1 AN ACT concerning elections.
2 Be it enacted by the People of the State of Illinois,
3 represented in the General Assembly:
4 Section 5. The Election Code is amended by adding
5 Section 9-8.5 as follows:
6 (10 ILCS 5/9-8.5 new)
7 Sec. 9-8.5. Prohibited solicitations by certain State
8 officials, employees, and appointees. An executive or
9 legislative branch constitutional officer, his or her
10 employees, or a candidate in a general primary election or
11 general election for that constitutional office may not
12 knowingly solicit contributions from that constitutional
13 officer's employees, regardless of the time, place, or manner
14 of solicitation nor may the officer, employee, or candidate
15 ask such employees to raise funds from others.
16 For the purpose of this Section: executive branch
17 constitutional officer means the Governor, Lieutenant
18 Governor, Secretary of State, Attorney General, State
19 Treasurer, and State Comptroller; legislative branch
20 constitutional officer means a member of the General
21 Assembly; and employee means a full-time or part-time
22 salaried employee or a salaried appointee (i) of any office,
23 board, commission, agency, department, authority,
24 administrative unit, or corporate outgrowth under the
25 jurisdiction of the applicable executive branch
26 constitutional officer or entity or (ii) of the legislative
27 branch.
28 Violation of this Section constitutes grounds for
29 disciplinary action, including discharge, against the
30 offending officer or employee to the extent permissible under
31 the Illinois Constitution. In the case of an executive or

1 legislative branch constitutional officer, violation of this
2 Section may constitute grounds for his or her impeachment or
3 expulsion.
4 Nothing in this Section prevents the making or accepting
5 of voluntary contributions otherwise in accordance with law.
