Identification card. | 9 | | (a) The Secretary of State shall issue a standard Illinois | 10 | | Identification Card to any natural person who is a resident of | 11 | | the State of Illinois who applies for such card, or renewal | 12 | | thereof. No identification card shall be issued to any person | 13 | | who holds a valid foreign state identification card, license, | 14 | | or permit unless the person first surrenders to the Secretary | 15 | | of State the valid foreign state identification card, license, | 16 | | or permit. The card shall be prepared and supplied by the |

However, the Secretary of | 3 | | State may provide by rule for the issuance of Illinois | 4 | | Identification Cards without photographs if the applicant has | 5 | | a bona fide religious objection to being photographed or to | 6 | | the display of his or her photograph. The Illinois | 7 | | Identification Card may be used for identification purposes in | 8 | | any lawful situation only by the person to whom it was issued. | 9 | | As used in this Act, "photograph" means any color photograph | 10 | | or digitally produced and captured image of an applicant for | 11 | | an identification card. As used in this Act, "signature" means | 12 | | the name of a person as written by that person and captured in | 13 | | a manner acceptable to the Secretary of State. | 14 | | (a-5) If an applicant for an identification card has a | 15 | | current driver's license or instruction permit issued by the | 16 | | Secretary of State, the Secretary may require the applicant to | 17 | | utilize the same residence address and name on the | 18 | | identification card, driver's license, and instruction permit | 19 | | records maintained by the Secretary. The Secretary may | 20 | | promulgate rules to implement this provision. | 21 | | (a-10) If the applicant is a judicial officer as defined | 22 | | in Section 1-10 of the Judicial Privacy Act or a peace officer, | 23 | | the applicant may elect to have his or her office or work | 24 | | address listed on the card instead of the applicant's | 25 | | residence or mailing address. The Secretary may promulgate | 26 | | rules to implement this provision. For the purposes of this |

| 1 | | subsection (a-10), "peace officer" means any person who by | 2 | | virtue of his or her office or public employment is vested by | 3 | | law with a duty to maintain public order or to make arrests for | 4 | | a violation of any penal statute of this State, whether that | 5 | | duty extends to all violations or is limited to specific | 6 | | violations. | 7 | | (a-15) The Secretary of State may provide for an expedited | 8 | | process for the issuance of an Illinois Identification Card. | 9 | | The Secretary shall charge an additional fee for the expedited | 10 | | issuance of an Illinois Identification Card, to be set by | 11 | | rule, not to exceed $75. If the Secretary of State determines that the volume of | 17 | | expedited identification card requests received on a given day | 18 | | exceeds the ability of the Secretary to process those requests | 19 | | in an expedited manner, the Secretary may decline to provide | 20 | | expedited services, and the additional fee for the expedited | 21 | | service shall be refunded to the applicant. | 22 | | (a-20) The Secretary of State shall issue a standard | 23 | | Illinois Identification Card to a person committed to the | 24 | | Department of Corrections or Department of Juvenile Justice | 25 | | upon receipt of the person's birth certificate, social | 26 | | security card, photograph, proof of residency upon discharge, |

Documents proving residence address shall include | 13 | | any official document of the Department of Human Services | 14 | | showing the person's address after release and a Secretary of | 15 | | State prescribed verification form, which may be executed by | 16 | | personnel of the Department of Human Services. | 17 | | (b) The Secretary of State shall issue a special Illinois | 18 | | Identification Card, which shall be known as an Illinois | 19 | | Person with a Disability Identification Card, to any natural | 20 | | person who is a resident of the State of Illinois, who is a | 21 | | person with a disability as defined in Section 4A of this Act, | 22 | | who applies for such card, or renewal thereof. The card shall be prepared and | 3 | | supplied by the Secretary of State, and shall include a | 4 | | photograph and signature or mark of the applicant, a | 5 | | designation indicating that the card is an Illinois Person | 6 | | with a Disability Identification Card, and shall include a | 7 | | comprehensible designation of the type and classification of | 8 | | the applicant's disability as set out in Section 4A of this | 9 | | Act. However, the Secretary of State may provide by rule for | 10 | | the issuance of Illinois Person with a Disability | 11 | | Identification Cards without photographs if the applicant has | 12 | | a bona fide religious objection to being photographed or to | 13 | | the display of his or her photograph. If the applicant so | 14 | | requests, the card shall include a description of the | 15 | | applicant's disability and any information about the | 16 | | applicant's disability or medical history which the Secretary | 17 | | determines would be helpful to the applicant in securing | 18 | | emergency medical care. If a mark is used in lieu of a | 19 | | signature, such mark shall be affixed to the card in the | 20 | | presence of two witnesses who attest to the authenticity of | 21 | | the mark. The Illinois Person with a Disability Identification | 22 | | Card may be used for identification purposes in any lawful | 23 | | situation by the person to whom it was issued. | 24 | | The Illinois Person with a Disability Identification Card | 25 | | may be used as adequate documentation of disability in lieu of | 26 | | a physician's determination of disability, a determination of |

