AMENDMENT TO SENATE BILL 2644

2    AMENDMENT NO. ______. Amend Senate Bill 2644 on page 1,
3line 8, by replacing "The" with "Beginning January 1, 2026,
4the"; and
 
5on page 1, line 12, by replacing "POLST" with "Practitioner
6Order for Life-Sustaining Treatment (POLST)"; and
 
7on page 1, line 14, immediately after "available", by
8inserting "electronically"; and
 
9on page 2, immediately below line 12, by inserting the
10following:
11    "(g) Nothing in this Section requires a health care
12professional or health care provider, including a hospital
13licensed under the Hospital Licensing Act and a hospital
14organized under the University of Illinois Hospital Act, to
15(i) inquire whether a patient has a Department of Public

1Health Uniform POLST form registered on the Advance Directive
2Registry or (ii) access or search the Advance Directive
3Registry to determine whether a patient has registered a
4Department of Public Health Uniform POLST form or the terms of
5the form.
6    (h) A health care professional or health care provider,
7including a hospital licensed under the Hospital Licensing Act
8and a hospital organized under the University of Illinois
9Hospital Act, is not subject to civil or criminal liability or
10professional discipline for failure to access or search the
11Advance Directive Registry. Notwithstanding any other
12provision of this Section, a health care professional or
13health care provider who relies in good faith on the
14provisions of a Department of Public Health Uniform POLST form
15retrieved from the Advance Directive Registry is immune from
16criminal and civil liability as described in subsection (d) of
17Section 65 of the Health Care Surrogate Act.".
