 |
| Speech-Language Pathology and Audiology Practice Act,
(B) | 20 |
| holds a current Certificate of Clinical Competence in
| 21 |
| speech-language pathology from the American | 22 |
| Speech-Language-Hearing Association
and a regular license | 23 |
| in speech-language pathology from another state or
| 24 |
| territory or the District of Columbia and has applied for a | 25 |
| regular license as
a speech-language pathologist pursuant | 26 |
| to the Illinois Speech-Language
Pathology and Audiology | 27 |
| Practice Act, or (C) holds or has applied for a temporary | 28 |
| license pursuant to
Section 8.1 of the Illinois | 29 |
| Speech-Language Pathology and Audiology Practice Act and | 30 |
| has
completed an approved program .
| 31 |
| (2) Holds a master's or doctoral degree with a major | 32 |
| emphasis in
speech-language pathology from an institution |

| whose course of study was
approved or program was | 2 |
| accredited by the Council on Academic Accreditation in
| 3 |
| Audiology and Speech-Language Pathology of the American | 4 |
| Speech-Language-Hearing
Association or its predecessor.
| 5 |
| (3) Either (i) has completed a program of study before | 6 |
| July 1, 2002 that
includes course work and supervised | 7 |
| clinical experience sufficient in breadth
and depth to | 8 |
| demonstrate knowledge and skills related to the specific | 9 |
| problems,
methods and procedures applicable to students | 10 |
| with disabilities in a school
setting serving ages 3 | 11 |
| through 21 or (ii) meets the content area standards for
| 12 |
| speech-language pathologists approved
adopted by the State | 13 |
| Board of Education, in
consultation with the State Teachers | 14 |
| Certification Board , (ii) has completed a program in | 15 |
| another state, territory, or possession of the United | 16 |
| States that is comparable to an approved program of study | 17 |
| described in item (i), or (iii) holds a certificate issued | 18 |
| by another state, territory, or possession of the United | 19 |
| States that is comparable to the school service personnel | 20 |
| certificate with a speech-language endorsement. If the | 21 |
| requirements described in items (i), (ii), or (iii) of this | 22 |
| paragraph (3) have not been met, a person must provide | 23 |
| evidence that he or she has completed at least 150 clock | 24 |
| hours of supervised experience in speech-language | 25 |
| pathology with students with disabilities in a school | 26 |
| setting, including experience required by federal law or | 27 |
| federal court order; however, a person who lacks such | 28 |
| experience may obtain interim certification as established | 29 |
| by the Illinois State Board of Education, in consultation | 30 |
| with the State Teacher Certification Board, and shall | 31 |
| participate in school-based professional experience of at | 32 |
| least 150 clock hours to meet this requirement .

| (4) Has successfully completed the required Illinois | 34 |
| certification tests.
| 35 |
| (5) Has paid the application fee required for | 36 |
| certification.

| The provisions of this subsection (b) do not preclude the | 2 |
| issuance of a
teaching certificate to a speech-language | 3 |
| pathologist who qualifies for such a
certificate.

| Sec. 14-6.04. Contracting for speech-language pathology | 7 |
| services.
| 8 |
| (a) For purposes of this Section:
| 9 |
| "Reasonable efforts" means performing all of the | 10 |
| following:
| 11 |
| (1) placing at least 3 employment advertisements for a | 12 |
| speech-language
pathologist published in the newspaper of | 13 |
| widest distribution within the school
district or | 14 |
| cooperative;
| 15 |
| (2) placing one employment listing in the placement | 16 |
| bulletin of a
college or university that has a | 17 |
| speech-language pathology curriculum that is
located in | 18 |
| the geographic area of the school district or cooperative, | 19 |
| if any;
and
| 20 |
| (3) posting the position for speech-language | 21 |
| pathologist on the Illinois
Association of School | 22 |
| Administrators' job placement service for at least 30
days.
| 23 |
| "Speech-language pathologist" means a person who:
| 24 |
| (1) holds a master's or doctoral degree with a major | 25 |
| emphasis in
speech-language pathology from an institution | 26 |
| whose course of study was
approved or program was | 27 |
| accredited by the Council on Academic Accreditation in
| 28 |
| Audiology and Speech-Language Pathology of the American | 29 |
| Speech-Language-Hearing
Association or its predecessor; | 30 |
| and
| 31 |

