1 AN ACT concerning veterans preferences.
2 Be it enacted by the People of the State of Illinois,
3 represented in the General Assembly:
4 Section 5. The Illinois Municipal Code is amended by
5 changing Section 10-1-16 as follows:

7 Sec. 10-1-16. Veterans preferences. Persons who were
8 engaged in the military or naval service of the United States
9 at any time during the years 1898 through 1902, 1914 through
10 1919, at any time between September 16, 1940 and July 25,
11 1947, or at any time during the national emergency between
12 June 25, 1950 and January 31, 1955, or at any time between
13 January 1, 1961 and the date Congress declares the Viet Nam
14 conflict ended, and who were honorably discharged from that
15 servicetherefrom and all persons who were engaged in the
16 such military or naval service during any of thosesuch years
17 who are now or may hereafter be on inactive or reserve duty
18 in thesuch military or naval service, not including,
19 however, persons who were convicted by court-martial of
20 disobedience of orders, where thesuch disobedience consisted
21 in the refusal to perform military service on the ground of
22 alleged religious or conscientious objections against war,
23 shall be preferred for appointments to civil offices,
24 positions, and places of employment in the classified service
25 of any municipality coming under the provisions of this
26 Division 1, provided they are found to possess the business
27 capacity necessary for the proper discharge of the duties of
28 such office, position, or place of employment as determined
29 by examination. The civil service commission on certifying
30 from any existing register of eligibles resulting from the
31 holding of an examination for original entrance or any

1 register of eligibles that may be hereafter created of
2 persons who have taken and successfully passed the
3 examinations provided for in this Division 1 for original
4 entrance commencing prior to September 1, 1949, shall place
5 the name or names of such persons at the head of any existing
6 eligible register or list of eligibles that may hereafter be
7 created under the provision of this Division 1, to be
8 certified for appointment. The civil service commission shall
9 give preference for original appointment to persons as
10 hereinabove designated whose names appear on any register of
11 eligibles resulting from an examination for original entrance
12 held under the provisions of this Division 1 and commenced on
13 or after September 1, 1949 by adding to the final grade
14 average which they received or will receive as the result of
15 any examination held for original entrance, 5 points. The
16 numerical result thus attained shall be applied by the civil
17 service commission in determining the position of such
18 persons on any eligible list which has been created as the
19 result of any examination for original entrance commenced on
20 or after September 1, 1949 for purposes of preference in
21 certification and appointment from such eligible list.
22 Every certified civil service employee who was called to,
23 or who volunteered for, the military or naval service of the
24 United States at any time during the years specified in this
25 Division 1, at any time between September 16, 1940 and July
26 25, 1947, or at any time during the national emergency
27 between June 25, 1950 and January 31, 1955, or at any time
28 between January 1, 1961 and the date Congress declares the
29 Viet Nam conflict ended, and who were honorably discharged
30 therefrom or who are now or who may hereafter be on inactive
31 or reserve duty in such military or naval service, not
32 including, however, persons who were convicted by court
33 martial of disobedience of orders where such disobedience
34 consisted in the refusal to perform military service on the

1 ground of alleged religious or conscientious objections
2 against war, and whose names appear on existing promotional
3 eligible registers or any promotional eligible register that
4 may hereafter be created, as provided for by this Division 1,
5 shall be preferred for promotional appointment to civil
6 offices, positions and places of employment in the classified
7 civil service of any municipality coming under the provisions
8 of this Division 1.
9 The civil service commission shall give preference for
10 promotional appointment to persons as hereinabove designated
11 whose names appear on existing promotional eligible registers
12 or promotional eligible registers that may hereafter be
13 created by adding to the final grade average which they
14 received or will receive as the result of any promotional
15 examination commencing prior to September 1, 1949, six-tenths
16 of one point for each 6 months or fraction thereof of
17 military or naval service not exceeding 30 months, and by
18 adding to the final grade average which they will receive as
19 the result of any promotional examinations held commencing on
20 or after September 1, 1949 seven-tenths of one point for each
21 6 months or fraction thereof of military or naval service not
22 exceeding 30 months. The numerical result thus attained shall
23 be applied by the civil service commission in determining the
24 position of such persons on any eligible list which has been
25 created or will be created as the result of any promotional
26 examination held hereunder for purposes of preference in
27 certification and appointment from such eligible list.
28 No person shall receive the preference for a promotional
29 appointment granted by this Section after he has received one
30 promotion from an eligible list on which he was allowed such
31 preference and which was prepared as a result of an
32 examination held on or after September 1, 1949.
33 No person entitled to preference or credit for military
34 or naval service hereunder shall be required to furnish

1 evidence or record of honorable discharge from the armed
2 forces before the publication or posting of any eligible
3 register or list resulting from the examination. Such
4 preference shall be given after the posting or publication of
5 any eligible list or register resulting from such examination
6 and before any certifications or appointments are made from
7 such list or register.
