AMENDMENT TO SENATE BILL 2075

2    AMENDMENT NO. ______. Amend Senate Bill 2075 by replacing
3everything after the enacting clause with the following:
 
4    "Section 5. The Illinois Administrative Procedure Act is
5amended by adding Section 5-45.65 as follows:
 
6    (5 ILCS 100/5-45.65 new)
7    Sec. 5-45.65. Emergency rulemaking; Department of
8Transportation. To provide for the expeditious and timely
9implementation of this amendatory Act of the 104th General
10Assembly, emergency rules implementing this amendatory Act of
11the 104th General Assembly may be adopted in accordance with
12Section 5-45 by the Department of Transportation. The adoption
13of emergency rules authorized by Section 5-45 and this Section
14is deemed to be necessary for the public interest, safety, and
15welfare.
16    This Section is repealed one year after the effective date

1of this amendatory Act of the 104th General Assembly.
 
2    Section 10. The Cycle Rider Safety Training Act is amended
3by changing Sections 2.01, 2.03, 4, and 7 and by adding
4Sections 2.03a and 8 as follows:
 
5    (625 ILCS 35/2.01)  (from Ch. 95 1/2, par. 802.01)
6    Sec. 2.01. "Cycle" means a motorcycle, motor driven cycle
7or moped, as defined in The Illinois Vehicle Code.

10    Sec. 2.03. "Cycle Rider Safety Training Courses" and
11"Courses" mean courses of instruction in the use and operation
12of cycles, including instruction in the safe on-road operation
13of cycles, the rules of the road and the laws of this State
14relating to motor vehicles, which courses meet the minimum
15requirements of this Act, the standards established in the
16model national administrative standards for state motorcycle
17rider training programs by the National Highway Traffic Safety
18Administration, and the rules and regulations issued hereunder
19by the Department and which have been approved or denied
20within 60 days by the Department as meeting such requirements.

1    Sec. 2.03a. Cycle Rider Safety Training Course Provider.
2"Cycle Rider Safety Training Course Provider" and "provider"
3means a community college, State university, State or local
4government agency, or for-profit or nonprofit business entity
5in good standing and operating in the State that is capable of
6providing courses meeting the definition in this Act in
7accordance with the rules set forth by the Department and the
8regulations of this Act. "Cycle Rider Safety Training Course
9Provider" and "provider" does not include any business
10registered as a motorcycle dealer with the Secretary of State
11or any other business that derives income from the selling of
12motorcycles or has motorcycles for sale at its place of
13business on a consignment basis.

15    Sec. 4. Cycle Rider Safety Training Courses.
16    (a) The Department shall, on an as needed basis, put out
17notices to the public seeking Cycle Rider Safety Training
18Course Providers to provide courses in this State. Such
19courses shall be open to all residents of the State who hold a
20currently valid driver's license and who have reached their
2116th birthday before the first day of the course to be held.
22Such courses may be offered throughout the calendar year.
23    Providers may charge a nominal registration fee set by the
24Department, which shall be refunded upon completion of the
25course.

1    Responses from potential providers shall include, at a
2minimum, the location where classes are to be held at, the
3number of students they intend to train, whether they would be
4providing motorcycles or using motorcycles provided by the
5program, and the cost for courses provided on a per student
6basis.
7    Contracts shall be awarded by the Department to providers
8based on training needs and cost effectiveness of each bid or
9proposal as well as the provider's organizational capacity to
10satisfactorily discharge Cycle Rider Safety Training Courses.
11    (b) A provider shall only be paid grant funds under one of
12the following conditions:
13        (1) a course was held, in which case the provider
14    shall be paid per student rate multiplied by the number of
15    students present on the first day of the course;
16        (2) expenses submitted related to the maintenance of
17    program equipment; or
18        (3) submitting other non-personnel expenses as deemed
19    appropriate by the Department.
20    (c) A provider awarded a contract with grant funding under
21this Act shall:
22        (1) submit proof to the Department that each
23    instructor employed by the provider meets the
24    qualifications to teach the curriculum for the courses;
25        (2) have at least one employee on staff certified to
26    do quality assurance or quality control visits where

1    instructors are evaluated per curriculum standards on
2    teaching;
3        (3) perform at least one quality assurance or quality
4    control visit on each instructor employed during the year
5    and submit the results of those visits to the Department;
6        (4) maintain appropriate liability insurance to cover
7    training activities;
8        (5) submit requests for payment in a timely manner;
9    and
10        (6) adhere to additional program rules and regulations
11    as determined by the Department.
12    (d) A provider awarded a contract with grant funding under
13this Act shall not adopt any policy, requirement, or
14expectation regarding employee's manner of dress outside of
15the employee's scheduled work hours, nor may the provider pose
16any questions regarding such on job applications or during
17interviews with potential employees.
18Any State or community college, State university or community
19agency designated by the Department may organize a Regional
20Cycle Rider Safety Training Center and may offer cycle rider
21safety training courses through such Training Centers which it
22operates. The curriculum and accreditation for the courses,
23and the geographic areas in which each Training Center may
24offer the courses, shall be provided for by rules and
25regulations of the Department. Instructors of such courses
26shall meet the qualification and certification requirements of

1the regulations of the Department and the college, university
2or community agency offering the program and may be employed
3on a calendar year rather than a school year basis. Such
4courses shall be open to all residents of the State who hold a
5currently valid driver's license and who have reached their
616th birthday without regard to whether such person is
7enrolled in any other course offered by said State or
8community college, State university or community agency. Such
9courses may be offered throughout the calendar year. The
10courses may be offered as credit or noncredit courses, but no
11fee shall be charged except for a nominal registration fee
12which shall be refunded upon completion of the course.

15    Sec. 7. The Department is authorized to and shall award
16contracts out of appropriations to the Department from "The
17Cycle Rider Safety Training Fund" to qualifying providers
18Regional Cycle Rider Safety Training Centers for the conduct
19of approved Cycle Rider Safety Training courses.

22    Sec. 8. Emergency rulemaking. The Department may implement
23the changes made by this amendatory Act of the 104th General
24Assembly through the use of emergency rules in accordance with

1Section 5-45 of the Illinois Administrative Procedure Act. For
2purposes of the Illinois Administrative Procedure Act, the
3adoption of rules to implement the changes made by this
4amendatory Act of the 104th General Assembly shall be deemed
5an emergency and necessary for the public interest, safety,
6and welfare.
 
7    Section 99. Effective date. This Act takes effect January
81, 2026.".
