AMENDMENT TO SENATE BILL 1699

2    AMENDMENT NO. ______. Amend Senate Bill 1699 as follows:
 
3on page 1, line 5, by replacing "Section" with "Sections 8.7
4and"; and
 
5on page 1, immediately below line 5, by inserting the
6following:
 
7    "(225 ILCS 90/8.7 new)
8    Sec. 8.7. Criminal history records background check. Each
9applicant for licensure under Sections 8, 8.1, and 11 shall
10have his or her fingerprints submitted to the Illinois State
11Police in an electronic format that complies with the form and
12manner for requesting and furnishing criminal history record
13information as prescribed by the Illinois State Police. These
14fingerprints shall be checked against the Illinois State
15Police and Federal Bureau of Investigation criminal history

1record databases now and hereafter filed. The Illinois State
2Police shall charge applicants a fee for conducting the
3criminal history records check, which shall be deposited into
4the State Police Services Fund and shall not exceed the actual
5cost of the records check. The Illinois State Police shall
6furnish, pursuant to positive identification, records of
7Illinois convictions to the Department. The Department may
8require applicants to pay a separate fingerprinting fee,
9either to the Department or to a vendor designated or approved
10by the Department. The Department, in its discretion, may
11allow an applicant or licensee who does not have reasonable
12access to a designated vendor to provide his or her
13fingerprints in an alternative manner. Communication between
14the Department and an interstate compact governing body or
15other entities may not include information received from the
16Federal Bureau of Investigation relating to a State and
17federal criminal history records check. The Department may
18adopt any rules necessary to implement this Section.".
