SYNOPSIS AS INTRODUCED:

    Amends the Historic Preservation Act. Creates the State Historic Preservation Board. Provides for appointment of members of the Board and the powers and duties of the Board. Provides that the Board may: (1) adopt rules in accordance with the Illinois Administrative Procedure Act, for the administration and execution of the powers granted under the Act after consultation with and written approval by the Department of Natural Resources; (2) list, delist, create specific list designations, create designation definitions, create property assessment criteria, or change the listing designation of State Historic Sites; and (3) advise the Department of Natural Resources on methods of assistance, protection, conservation, and management of State Historic Sites, which are all subject to Department approval and available appropriations to implement those recommendations. Provides that the listing, delisting, creation of specific list designations or designation definitions, or change of listing designation by the Board shall be done only with the written approval of the Director of Natural Resources. Deletes the statutory listing of specific State Historic Sites, State Memorials, and Miscellaneous Properties. Provides that State Historic Sites shall be designated by administrative rule. Provides that the Department shall submit an annual report, on or before June 30, to the General Assembly containing a full list of the State Historic Sites and the site designations, as recommended by the Board and which received the approval of the Department. Defines "State Historic Site" as a property that has been deemed by the Board and the Department to have a State, national, or international level of historic significance. Makes conforming changes. Amends the Illinois Historic Sites Advisory Council Act. Changes the short title of the Act to the Illinois National Register Advisory Council Act. Repeals the Historical Sites Listing Act. Effective immediately.

1    AN ACT concerning State government.
 
2    Be it enacted by the People of the State of Illinois,
3represented in the General Assembly:
 
4    Section 5. The Historic Preservation Act is amended by
5changing Sections 2, 4.5, 6, 8, 16, and 35 and by adding
6Sections 4.7 and 21 as follows:

8    Sec. 2. For the purposes of this Act:
9    (a) (Blank);
10    (b) "Board" means the State Historic Preservation Board
11(Blank);
12    (b-5) "Department" means the Department of Natural
13Resources.
14    (c) "Director" means the Director of Natural Resources;
15    (d) (Blank);
16    (e) (Blank);
17    (f) (Blank); and
18    (g) "Historic Sites and Preservation Division" means the
19Division of Historic Preservation within the Department of
20Natural Resources; and .
21    (h) "State Historic Site" means a property that has been
22deemed by the Board and the Department to have a State,
23national, or international level of historic significance.

3    Sec. 4.5. Division of Historic Preservation. On and after
4August 3, 2018 (the effective date of Public Act 100-695), the
5Division of Historic Preservation of the Department of Natural
6Resources Office of Land Management shall be created. The head
7of the Division shall be known as the Division Manager of
8Historic Preservation. The Department of Natural Resources may
9employ or retain other persons to assist in the discharge of
10its functions, subject to the Personnel Code and any other
11applicable Department policies.

14    Sec. 4.7. State Historic Preservation Board.
15    (a) The State Historic Preservation Board is created,
16hereinafter referred to as the Board.
17    (b) The Board shall consist of 9 members appointed by the
18Governor. The Director of the Department, or the Director's
19designee, shall serve as a non-voting member of the Board. Of
20those members appointed by the Governor:
21        (1) two members shall have relevant backgrounds in
22    public history or have a background in either teaching or
23    researching the history of Illinois or historically
24    marginalized communities;

1        (2) one member shall have experience in library
2    studies or archival work in Illinois;
3        (3) three members shall be representatives of a
4    community-based organization working on historic
5    preservation in Illinois;
6        (4) one member shall be a representative with
7    experience in the Americans with Disabilities Act of 1990;
8        (5) one member shall be a representative with
9    experience working on federal historic designations; and
10        (6) one member shall be a museum professional.
11    The chairperson of the Board shall be named from the
12voting members of the Board by the Governor. The terms of the
13membership of the Board shall be for 3 years. Board members
14shall serve until a replacement is named by the Governor.
15Members may be removed from the Board for just cause,
16including, but not limited to, incompetence, dereliction of
17duty, malfeasance, or misfeasance. Of those members appointed
18by the Governor, at least 50% of the members shall consist of
19individuals who represent historically excluded and
20marginalized people. The Governor's office, with the
21assistance of the Department of Natural Resources, shall be
22responsible for ensuring that 50% of the appointed members of
23the Board consist of people who represent historically
24excluded and marginalized people. Knowledge in the following
25areas shall be prioritized in making an appointment under this
26item: the culture, traditions, and history of American Indians

