| 1 | | AN ACT concerning State government.
| 2 | | Be it enacted by the People of the State of Illinois,
| 3 | | represented in the General Assembly:
| 4 | | Section 5. The Illinois Lottery Law is amended by changing | 5 | | Section 21.5 as follows: | 6 | | (20 ILCS 1605/21.5)
| 7 | | Sec. 21.5. Carolyn Adams Ticket For The Cure. | 8 | | (a) The Department shall offer a special instant | 9 | | scratch-off game with the title of " Carolyn Adams Ticket For | 10 | | The Cure". The game shall commence on January 1, 2006 or as | 11 | | soon thereafter, in the discretion of the Director, as is | 12 | | reasonably practical, and shall be discontinued on December 31, | 13 | | 2016 2011 . The operation of the game shall be governed by this | 14 | | Act and any rules adopted by the Department. The Department | 15 | | must consult with the Carolyn Adams Ticket For The Cure Board, | 16 | | which is established under Section 2310-347 of the Department | 17 | | of Public Health Powers and Duties Law of the
Civil | 18 | | Administrative Code of Illinois, regarding the design and | 19 | | promotion of the game. If any provision of this Section is | 20 | | inconsistent with any other provision of this Act, then this | 21 | | Section governs. | 22 | | (b) The Carolyn Adams Ticket For The Cure Grant Fund is | 23 | | created as a special fund in the State treasury. The net |

| 1 | | revenue from the Carolyn Adams Ticket For The Cure special | 2 | | instant scratch-off game shall be deposited into the Fund for | 3 | | appropriation by the General Assembly solely to the Department | 4 | | of Public Health for the purpose of making grants to public or | 5 | | private entities in Illinois for the purpose of funding | 6 | | research concerning breast cancer research, and supportive for | 7 | | funding services for breast cancer survivors and those impacted | 8 | | by breast cancer and breast cancer education. In awarding | 9 | | grants, the Department of Public Health shall consider criteria | 10 | | that includes, but is not limited to, projects and initiatives | 11 | | that address disparities in incidence and mortality rates of | 12 | | breast cancer, based on data from the Illinois Cancer Registry, | 13 | | and populations facing barriers to care victims . The Department | 14 | | of Public Health shall must , before grants are awarded, provide | 15 | | copies of all grant applications to the Carolyn Adams Ticket | 16 | | For The Cure Board, receive and review the Board's | 17 | | recommendations and comments, and consult with the Board | 18 | | regarding the grants. For purposes of this Section, the term | 19 | | "research" includes, without limitation, expenditures to | 20 | | develop and advance the understanding, techniques, and | 21 | | modalities effective in the detection, prevention, screening, | 22 | | and treatment of breast cancer and may include clinical trials. | 23 | | The grant funds may not be used for institutional, | 24 | | organizational, or community-based overhead costs, indirect | 25 | | costs, or levies. | 26 | | Moneys received for the purposes of this Section, |

| 1 | | including, without limitation, net revenue from the special | 2 | | instant scratch-off game and gifts, grants, and awards from any | 3 | | public or private entity, must be deposited into the Fund. Any | 4 | | interest earned on moneys in the Fund must be deposited into | 5 | | the Fund. | 6 | | For purposes of this subsection, "net revenue" means the | 7 | | total amount for which tickets have been sold less the sum of | 8 | | the amount paid out in prizes and the actual administrative | 9 | | expenses of the Department solely related to the Ticket For The | 10 | | Cure game. | 11 | | (c) During the time that tickets are sold for the Carolyn | 12 | | Adams Ticket For The Cure game, the Department shall not | 13 | | unreasonably diminish the efforts devoted to marketing any | 14 | | other instant scratch-off lottery game. | 15 | | (d) The Department may adopt any rules necessary to | 16 | | implement and administer the provisions of this Section.

