| 2 | | AMENDMENT NO. ______. Amend Senate Bill 858 by replacing | 3 | | everything after the enacting clause with the following: | 4 | | "Section 5. The Illinois Criminal Justice Information Act | 5 | | is amended by changing Section 7.9 as follows: | 6 | | (20 ILCS 3930/7.9) | 7 | | (Section scheduled to be repealed on July 1, 2027) | 8 | | Sec. 7.9. Firearm Prohibitors and Records Improvement Task | 9 | | Force. | 10 | | (a) As used in this Section, "firearms prohibitor" means | 11 | | any factor listed in Section 4 of the Firearm Owners | 12 | | Identification Card Act or Section 24-3 or 24-3.1 of the | 13 | | Criminal Code of 2012 that prohibits a person from | 14 | | transferring or possessing a firearm, firearm ammunition, | 15 | | Firearm Owner's Identification Card, or concealed carry | 16 | | license. |

| 1 | | (b) The Firearm Prohibitors and Records Improvement Task | 2 | | Force is created to identify and research all available | 3 | | grants, resources, and revenue that may be applied for and | 4 | | used by all entities responsible for reporting federal and | 5 | | State firearm prohibitors to the Illinois State Police and the | 6 | | National Instant Criminal Background Check System. Under the | 7 | | Firearm Owners Identification Card Act, these reporting | 8 | | entities include, but are not limited to, hospitals, courts, | 9 | | law enforcement and corrections. The Task Force shall identify | 10 | | weaknesses in reporting and recommend a strategy to direct | 11 | | resources and revenue to ensuring reporting is reliable, | 12 | | accurate, and timely. The Task Force shall inventory all | 13 | | statutorily mandated firearm and gun violence related data | 14 | | collection and reporting requirements, along with the agency | 15 | | responsible for collecting that data, and identify gaps in | 16 | | those requirements. The Task Force shall submit a coordinated | 17 | | application with and through the Illinois Criminal Justice | 18 | | Information Authority for federal funds from the National | 19 | | Criminal History Improvement Program and the NICS Acts Record | 20 | | Improvement Program. The Firearm Prohibitors and Records | 21 | | Improvement Task Force shall be comprised of the following | 22 | | members, all of whom shall serve without compensation: | 23 | | (1) the Executive Director of the Illinois Criminal | 24 | | Justice Information Authority or the Executive Director's | 25 | | designee , who shall serve as Chair; | 26 | | (2) the Director of the Illinois State Police, or his |

| 1 | | or her designee; | 2 | | (3) the Secretary of Human Services, or his or her | 3 | | designee; | 4 | | (4) the Director of Corrections, or his or her | 5 | | designee; | 6 | | (5) the Attorney General, or his or her designee; | 7 | | (6) the Director of the Administrative Office of the | 8 | | Illinois Courts, or his or her designee; | 9 | | (7) a representative of an association representing | 10 | | circuit clerks appointed by the President of the Senate; | 11 | | (8) a representative of an association representing | 12 | | sheriffs appointed by the House Minority Leader; | 13 | | (9) a representative of an association representing | 14 | | State's Attorneys appointed by the House Minority Leader; | 15 | | (10) a representative of an association representing | 16 | | chiefs of police appointed by the Senate Minority Leader; | 17 | | (11) a representative of an association representing | 18 | | hospitals appointed by the Speaker of the House of | 19 | | Representatives; | 20 | | (12) a representative of an association representing | 21 | | counties appointed by the President of the Senate; and | 22 | | (13) a representative of an association representing | 23 | | municipalities appointed by the Speaker of the House of | 24 | | Representatives. | 25 | | (c) The Illinois Criminal Justice Information Authority | 26 | | shall provide administrative and other support to the Task |

The Illinois State Police Division of Justice Services | 2 | | shall also provide support to the Illinois Criminal Justice | 3 | | Information Authority and the Task Force. | 4 | | (d) The Task Force may meet in person or virtually and | 5 | | shall issue a written report of its findings and | 6 | | recommendations to General Assembly on or before July 1, 2022. | 7 | | The Task Force shall issue an annual report, which shall | 8 | | include information on the state of FOID data, including a | 9 | | review of previous activity by the Task Force to close | 10 | | previously identified gaps; identifying known (or new) gaps; a | 11 | | proposal of policy and practice recommendations to close those | 12 | | gaps; and a preview of expected activities of the Task Force | 13 | | for the coming year. | 14 | | (e) Within 60 days of the effective date of this | 15 | | amendatory Act of the 102nd General Assembly, the Chair shall | 16 | | establish the Task Force. | 17 | | (f) This Section is repealed on July 1, 2027. | 18 | | (Source: P.A. 102-237, eff. 1-1-22 .)". |