1and Native Americans; Black Americans; Latinos, Latinas, and
2Hispanic Americans; Asian Americans and Pacific Islanders; the
3LGBTQAI+ community; immigrants and refugees; people with
4disabilities; veterans' organizations; women's history; the
5history of Illinois' agriculture, architecture, armed forces,
6arts, civics, cultural geography, ecology, education,
7faith-based communities, folklore, government, industry,
8labor, law, medicine, and transportation; anthropology;
9archeology; cultural exhibits and museums; heritage tourism;
10historic preservation; and social justice.
11    (c) Board meetings shall be called at regular intervals
12set by the Board, on the request of the Department, or upon
13written notice signed by at least 5 members of the Board, but
14in no event less than once quarterly.
15    (d) A majority of the members of the Board constitute a
16quorum for the transaction of business at a meeting of the
17Board. A majority of the members present and serving is
18required for official action of the Board.
19    (e) All business that the Board is authorized to perform
20shall be conducted at a public meeting of the Board, held in
21compliance with the Open Meetings Act.
22    (f) A writing prepared, owned, used, in the possession of,
23or retained by the Board in the performance of an official
24function is subject to the Freedom of Information Act.
25    (g) The members of the Board shall serve without
26compensation but shall be entitled to reimbursement for all

1necessary expenses incurred in the performance of their
2official duties as members of the Board from funds
3appropriated for that purpose. Reimbursement for travel,
4meals, and lodging shall be in accordance with the rules of the
5Governor's Travel Control Board.
6    (h) The Board has the powers and duties enumerated in this
7subsection (h):
8        (1) To adopt rules in accordance with the Illinois
9    Administrative Procedure Act, for the administration and
10    execution of the powers granted under this Act. All such
11    rules that are authorized to be created under this Act
12    shall be adopted after consultation with and written
13    approval by the Department.
14        (2) To list, delist, create specific list
15    designations, create designation definitions, create
16    property assessment criteria, or change the listing
17    designation of State Historic Sites. Such actions shall be
18    undertaken by administrative rule. The listing, delisting,
19    creation of specific list designations or designation
20    definitions, or change of listing designation by the Board
21    shall only be done with the written approval of the
22    Director of Natural Resources. When listing, delisting, or
23    making a change of listing designation, the Board shall
24    consider, but is not limited to, the following:
25            (A) the budgetary impact on the full historic
26        sites portfolio when taking such action;

1            (B) if the action includes the stories of
2        historically excluded and marginalized people;
3            (C) the geographic balance of the portfolio;
4            (D) disability access;
5            (E) and opportunities to coordinate with federal
6        historic designations or federal funding
7        opportunities; and
8            (F) any other criteria that have been set out in
9        administrative rule; and
10        (3) to advise the Department on methods of assistance,
11    protection, conservation, and management of State Historic
12    Sites, which are all subject to Department approval and
13    available appropriations to implement those
14    recommendations.

16    Sec. 6. Jurisdiction. The Department shall have
17jurisdiction over the following described areas which are
18hereby designated by administrative rule as State Historic
19Sites, State Memorials, and Miscellaneous Properties. Those
20These sites have been deemed by the Board and the Department to
21have a continuing State, national, or international level of
22historic historical significance and the stewardship and
23caretaking responsibilities to protect and promote are hereby
24bestowed upon the Department. The Board is authorized to
25modify, remove, or add to the list of State Historic Sites that

1are listed in administrative rule in compliance with this Act.
2The following sites shall comprise the initial list of State
3Historic Sites that the Board shall initially list in
4administrative rule, but shall be subject to modification,
5removal, or additions by the Board and the Department pursuant
6to this Act:

8    Albany Mounds State Historic Site, Whiteside County;
9    Apple River Fort State Historic Site, Jo Daviess County;
10    Bishop Hill State Historic Site, Henry County;
11    Black Hawk State Historic Site, Rock Island County;
12    Bryant Cottage State Historic Site, Piatt County;
13    Cahokia Courthouse State Historic Site, St. Clair County;
14    Cahokia Mounds State Historic Site, in Madison and St.
15        Clair Counties (however, the Illinois State Museum
16        shall act as curator of artifacts pursuant to the

3    Sec. 8. Business plans. The Department shall create an
4individual business plan for each historic site related to
5Abraham Lincoln that is listed in administrative rule Section
66 of this Act. Each business plan must address ways to enhance
7tourism at the historic site and the historic aspect of each
8site. The Department may seek assistance from the Department
9of Commerce and Economic Opportunity when creating the
10business plans. The Department shall complete the business
11plans no later than January 1, 2008.

