| 1 | | AN ACT concerning transportation.
| 2 | | Be it enacted by the People of the State of Illinois, | 3 | | represented in the General Assembly:
| 4 | | Section 5. The Recreational Trails of Illinois Act is | 5 | | amended by changing Section 10 and by adding Section 36.7 as | 6 | | follows:

| 8 | | Sec. 10. Definitions. As used in this Act:
| 9 | | "Department" means the Department of Natural Resources.
| 10 | | "Director" means the Director of Natural Resources.
| 11 | | "Facilities" means equipment or other man-made improvement | 12 | | that is directly associated with, and provided for, a | 13 | | recreational trail. Typical recreational trail facilities | 14 | | include signage, gates, culverts, trail bridges, railings, | 15 | | benches, security cameras, security lighting, aggregate and | 16 | | other erosion control measures, picnic shelters, informational | 17 | | kiosks, and vault toilets.
| 18 | | "Large non-highway vehicle" means any motorized | 19 | | off-highway device designed to travel primarily off-highway, | 20 | | greater than 64 inches and not more than 75 inches in width, | 21 | | having a manufacturer's dry weight of 3,500 pounds or less, | 22 | | traveling on 4 or more non-highway tires, designed with a | 23 | | non-straddle seat and a steering wheel for steering control, |

| 1 | | except equipment such as lawnmowers. | 2 | | "Off-highway vehicle" means a motor-driven recreational | 3 | | vehicle capable of
cross-country travel on natural terrain | 4 | | without benefit of a road or
trail, including an all-terrain | 5 | | vehicle and off-highway motorcycle as defined
in
the Illinois | 6 | | Vehicle Code. "Off-highway vehicle" does not include a | 7 | | snowmobile;
a motorcycle; a watercraft; snow-grooming | 8 | | equipment when used for its
intended purpose; or an aircraft ; | 9 | | or a large non-highway vehicle .
| 10 | | "Recreational trail" means a thoroughfare or track across | 11 | | land or snow or along water, used for recreational purposes | 12 | | such as bicycling, cross-country skiing, day
hiking, | 13 | | equestrian activities, jogging or similar fitness activities, | 14 | | trail
biking, overnight and long-distance backpacking, | 15 | | snowmobiling, aquatic or
water activity, and vehicular travel | 16 | | by motorcycle or
off-highway vehicles.

A large non-highway | 20 | | vehicle may not be granted an off-highway vehicle trails | 21 | | public access sticker under Section 25.5 or be operated on | 22 | | lands or waters under that Section. | 23 | | Section 10. The Illinois Vehicle Code is amended by | 24 | | changing Section 1-168.8 as follows: |

| 2 | | Sec. 1-168.8. Recreational off-highway vehicle. Any | 3 | | motorized off-highway device designed to travel primarily | 4 | | off-highway, 64 inches or less in width, having a | 5 | | manufacturer's dry weight of 2,000 pounds or less for | 6 | | gas-powered engines or 3,000 pounds or less for | 7 | | electric-powered engines , traveling on 4 or more non-highway | 8 | | tires, designed with a non-straddle seat and a steering wheel | 9 | | for steering control, except equipment such as lawnmowers.
