AMENDMENT TO SENATE BILL 3323

2    AMENDMENT NO. ______. Amend Senate Bill 3323 on page 10,
3by inserting immediately below line 12 the following:
 
4    "Section 51. Enforcement. The Attorney General shall have
5the authority to enforce this Act. The Attorney General may
6investigate any complaint or reported violation of this Act
7and, if necessary to ensure compliance, may do any or all of
8the following:
9        (1) Conduct an investigation to determine if a
10    violation of this Act exists. This includes the power to:
11            (A) require an individual or entity to file a
12        statement or report in writing under oath or
13        otherwise, as to all information the Attorney General
14        may consider;
15            (B) examine under oath any person alleged to have
16        participated in or with knowledge of the violations;
17        and

1            (C) issue subpoenas or conduct hearings in aid of
2        any investigation.
3        (2) Bring an action for an injunction to halt
4    construction or alteration of any electric vehicle
5    charging station or to require compliance with this Act by
6    any electric vehicle charging station that has been or is
7    being constructed or altered in violation of this Act.
8        (3) Bring an action for mandamus.
9        (4) Bring an action for penalties as follows: any
10    owner of an electric vehicle charging station in violation
11    of this Act is subject to civil penalties in a sum not to
12    exceed S250 per day, and each day the owner is in violation
13    of this Act constitutes a separate offense.
14        (5) Bring an action for any other appropriate relief,
15    including, but not limited to, in lieu of a civil action,
16    the entry of an assurance of voluntary compliance with the
17    individual or entity deemed to have violated this Act.".