14    Sec. 16. The Department shall have the following
15additional powers:
16        (a) To hire agents and employees necessary to carry
17    out the duties and purposes of this Act.
18        (b) To take all measures necessary to erect, maintain,
19    preserve, restore, and conserve all State Historic Sites
20    and State Memorials, except when supervision and
21    maintenance is otherwise provided by law. This
22    authorization includes the power to enter into contracts,
23    acquire and dispose of real and personal property, and
24    enter into leases of real and personal property. The

1    Department has the power to acquire, for purposes
2    authorized by law, any real property in fee simple subject
3    to a life estate in the seller in not more than 3 acres of
4    the real property acquired, subject to the restrictions
5    that the life estate shall be used for residential
6    purposes only and that it shall be non-transferable.
7        (c) To provide recreational facilities, including
8    campsites, lodges and cabins, trails, picnic areas, and
9    related recreational facilities, at all sites under the
10    jurisdiction of the Department.
11        (d) To lay out, construct, and maintain all needful
12    roads, parking areas, paths or trails, bridges, camp or
13    lodge sites, picnic areas, lodges and cabins, and any
14    other structures and improvements necessary and
15    appropriate in any State historic site or easement
16    thereto; and to provide water supplies, heat and light,
17    and sanitary facilities for the public and living quarters
18    for the custodians and keepers of State historic sites.
19        (e) To grant licenses and rights-of-way within the
20    areas controlled by the Department for the construction,
21    operation, and maintenance upon, under or across the
22    property, of facilities for water, sewage, telephone,
23    telegraph, electric, gas, or other public service, subject
24    to the terms and conditions as may be determined by the
25    Department.
26        (f) To authorize the officers, employees, and agents

1    of the Department, for the purposes of investigation and
2    to exercise the rights, powers, and duties vested and that
3    may be vested in it, to enter and cross all lands and
4    waters in this State, doing no damage to private property.
5        (g) To transfer jurisdiction of or exchange any realty
6    under the control of the Department to any other
7    Department of the State Government, or to any agency of
8    the Federal Government, or to acquire or accept Federal
9    lands, when any transfer, exchange, acquisition, or
10    acceptance is advantageous to the State and is approved in
11    writing by the Governor.
12        (h) To erect, supervise, and maintain all public
13    monuments and memorials erected by the State, except when
14    the supervision and maintenance of public monuments and
15    memorials is otherwise provided by law.
16        (i) To accept, hold, maintain, and administer, as
17    trustee, property given in trust for educational or
18    historic purposes for the benefit of the People of the
19    State of Illinois and to dispose of any property under the
20    terms of the instrument creating the trust.
21        (j) To lease concessions on any property under the
22    jurisdiction of the Department for a period not exceeding
23    25 years and to lease a concession complex at Lincoln's
24    New Salem State Historic Site for which a cash incentive
25    has been authorized under Section 5.1 of this Act for a
26    period not to exceed 40 years. All leases, for whatever

1    period, shall be made subject to the written approval of
2    the Governor. All concession leases extending for a period
3    in excess of 10 years, will contain provisions for the
4    Department to participate, on a percentage basis, in the
5    revenues generated by any concession operation.
6        The Department is authorized to allow for provisions
7    for a reserve account and a leasehold account within
8    Department concession lease agreements for the purpose of
9    setting aside revenues for the maintenance,
10    rehabilitation, repair, improvement, and replacement of
11    the concession facility, structure, and equipment of the
12    Department that are part of the leased premises.
13        The lessee shall be required to pay into the reserve
14    account a percentage of gross receipts, as set forth in
15    the lease, to be set aside and expended in a manner
16    acceptable to the Department by the concession lessee for
17    the purpose of ensuring that an appropriate amount of the
18    lessee's moneys are provided by the lessee to satisfy the
19    lessee's incurred responsibilities for the operation of
20    the concession facility under the terms and conditions of
21    the concession lease.
22        The lessee account shall allow for the amortization of
23    certain authorized expenses that are incurred by the
24    concession lessee but that are not an obligation of the
25    lessee under the terms and conditions of the lease
26    agreement. The Department may allow a reduction of up to