| 1 | | disability from a physician assistant, a determination of | 2 | | disability from an advanced practice registered nurse, or any | 3 | | other documentation of disability whenever any State law | 4 | | requires that a person with a disability provide such | 5 | | documentation of disability, however an Illinois Person with a | 6 | | Disability Identification Card shall not qualify the | 7 | | cardholder to participate in any program or to receive any | 8 | | benefit which is not available to all persons with like | 9 | | disabilities. Notwithstanding any other provisions of law, an | 10 | | Illinois Person with a Disability Identification Card, or | 11 | | evidence that the Secretary of State has issued an Illinois | 12 | | Person with a Disability Identification Card, shall not be | 13 | | used by any person other than the person named on such card to | 14 | | prove that the person named on such card is a person with a | 15 | | disability or for any other purpose unless the card is used for | 16 | | the benefit of the person named on such card, and the person | 17 | | named on such card consents to such use at the time the card is | 18 | | so used. | 19 | | An optometrist's determination of a visual disability | 20 | | under Section 4A of this Act is acceptable as documentation | 21 | | for the purpose of issuing an Illinois Person with a | 22 | | Disability Identification Card. | 23 | | When medical information is contained on an Illinois | 24 | | Person with a Disability Identification Card, the Office of | 25 | | the Secretary of State shall not be liable for any actions | 26 | | taken based upon that medical information. |

| 1 | | (c) The Secretary of State shall provide that each | 2 | | original or renewal Illinois Identification Card or Illinois | 3 | | Person with a Disability Identification Card issued to a | 4 | | person under the age of 21 shall be of a distinct nature from | 5 | | those Illinois Identification Cards or Illinois Person with a | 6 | | Disability Identification Cards issued to individuals 21 years | 7 | | of age or older. The color designated for Illinois | 8 | | Identification Cards or Illinois Person with a Disability | 9 | | Identification Cards for persons under the age of 21 shall be | 10 | | at the discretion of the Secretary of State. | 11 | | (c-1) Each original or renewal Illinois Identification | 12 | | Card or Illinois Person with a Disability Identification Card | 13 | | issued to a person under the age of 21 shall display the date | 14 | | upon which the person becomes 18 years of age and the date upon | 15 | | which the person becomes 21 years of age. | 16 | | (c-3) The General Assembly recognizes the need to identify | 17 | | military veterans living in this State for the purpose of | 18 | | ensuring that they receive all of the services and benefits to | 19 | | which they are legally entitled, including healthcare, | 20 | | education assistance, and job placement. To assist the State | 21 | | in identifying these veterans and delivering these vital | 22 | | services and benefits, the Secretary of State is authorized to | 23 | | issue Illinois Identification Cards and Illinois Person with a | 24 | | Disability Identification Cards with the word "veteran" | 25 | | appearing on the face of the cards. This authorization is | 26 | | predicated on the unique status of veterans. The Secretary may |

