AMENDMENT TO SENATE BILL 1250

2    AMENDMENT NO. ______. Amend Senate Bill 1250, AS AMENDED,
3by replacing everything after the enacting clause with the
4following:
 
5    "Section 1. Short title. This Act may be cited as the
6Sprayed Fire-Resistant Material Applicator Act.
 
7    Section 5. Definitions. As used in this Act:
8    "Office" means the Office of the State Fire Marshal.
9    "Sprayed fire-resistant material" means a cementitious or
10fibrous material that is applied onto a steel structure
11through a spray process to provide fire-resistant protection
12to the steel structure.
13    "Sprayed fire-resistant material applicator" means an
14individual in the business of applying sprayed fire-resistant
15material.

1    Section 10. Fire-resistant material applicator
2registration.
3    (a) Beginning July 1, 2026, it is unlawful for a person to
4engage in business as a sprayed fire-resistant material
5applicator in this State without being registered with the
6Office as provided in this Act. A person who violates this
7Section may be assessed a civil penalty by the Office of up to
8$250 for each violation. Each day's violation constitutes a
9separate offense. The Attorney General or the State's Attorney
10of the county in which the violation occurs may bring an action
11in the name of the People of the State of Illinois or may, in
12addition to other remedies provided in this Act, bring an
13action for an injunction to restrain a violation of this
14subsection.
15    (b) The Office shall:
16        (1) register persons as sprayed fire-resistant
17    material applicators; and
18        (2) establish requirements for the registration of
19    sprayed fire-resistant material applicators that includes
20    a requirement for proof of training or certification.
21    (c) A person seeking registration as a sprayed
22fire-resistant material applicator shall meet the requirements
23established by the Office to register as a sprayed
24fire-resistant material applicator.
25    (d) Registration as a sprayed fire-resistant material
26applicator must be renewed every 3 years.

1    Section 15. Rules and fees.
2    (a) By July 1, 2025, the Office shall adopt rules
3consistent with the provisions of this Act for the
4administration and enforcement of this Act. The Office may
5prescribe forms to be issued in connection with the
6administration and enforcement of this Act.
7    (b) The Office may, by rule, establish fees, including,
8but not limited to, registration fees and processing fees. All
9fees collected pursuant to this Act shall be deposited into
10the Fire Prevention Fund. All fees paid pursuant to this Act
11are nonrefundable. This shall not preclude the Office from
12refunding accidental overpayment of fees.
 
13    Section 20. Exemptions. This Act does not apply to sprayed
14fire-resistant material applicators at facilities licensed by
15the federal Nuclear Regulatory Commission under 10 CFR 50 or
1610 CFR 52 or to employees of those facilities while engaged in
17the performance of their official duties.
 
18    Section 99. Effective date. This Act takes effect upon
19becoming law.".
