AMENDMENT TO SENATE BILL 3137

2    AMENDMENT NO. ______. Amend Senate Bill 3137, AS AMENDED,
3by replacing everything after the enacting clause with the
4following:
 
5    "Section 1. This Act may be referred to as Jordan's Law.
 
6    Section 5. The Substance Use Disorder Act is amended by
7adding Section 55-45 as follows:
 
8    (20 ILCS 301/55-45 new)
9    Sec. 55-45. Notice of death of patient. Any licensed
10facility operating in this State shall provide notice of the
11death of a patient occurring in the facility to the personal
12representative of the patient. The facility shall provide
13verbal notice to the personal representative of the patient
14within 24 hours after the death of the patient and shall
15provide written notice to the personal representative, if

1known, of the patient within 5 days after the death of the
2patient. The facility shall provide notice under this
3subsection in accordance with 42 CFR 2.15(b) and 45 CFR
4164.502(g), as amended. For the purposes of this subsection,
5"personal representative" has the meaning set forth in 45 CFR
6164.502(g).
 
7    Section 10. The Mental Health and Developmental
8Disabilities Code is amended by adding Section 5-100.1 as
9follows:
 
10    (405 ILCS 5/5-100.1 new)
11    Sec. 5-100.1. Notice of death of patient. Any mental
12health or developmental disabilities facility operating in
13this State shall provide notice of the death of a recipient of
14services occurring in the facility to the personal
15representative of the recipient of services. The facility
16shall provide verbal notice to the personal representative, if
17known, of the recipient of services within 24 hours after the
18death of the recipient of services and shall provide written
19notice to the personal representative of the recipient of
20services within 5 days after the death of the recipient of
21services. The facility shall provide notice under this
22subsection in accordance with Sections 4 and 5 of the Mental
23Health and Developmental Disabilities Confidentiality Act and
2445 CFR 164.502(g), as amended. For the purposes of this

1subsection, "personal representative" has the meaning set
2forth in 45 CFR 164.502(g).
 
3    Section 99. Effective date. This Act takes effect upon
4becoming law.".
