1 AN ACT concerning the Department of Human Services.
2 Be it enacted by the People of the State of Illinois,
3 represented in the General Assembly:
4 Section 5. The Department of Human Services Act is
5 amended by adding Section 10-26 as follows:
6 (20 ILCS 1305/10-26 new)
7 Sec. 10-26. Disability database.
8 (a) The Department of Human Services shall compile and
9 maintain a cross-disability database of Illinois residents
10 with a disability who are potentially in need of disability
11 services funded by the Department. The database shall consist
12 of individuals with mental illness, physical disabilities,
13 and developmental disabilities, and shall include, but not be
14 limited to, individuals transitioning from special education
15 to adulthood, individuals in State-operated facilities,
16 individuals in private nursing and residential facilities,
17 and individuals in community integrated living arrangements.
18 Within 30 days after the effective date of this amendatory
19 Act of the 93rd General Assembly, the Secretary of Human
20 Services shall seek input from advisory bodies to the
21 Department, including advisory councils and committees
22 working with the Department in the areas of mental illness,
23 physical disabilities, and developmental disabilities. The
24 database shall be operational by July 1, 2004. The
25 information collected and maintained for the disability
26 database shall include, but is not limited to, the following:
27 (i) the types of services of which the individual is
28 potentially in need; (ii) demographic and identifying
29 information about the individual; (iii) factors indicating
30 need, including diagnoses, assessment information, age of
31 primary caregivers, and current living situation; (iv) if

1 applicable, the date information about the individual is
2 submitted for inclusion in the database and the types of
3 services sought by the individual; and (v) the representative
4 district in which the individual resides. In collecting and
5 maintaining information under this Section, the Department
6 shall give consideration to cost-effective appropriate
7 services for individuals.
8 (b) This amendatory Act of the 93rd General Assembly
9 does not create any new entitlement to a service, program, or
10 benefit, but shall not affect any entitlement to a service,
11 program, or benefit created by any other law. Except for a
12 service, program, or benefit that is an entitlement, a
13 service, program, or benefit provided as a result of the
14 collection and maintenance of the disability database shall
15 be subject to appropriations made by the General Assembly.
16 (c) The Department, consistent with applicable federal
17 and State law, shall make general information from the
18 disability database available to the public such as: (i) the
19 number of individuals potentially in need of each type of
20 service, program, or benefit and (ii) the general
21 characteristics of those individuals. The Department shall
22 protect the confidentiality of each individual in the
23 database when releasing database information by not
24 disclosing any personally identifying information.
25 Section 99. Effective Date. This Act takes effect upon
26 becoming law.