| 1 | | not issue any other identification card which identifies an | 2 | | occupation, status, affiliation, hobby, or other unique | 3 | | characteristics of the identification card holder which is | 4 | | unrelated to the purpose of the identification card. | 5 | | (c-5) Beginning on or before July 1, 2015, the Secretary | 6 | | of State shall designate a space on each original or renewal | 7 | | identification card where, at the request of the applicant, | 8 | | the word "veteran" shall be placed. The veteran designation | 9 | | shall be available to a person identified as a veteran under | 10 | | subsection (b) of Section 5 of this Act who was discharged or | 11 | | separated under honorable conditions. | 12 | | (d) The Secretary of State may issue a Senior Citizen | 13 | | discount card, to any natural person who is a resident of the | 14 | | State of Illinois who is 60 years of age or older and who | 15 | | applies for such a card or renewal thereof. The Secretary of | 16 | | State shall charge no fee to issue such card. The card shall be | 17 | | issued in every county and applications shall be made | 18 | | available at, but not limited to, nutrition sites, senior | 19 | | citizen centers and Area Agencies on Aging. The applicant, | 20 | | upon receipt of such card and prior to its use for any purpose, | 21 | | shall have affixed thereon in the space provided therefor his | 22 | | signature or mark. | 23 | | (e) The Secretary of State, in his or her discretion, may | 24 | | designate on each Illinois Identification Card or Illinois | 25 | | Person with a Disability Identification Card a space where the | 26 | | card holder may place a sticker or decal, issued by the |

| 1 | | Secretary of State, of uniform size as the Secretary may | 2 | | specify, that shall indicate in appropriate language that the | 3 | | card holder has renewed his or her Illinois Identification | 4 | | Card or Illinois Person with a Disability Identification Card. | 5 | | (f) Upon providing required documentation, at the request | 6 | | of the applicant, the identification card may reflect Gold | 7 | | Star Family designation. The Secretary shall designate a space | 8 | | on each original or renewal of an identification card for such | 9 | | designation. Notwithstanding the previous sentence, a | 6 | | city or park district may enter into a lease for an initial | 7 | | term not to exceed 99 years, subject to renewal, allowing a | 8 | | corporation or society as hereinabove described to erect, | 9 | | enlarge, ornament, build, rebuild, rehabilitate, improve, | 10 | | maintain, and operate its aquarium or museum, together with | 11 | | grounds immediately adjacent to such aquarium or museum, and | 12 | | to use, possess, and occupy grounds surrounding such aquarium | 13 | | or museum as hereinabove described for the purpose of | 14 | | beautifying and maintaining such grounds in a manner | 15 | | consistent with the aquarium or museum's purpose, and on the | 16 | | conditions that (1) the public is allowed access to such | 17 | | grounds in a manner consistent with its access to other public | 18 | | parks, and (2) the city or park district retains a | 19 | | reversionary interest in any improvements made by the | 20 | | corporation or society on the grounds, including the aquarium | 21 | | or museum itself, that matures upon the expiration or lawful | 22 | | termination of the lease. It is hereby reaffirmed and found | 23 | | that the aquariums and museums as described in this Section, | 24 | | and their collections, exhibitions, programming, and | 25 | | associated initiatives, serve valuable public purposes, | 26 | | including, but not limited to, furthering human knowledge and |

| 1 | | understanding, educating and inspiring the public, and | 2 | | expanding recreational and cultural resources and | 3 | | opportunities. Any city or park district may charge, or permit | 4 | | such an aquarium or museum to charge, an admission fee. Any | 5 | | such aquarium or museum, however, shall be open without | 6 | | charge, when accompanied by a teacher, to the children in | 7 | | actual attendance upon grades kindergarten through twelve in | 8 | | any of the schools in this State at all times. In addition, | 9 | | except as otherwise provided in this Section, any such | 10 | | aquarium or museum must be open to persons who reside in this | 11 | | State without charge for a period equivalent to 52 days, at | 12 | | least 6 of which must be during the period from June through | 13 | | August, each year. Beginning on the effective date of this | 14 | | amendatory Act of the 101st General Assembly through June 30, | 15 | | 2022, any such aquarium or museum must be open to persons who | 16 | | reside in this State without charge for a period equivalent to | 17 | | 52 days, at least 6 of which must be during the period from | 18 | | June through August, 2021. Any such museum shall be open | 19 | | without charge throughout the year to an Illinois resident who | 20 | | shows a driver's license or Illinois Identification Card | 21 | | containing a designation that the resident is a Gold Star | 22 | | Family member. Notwithstanding said provisions, charges may be | 23 | | made at any time for special services and for admission to | 24 | | special facilities within any aquarium or museum for the | 25 | | education, entertainment, or convenience of visitors. The | 26 | | proceeds of such admission fees and charges for special |