| 1 | | the effective date of this amendatory Act of the 97th General | 2 | | Assembly, the The Board may shall consist of 10 members as | 3 | | follows: 2 members appointed by the President of the Senate; 2 | 4 | | members appointed by the Minority Leader of the Senate; 2 | 5 | | members appointed by the Speaker of the House of | 6 | | Representatives; 2 members appointed by the Minority Leader of | 7 | | the House of Representatives; and 2 members appointed by the | 8 | | Governor with the advice and consent of the Senate, one of whom | 9 | | shall be designated as chair of the Board at the time of | 10 | | appointment. | 11 | | (a-5) Notwithstanding any provision of this Article to the | 12 | | contrary, the term of office of each current Board member ends | 13 | | 30 days after the effective date of this amendatory Act of the | 14 | | 97th General Assembly or when his or her successor is appointed | 15 | | and qualified, whichever occurs sooner. No later than 30 days | 16 | | after the effective date of this amendatory Act of the 97th | 17 | | General Assembly, the Board shall consist of 10 newly appointed | 18 | | members. Four of the Board members shall be members of the | 19 | | General Assembly and appointed as follows: one member appointed | 20 | | by the President of the Senate; one member appointed by the | 21 | | Minority Leader of the Senate; one member appointed by the | 22 | | Speaker of the House of Representatives; and one member | 23 | | appointed by the Minority Leader of the House of | 24 | | Representatives. | 25 | | Six of the Board members shall be appointed by the Director | 26 | | of the Department of Public Health, who shall designate one of |

| 1 | | these appointed members as chair of the Board at the time of | 2 | | his or her appointment. These 6 members appointed by the | 3 | | Director shall reflect the population with regard to ethnic, | 4 | | racial, and geographical composition and shall include the | 5 | | following individuals: one breast cancer survivor; one | 6 | | physician specializing in breast cancer or related medical | 7 | | issues; one breast cancer researcher; one representative from a | 8 | | breast cancer organization; one individual who operates a | 9 | | patient navigation program at a major hospital or health | 10 | | system; and one breast cancer professional that may include, | 11 | | but not be limited to, a genetics counselor, a social worker, a | 12 | | detain, an occupational therapist, or a nurse. | 13 | | A Board member whose term has expired may continue to serve | 14 | | until a successor is appointed. A Board member who is not a | 15 | | member of the General Assembly may serve 2 consecutive 3-year | 16 | | terms and shall not be reappointed for 3 years after the | 17 | | completion of those consecutive terms. | 18 | | If a vacancy occurs in the Board membership, the vacancy | 19 | | shall be filled in the same manner as the initial appointment. | 20 | | (b) Board members shall serve without compensation but may | 21 | | be reimbursed for their reasonable travel expenses incurred in | 22 | | performing their duties from funds available for that purpose. | 23 | | The Department shall provide staff and administrative support | 24 | | services to the Board. | 25 | | (c) The Board may advise must : | 26 | | (i) consult with the Department of Revenue in designing |

| 1 | | and promoting the Carolyn Adams Ticket For The Cure special | 2 | | instant scratch-off lottery game; and | 3 | | (ii) the Department in reviewing review grant | 4 | | applications ; and | 5 | | (iii) the Director on the final award of grants , make | 6 | | recommendations and comments, and consult with the | 7 | | Department of Public Health in making grants, from amounts | 8 | | appropriated from the Carolyn Adams Ticket For The Cure | 9 | | Grant Fund, to public or private entities in Illinois that | 10 | | reflect the population with regard to ethnic, racial, and | 11 | | geographical composition for the purpose of funding breast | 12 | | cancer research concerning breast cancer and supportive | 13 | | for funding services for breast cancer survivors and those | 14 | | impacted by breast cancer and breast cancer education. In | 15 | | awarding grants, the Department shall consider criteria | 16 | | that includes, but is not limited to, projects and | 17 | | initiatives that address disparities in incidence and | 18 | | mortality rates of breast cancer, based on data from the | 19 | | Illinois Cancer Registry, and populations facing barriers | 20 | | to care victims in accordance with Section 21.5 of the | 21 | | Illinois Lottery Law. | 22 | | (c-5) The Department shall submit a report to the Governor | 23 | | and the General Assembly by December 31 of each year. The | 24 | | report shall provide a summary of the Carolyn Adams Ticket for | 25 | | the Cure lottery ticket sales, grants awarded, and the | 26 | | accomplishments of the grantees. |