1    50% of the monthly rent due for the purpose of enabling the
2    recoupment of the lessee's authorized expenditures during
3    the term of the lease.
4        (k) To sell surplus agricultural products grown on
5    land owned by or under the jurisdiction of the Department,
6    when the products cannot be used by the Department.
7        (l) To enforce the laws of the State and the rules and
8    regulations of the Department in or on any lands owned,
9    leased, or managed by the Department.
10        (m) To cooperate with private organizations and
11    agencies of the State of Illinois by providing areas and
12    the use of staff personnel where feasible for the sale of
13    publications on the historic and cultural heritage of the
14    State and craft items made by Illinois craftsmen. These
15    sales shall not conflict with existing concession
16    agreements. The Department is authorized to negotiate with
17    the organizations and agencies for a portion of the monies
18    received from sales to be returned to the Department's
19    Historic Sites Fund for the furtherance of interpretive
20    and restoration programs.
21        (n) To establish local bank or savings and loan
22    association accounts, upon the written authorization of
23    the Director, to temporarily hold income received at any
24    of its properties. The local accounts established under
25    this Section shall be in the name of the Department and
26    shall be subject to regular audits. The balance in a local

1    bank or savings and loan association account shall be
2    forwarded to the Department for deposit with the State
3    Treasurer on Monday of each week if the amount to be
4    deposited in a fund exceeds $500.
5        No bank or savings and loan association shall receive
6    public funds as permitted by this Section, unless it has
7    complied with the requirements established under Section 6
8    of the Public Funds Investment Act.
9        (o) To accept offers of gifts, gratuities, or grants
10    from the federal government, its agencies, or offices, or
11    from any person, firm, or corporation.
12        (p) To make reasonable rules and regulations as may be
13    necessary to discharge the duties of the Department.
14        (q) With appropriate cultural organizations, to
15    further and advance the goals of the Department.
16        (r) To make grants for the purposes of planning,
17    survey, rehabilitation, restoration, reconstruction,
18    landscaping, and acquisition of Illinois properties (i)
19    designated individually in the National Register of
20    Historic Places, (ii) designated as a landmark under a
21    county or municipal landmark ordinance, or (iii) located
22    within a National Register of Historic Places historic
23    district or a locally designated historic district when
24    the Director determines that the property is of historic
25    significance whenever an appropriation is made therefor by
26    the General Assembly or whenever gifts or grants are

1    received for that purpose and to promulgate regulations as
2    may be necessary or desirable to carry out the purposes of
3    the grants.
4        Grantees may, as prescribed by rule, be required to
5    provide matching funds for each grant. Grants made under
6    this subsection shall be known as Illinois Heritage
7    Grants.
8        Every owner of a historic property, or the owner's
9    agent, is eligible to apply for a grant under this
10    subsection.
11        (s) To establish and implement a pilot program for
12    charging admission to State historic sites. Fees may be
13    charged for special events, admissions, and parking or any
14    combination; fees may be charged at all sites or selected
15    sites. All fees shall be deposited into the Illinois
16    Historic Sites Fund. The Department shall have the
17    discretion to set and adjust reasonable fees at the
18    various sites, taking into consideration various factors,
19    including, but not limited to: cost of services furnished
20    to each visitor, impact of fees on attendance and tourism,
21    and the costs expended collecting the fees. The Department
22    shall keep careful records of the income and expenses
23    resulting from the imposition of fees, shall keep records
24    as to the attendance at each historic site, and shall
25    report to the Governor and General Assembly by January 31
26    after the close of each year. The report shall include