If any owner or owners of any lands or lots | 4 | | abutting or fronting on any such public park, or adjacent | 5 | | thereto, have any private right, easement, interest or | 6 | | property in such public park appurtenant to their lands or | 7 | | lots or otherwise, which would be interfered with by the | 8 | | erection and maintenance of any aquarium or museum as | 9 | | hereinbefore provided, or any right to have such public park | 10 | | remain open or vacant and free from buildings, the corporate | 11 | | authorities of the city or park district having control of | 12 | | such park, may condemn the same in the manner prescribed for | 13 | | the exercise of the right of eminent domain under the Eminent | 14 | | Domain Act. When applying for a Universal special license plate | 8 | | the applicant shall inform the Secretary of the name of the | 9 | | authorized organization from which the applicant will obtain a | 10 | | decal to place on the plate. The Secretary shall make a record | 11 | | of that organization and that organization shall remain | 12 | | affiliated with that plate until the plate is surrendered, | 13 | | revoked, or otherwise cancelled. The authorized organization | 14 | | may charge a fee to offset the cost of producing and | 15 | | distributing the decal, but that fee shall be retained by the | 16 | | authorized organization and shall be separate and distinct | 17 | | from any registration fees charged by the Secretary. No decal, | 18 | | sticker, or other material may be affixed to a Universal | 19 | | special license plate other than a decal authorized by the | 20 | | General Assembly in this Section or a registration renewal | 21 | | sticker. The special plates issued under this Section shall be | 22 | | affixed only to passenger vehicles of the first division, | 23 | | including motorcycles and autocycles, or motor vehicles of the | 24 | | second division weighing not more than 8,000 pounds. Plates | 25 | | issued under this Section shall expire according to the | 26 | | multi-year procedure under Section 3-414.1 of this Code. |

The design shall allow for | 6 | | the application of a decal to the plate. Organizations | 7 | | authorized by the General Assembly to issue decals for | 8 | | Universal special license plates shall comply with rules | 9 | | adopted by the Secretary governing the requirements for and | 10 | | approval of Universal special license plate decals. The | 11 | | Secretary may, in his or her discretion, allow Universal | 12 | | special license plates to be issued as vanity or personalized | 13 | | plates in accordance with Section 3-405.1 of this Code. In the case of an | 15 | | applicant who is a judicial officer or peace officer, the | 16 | | Secretary may allow the applicant to provide an office or work | 17 | | address in lieu of a residence or mailing address. The | 18 | | application form may also require the statement of such | 19 | | additional relevant information as the Secretary of State | 20 | | shall deem necessary to determine the applicant's competency | 21 | | and eligibility. The Secretary of State may, in his | 22 | | discretion, by rule or regulation, provide that an application | 23 | | for a drivers license or permit may include a suitable | 24 | | photograph of the applicant in the form prescribed by the | 25 | | Secretary, and he may further provide that each drivers | 26 | | license shall include a photograph of the driver. | 1 | | Secretary of State may utilize a photograph process or system | 2 | | most suitable to deter alteration or improper reproduction of | 3 | | a drivers license and to prevent substitution of another photo | 4 | | thereon. For the purposes of this subsection (b), "peace | 5 | | officer" means any person who by virtue of his or her office or | 6 | | public employment is vested by law with a duty to maintain | 7 | | public order or to make arrests for a violation of any penal | 8 | | statute of this State, whether that duty extends to all | 9 | | violations or is limited to specific violations. | 10 | | (b-3) Upon the first issuance of a request for proposals | 11 | | for a digital driver's license and identification card | 12 | | issuance and facial recognition system issued after January 1, | 13 | | 2020 (the effective date of Public Act 101-513), and upon | 14 | | implementation of a new or revised system procured pursuant to | 15 | | that request for proposals, the Secretary shall permit | 16 | | applicants to choose between "male", "female" or "non-binary" | 17 | | when designating the applicant's sex on the driver's license | 18 | | application form. The sex designated by the applicant shall be | 19 | | displayed on the driver's license issued to the applicant. | 20 | | (b-5) Every applicant for a REAL ID compliant driver's | 21 | | license or permit shall provide proof of lawful status in the | 22 | | United States as defined in 6 CFR 37.3, as amended. Applicants | 23 | | who are unable to provide the Secretary with proof of lawful | 24 | | status may apply for a driver's license or permit under | 25 | | Section 6-105.1 of this Code. | 26 | | (c) The application form shall include a notice to the |