| 24 |
| "Speech-language pathology services" means the application | 25 |
| of methods and
procedures for identifying, measuring, testing, | 26 |
| appraising, predicting, and
modifying communication | 27 |
| development and disorders or disabilities of speech,
language, | 28 |
| voice, swallowing, and other speech, language, and | 29 |
| voice-related
disorders for the purpose of counseling, | 30 |
| consulting, and rendering services or
participating in the | 31 |
| planning, directing, or conducting of programs that are
| 32 |
| designed to modify communicative disorders and conditions in | 33 |
| individuals or
groups of individuals involving speech, | 34 |
| language, voice, and swallowing
functions.
| 35 |
| (b) A school district or a cooperative must make reasonable | 36 |
| efforts to
employ a speech-language pathologist. While making |

| those reasonable efforts or
after unsuccessful reasonable | 2 |
| efforts have been made, or both, a school
district or | 3 |
| cooperative may contract for speech-language pathology
| 4 |
| services with a speech-language pathologist or an entity that | 5 |
| employs
speech-language pathologists. A speech-language | 6 |
| pathologist who provides
speech-language pathology services | 7 |
| pursuant to a contract must hold :
| 8 |
| (1) hold a speech-language pathology license under the | 9 |
| Illinois Speech-Language
Pathology and Audiology Practice | 10 |
| Act or hold or have applied for a temporary license issued | 11 |
| under Section 8.1 of that Act ; and
| 12 |
| (2) hold a certificate under this Code with an | 13 |
| endorsement in speech-language
pathology.

| Section 10. The Illinois Speech-Language Pathology and
| 16 |
| Audiology Practice Act is amended by changing Sections 8.1 and | 17 |
| 8.5 as follows:

| (Section scheduled to be repealed on January 1, 2008)
| 20 |
| Sec. 8.1. Temporary license. On and after July 1, 2005
| 21 |
| January 1, 2004 , a person who has
met the requirements of items | 22 |
| (a) through (e) of Section 8 and intends to
undertake | 23 |
| supervised professional experience as a speech-language | 24 |
| pathologist,
as required by subsection (f) of Section 8 and the | 25 |
| rules adopted by the
Department, must first obtain a temporary | 26 |
| license from the Department. A
temporary license may be issued | 27 |
| by the Department only to an applicant pursuing
licensure as a | 28 |
| speech-language pathologist in this State. A temporary license
| 29 |
| shall be issued to an applicant upon receipt of the required | 30 |
| fee as set forth
by rule and documentation on forms prescribed | 31 |
| by the Department certifying that his or her professional | 32 |
| experience will be supervised by
demonstrating
that a licensed | 33 |
| speech-language pathologist has agreed to supervise the
| 34 |
| professional experience of the applicant . A temporary license |

| shall be issued
for a period of 12 months and may be renewed | 2 |
| only once for good cause shown.

| Sec. 8.5. Qualifications for licenses as a speech-language | 7 |
| pathology
assistant.
| 8 |
| (a) A person is qualified to be licensed as a | 9 |
| speech-language
pathology assistant if that person has applied | 10 |
| in writing on forms prescribed
by the Department, has paid the | 11 |
| required fees, and meets both of the following
criteria:
| 12 |
| (1) Is of good moral character. In determining moral | 13 |
| character, the
Department
may take into consideration any | 14 |
| felony conviction of the
applicant, but such a conviction | 15 |
| shall not operate automatically as a complete
bar to | 16 |
| licensure.
| 17 |
| (2) Has received an associate degree from a | 18 |
| speech-language pathology
assistant
program that has been | 19 |
| approved by the Department and
that meets the minimum | 20 |
| requirements set forth in Section 8.6. | 21 |
| (b) Until July 1, 2005
January 1, 2004 , a person holding a | 22 |
| bachelor's level degree in
communication disorders who was | 23 |
| employed to assist a speech-language
pathologist on June 1, | 24 |
| 2002 (the effective date of P.A. 92-510)
the effective date of | 25 |
| this amendatory Act of the 92nd General
Assembly shall be | 26 |
| eligible to receive a license as a speech-language pathology
| 27 |
| assistant from the Department upon completion of forms | 28 |
| prescribed by the
Department and the payment of the required | 29 |
| fee.

| Section 99. Effective date. This Act takes effect upon | 32 |
| becoming law.