1    information on costs, expenses, attendance, comments by
2    visitors, and any other information the Department may
3    believe pertinent, including:
4            (1) Recommendations as to whether fees should be
5        continued at each State historic site.
6            (2) How the fees should be structured and imposed.
7            (3) Estimates of revenues and expenses associated
8        with each site.
9        (t) To provide for overnight tent and trailer
10    campsites and to provide suitable housing facilities for
11    student and juvenile overnight camping groups. The
12    Department shall charge rates similar to those charged by
13    the Department for the same or similar facilities and
14    services.
15        (u) To engage in marketing activities designed to
16    promote the sites and programs administered by the
17    Department. In undertaking these activities, the
18    Department may take all necessary steps with respect to
19    products and services, including, but not limited to,
20    retail sales, wholesale sales, direct marketing, mail
21    order sales, telephone sales, advertising and promotion,
22    purchase of product and materials inventory, design,
23    printing and manufacturing of new products, reproductions,
24    and adaptations, copyright and trademark licensing and
25    royalty agreements, and payment of applicable taxes. In
26    addition, the Department shall have the authority to sell

1    advertising in its publications and printed materials. All
2    income from marketing activities shall be deposited into
3    the Illinois Historic Sites Fund.
4        (v) To cooperate with the Board in matters relating to
5    the purpose of this Act, and, at the Department's
6    discretion, to provide the Board, upon its request,
7    services, supplies, funds, facilities and other
8    assistance.
9        (w) To review and approve in writing rules adopted by
10    the Board.

13    Sec. 21. Annual report. Starting in 2025, the Department
14shall submit an annual report, on or before June 30, to the
15General Assembly containing a full list of the State Historic
16Sites and the sites designations, as recommended by the Board
17and which received the approval of the Department.
 
18    (20 ILCS 3405/35)
19    Sec. 35. Products manufactured in the United States. State
20Historic Sites, State Memorials, and other properties that are
21under the jurisdiction of the Department under Section 6 of
22this Act shall set aside a booth or section for the sale of
23products manufactured in the United States. As used in this
24Section, "products manufactured in the United States" means

1assembled articles, materials, or supplies for which design,
2final assembly, processing, packaging, testing, or other
3process that adds value, quality, or reliability occurred in
4the United States.

6    Section 10. The Illinois Historic Sites Advisory Council
7Act is amended by changing Sections 1, 2, and 3 as follows:

10Register Historic Sites Advisory Council Act.

13    Sec. 2. As used in this Act:
14    (a) "Council" means the Illinois National Register
15Historic Sites Advisory Council.

18    (c-5) "Department" means the Department of Natural
19Resources.
20    (d) "Director" means the Director of Natural Resources, or
21his or her designee.
22    (d-1) "Historic resource" means any property which is
23either publicly or privately held and which:

1        (1) is listed in the National Register of Historic
2    Places (hereafter "National Register");
3        (2) has been formally determined by the Director to be
4    eligible for listing in the National Register as defined
5    in Section 106 of Title 16 of the United States Code;
6        (3) has been nominated by the Director and the
7    Illinois National Register Historic Sites Advisory Council
8    for listing in the National Register; or
9        (4) meets one or more criteria for listing in the
10    National Register, as determined by the Director.
11    (e) "Place" means (1) any parcel or contiguous grouping of
12parcels of real estate under common or related ownership or
13control, where any significant improvements are at least 40
14years old, or (2) any aboriginal mound, fort, earthwork,
15village, location, burial ground, historic or prehistoric
16ruin, mine case or other location which is or may be the source
17of important archeological data.

24    Sec. 3. There is recognized and established hereunder the
25Illinois National Register Historic Sites Advisory Council,

1previously established pursuant to Federal regulations,
2hereafter called the Council. The Council shall consist of 15
3members. Of these, there shall be at least 3 historians, at
4least 3 architectural historians, or architects with a
5preservation background, and at least 3 archeologists. The
6remaining 6 members shall be drawn from supporting fields and
7have a preservation interest. Supporting fields shall include
8but not be limited to historical geography, law, urban
9planning, local government officials, and members of other
10preservation commissions. All shall be appointed by the
11Director.
12    The Council Chairperson shall be appointed by the Director
13from the Council membership and shall serve at the Director's
14pleasure.
15    The Executive Director of the Abraham Lincoln Presidential
16Library and Museum and the Director of the Illinois State
17Museum shall serve on the Council in advisory capacity as
18non-voting members.
19    Terms of membership shall be 3 years and shall be
20staggered by the Director to assure continuity of
21representation.
22    The Council shall meet at least 3 times each year.
23Additional meetings may be held at the call of the chairperson
24or at the call of the Director.
25    Members shall serve without compensation, but shall be
26reimbursed for actual expenses incurred in the performance of