For purposes of this subsection (c), "sex offender" has | 5 | | the meaning ascribed to it in Section 2 of the Sex Offender | 6 | | Registration Act. | 7 | | (d) Any male United States citizen or immigrant who | 8 | | applies for any permit or license authorized to be issued | 9 | | under this Code or for a renewal of any permit or license, and | 10 | | who is at least 18 years of age but less than 26 years of age, | 11 | | must be registered in compliance with the requirements of the | 12 | | federal Military Selective Service Act. The Secretary of State | 13 | | must forward in an electronic format the necessary personal | 14 | | information regarding the applicants identified in this | 15 | | subsection (d) to the Selective Service System. The | 16 | | applicant's signature on the application serves as an | 17 | | indication that the applicant either has already registered | 18 | | with the Selective Service System or that he is authorizing | 19 | | the Secretary to forward to the Selective Service System the | 20 | | necessary information for registration. The Secretary must | 21 | | notify the applicant at the time of application that his | 22 | | signature constitutes consent to registration with the | 23 | | Selective Service System, if he is not already registered. | 24 | | (e) Beginning on or before July 1, 2015, for each original | 25 | | or renewal driver's license application under this Code, the | 26 | | Secretary shall inquire as to whether the applicant is a |

The acceptable forms of proof shall include, but | 4 | | are not limited to, Department of Defense form DD-214, | 5 | | Department of Defense form DD-256 for applicants who did not | 6 | | receive a form DD-214 upon the completion of initial basic | 7 | | training, Department of Defense form DD-2 (Retired), an | 8 | | identification card issued under the federal Veterans | 9 | | Identification Card Act of 2015, or a United States Department | 10 | | of Veterans Affairs summary of benefits letter. If the | 11 | | document cannot be stamped, the Illinois Department of | 12 | | Veterans' Affairs shall provide a certificate to the veteran | 13 | | to provide to the Secretary of State. The Illinois Department | 14 | | of Veterans' Affairs shall advise the Secretary as to what | 15 | | other forms of proof of a person's status as a veteran are | 16 | | acceptable. | 17 | | For each applicant who is issued a driver's license with a | 18 | | veteran designation, the Secretary shall provide the | 19 | | Department of Veterans' Affairs with the applicant's name, | 20 | | address, date of birth, gender and such other demographic | 21 | | information as agreed to by the Secretary and the Department. | 22 | | The Department may take steps necessary to confirm the | 23 | | applicant is a veteran. If after due diligence, including | 24 | | writing to the applicant at the address provided by the | 25 | | Secretary, the Department is unable to verify the applicant's | 26 | | veteran status, the Department shall inform the Secretary, who |

| 1 | | detour or stop, an official school, religious, or other | 2 | | recreational activity supervised by adults and sponsored | 3 | | by a government or governmental agency, a civic | 4 | | organization, or another similar entity that takes | 5 | | responsibility for the licensee, without any detour or | 6 | | stop; | 7 | | (7) exercising First Amendment rights protected by the | 8 | | United States Constitution, such as the free exercise of | 9 | | religion, freedom of speech, and the right of assembly; or | 10 | | (8) married or had been married or is an emancipated | 11 | | minor under the Emancipation of Minors Act. | 12 | | (a-2.5) The driver's license of a person who is 17 years of | 13 | | age and has been licensed for at least 12 months is not invalid | 14 | | as described in subsection (a-1) of this Section while the | 15 | | licensee is participating as an assigned driver in a Safe | 16 | | Rides program that meets the following criteria: | 17 | | (1) the program is sponsored by the Boy Scouts of | 18 | | America or another national public service organization; | 19 | | and | 20 | | (2) the sponsoring organization carries liability | 21 | | insurance covering the program. | 22 | | (a-3) If a graduated driver's license holder over the age | 23 | | of 18 committed an offense against traffic regulations | 24 | | governing the movement of vehicles or any violation of Section | 25 | | 6-107 or Section 12-603.1 of this Code in the 6 months prior to | 26 | | the graduated driver's license holder's 18th birthday, and was |

The Secretary of State may undertake | 19 | | additional efforts, including education and awareness | 20 | | activities, to promote organ and tissue donation. | 21 | | (c) The Secretary of State shall designate on each | 22 | | driver's license issued a space where the licensee may place a | 23 | | sticker or decal of the uniform size as the Secretary may | 24 | | specify, which sticker or decal may indicate in appropriate | 25 | | language that the owner of the license carries an Emergency | 26 | | Medical Information Card. |

The Secretary may not issue any | 4 | | other driver's license which identifies an occupation, status, | 5 | | affiliation, hobby, or other unique characteristics of the | 6 | | license holder which is unrelated to the purpose of the | 7 | | driver's license. | 8 | | (e-5) Beginning on or before July 1, 2015, the Secretary | 9 | | of State shall designate a space on each original or renewal | 10 | | driver's license where, at the request of the applicant, the | 11 | | word "veteran" shall be placed. The veteran designation shall | 12 | | be available to a person identified as a veteran under | 13 | | subsection (e) of Section 6-106 of this Code who was | 14 | | discharged or separated under honorable conditions. | 15 | | (e-7) Upon providing required documentation, at the | 16 | | request of the applicant, the driver's license may reflect | 17 | | Gold Star Family designation. The Secretary shall designate a | 18 | | space on each original or renewal driver's license for such | 19 | | designation. This designation shall be available to a person | 20 | | eligible for Gold Star license plates under subsection (f) of | 21 | | Section 6-106 of this Code. | 22 | | (f) The Secretary of State shall inform all Illinois | 23 | | licensed commercial motor vehicle operators of the | 24 | | requirements of the Uniform Commercial Driver License Act, | 25 | | Article V of this Chapter, and shall make provisions to insure | 26 | | that all drivers, seeking to obtain a commercial driver's |

| 1 | | license, be afforded an opportunity prior to April 1, 1992, to | 2 | | obtain the license. The Secretary is authorized to extend | 3 | | driver's license expiration dates, and assign specific times, | 4 | | dates and locations where these commercial driver's tests | 5 | | shall be conducted. Any applicant, regardless of the current | 6 | | expiration date of the applicant's driver's license, may be | 7 | | subject to any assignment by the Secretary. Failure to comply | 8 | | with the Secretary's assignment may result in the applicant's | 9 | | forfeiture of an opportunity to receive a commercial driver's | 10 | | license prior to April 1, 1992. | 11 | | (g) The Secretary of State shall designate on a driver's | 12 | | license issued, a space where the licensee may indicate that | 13 | | he or she has drafted a living will in accordance with the | 14 | | Illinois Living Will Act or a durable power of attorney for | 15 | | health care in accordance with the Illinois Power of Attorney | 16 | | Act. | 17 | | (g-1) The Secretary of State, in his or her discretion, | 18 | | may designate on each driver's license issued a space where | 19 | | the licensee may place a sticker or decal, issued by the | 20 | | Secretary of State, of uniform size as the Secretary may | 21 | | specify, that shall indicate in appropriate language that the | 22 | | owner of the license has renewed his or her driver's license. | 23 | | (h) A person who acts in good faith in accordance with the | 24 | | terms of this Section is not liable for damages in any civil | 25 | | action or subject to prosecution in any criminal proceeding | 26 | | for his or her act. |
